Approval of the Minutes of April 9, 1979 Jensen x Motion: The Minutes of the Regular Commission Meeting be Mhoon x approved as submitted. Minton x x Van Ness x x * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Howell x Advisory Planning Board chair recognized Mr. John Andresen, Chairman of the Advisory Planning ard, who presented a report of the Planning Board meeting. Mr. Andresen advised that the PUD application of Mr. & Mrs. Siakel was approved with the following stipulations: there should be a five foot easement down the rear of the building; individual water meters should be installed for each apartment; eliminate the proposed two-car garage and install four parking stalls, and make all interested parties aware of the fact that the present 20 parking spaces are all on-street parking. There is no private property parking available on 10th Street. x Motion: Accept the recommendation of the Planning Board and pass JenMhosen x the PUD application for a Public Hearing to be held on Minton x x May 28, 1979. Van Ness x x * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Howell x Mr. Andresen also reported that the Board had unanimously approved the application of Mr. Mike Ash to construct a six unit complex on two lots in Saltair Section 3 under Planned Unit Development. Mayor Howell injected that Mr. Ash's application had been turned down by the Commission on April 9, 1979. Mr. Ash corrected his errors in the plans and went before the Planning Board. After a short discussion, the following motion was made with Commissioners Jensen, Mhoon, Van Ness, and Mayor Howell voting yes, and Commissioner Minton voting no. M S Y N City Manager's Report Mr. Davis verbally presented his report and requested permission to pay several bills as follows: 1. Coffman & Coleman, attorneys, in the amount of $591.97 for services rendered in the month of February, 1979 on cases they are handling for the City. Jensen x Motion: Approve payment of $591.97 to Coffman & Coleman for Mhoon x x services rendered in the month of February, 1979. The award of said fees was rendered by PERC in its order dated November 27, 1978. Motion: Approve payment, in the amount of $6,400. to Rod Jensen x Smith and Hal Johnson, attorneys in the case of Mhoon x x Murphy vs City of Atlantic Beach. Minton x x Van Ness x * * * * * * * * * * * * * * * * * * * * * * * * * * * * ** * Howell { x Mr. Davis also reported that the sub-contractor has now completed the re-paving of the dip in the roadway on Sherry Drive, and that the sidewalk project on Seaspray between the elementary school and Seminole Road has commenced using in-house work force. New Business A. Donald Pack re proposed wholesale and retail seafood market. Mr. Davis explained that Mr. Pack was in need of an expression of feel- ing from the Commission to operate a wholesale and retail seafood market at Mayport Road and West 6th Street. Mr. Pack was in need of this for financing purposes before actually acquiring the property. A short discussion followed concerning the body of a letter the City Manager had furnished, and it was agreed Mr. Davis would prepare a revised letter the next day. 11/11 ion on Resolutions - Utility Revenue Bond Interest Coupons Redeemed Mayor Howell presented and read in full a Resolution redeeming interest coupons on the Utility Revenue Bond Issue. Minton x Van Ness x x * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Howell x Mayor Howell announced that The Jacksonville Beaches CATV Board will be holding a Public Hearing on a proposed Ordinance on May 8, 1979 at 7:00 P.M. at the Neptune Beach City Hall. All interested parties are invited to attend. Mr. Davis advised that the Mayor of Jacksonville had appointed him to the Duval County Energy Emergency Panel. I respectfully request permission to pay this bill. The City has received a bill from Mr. Walter J. Parks, Jr. , for services rendered over an extended period of time, some of which transpired prior to my being appointed City Manager. Those items dated after April 1979 I have looked at and know that Mr. Parks assisted in these matters. I respectfully request permission to pay this bill. 1111 Additionally, we have the attorney's fees to be paid in Murphy vs. City of Atlantic Beach. The amount of $6;400 as payment has been negotiated as settlement in this issue. The award of said fees was rendered by PERC in its order dated November 27, 1978. I respectfully request permission to pay the same. RESOLVED BY,, THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA, that the following numbered interest coupons be burned: Coupons # 45 and 46 from Bonds 192 - 201 The above and foregoing Resolution passed by the City Commibsion on April 23 1979.
