Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, DECEMBER 23, 1974, AT 8: 00 P . M. PRESENT: William S. Howell, Mayor-Commissioner L. W. Minton, Jr. Robert R. Rosborough, II F. W. Fogg Robert B. Cook, Sr. , Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk ABSENT: None The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag, The minutes of the meeting of December 9, 1974 were approved as written upon a motion by Commissioner Cook, seconded by Commissioner Fogg and carried. Recognition of Visitors Mr. Francis Backus, Ocean Village One, Apartment No. 20, North Atlantic Beach requested that the water be turned on at his condo- minium. Mayor Howell stated that on October 28, 1974 the City Commission instructed the City Manager not to turn on any more water at Ocean Village One until a bill for approximately $600.00 is paid to the City of Atlantic Beach. Mr. Backus stated that he had pur- chased the condominium prior to construction and was unaware that water and sewage was not available. Commissioner Cook suggested that the City Commission set a firm policy on future water service to Ocean Village One. It was moved by Commissioner Fogg, seconded by Commissioner Minton and carried that those people who legitimately purchased a condominium prior to the City Commission action of October 28, 1974 be allowed to pay the delinquent water bill for their own unit and water service will be restored. The Ocean State Bank - PUD on Plaza Mr. Jim Burton, Vice President of Ocean State Bank, requested per- mission to build a drive-in bank on Plaza. The Advisory Planning Board recommended approval of this application for a Planned Unit Development. It was moved by Commissioner Fogg, seconded by Com- missioner Minton and carried that the application for Planned Unit Development of the Ocean State Bank be approved. Johnson Construction Co. - Addition to Building Plans were submitted to the City Commission for approval of an addition to the J. R. Johnson Construction Co. , 780 Atlantic Blvd. The plans and specifications meet the Southern Standard Building Code and all zoning requirements . it was moved by Commissioner Minton, seconded by Commissioner Fogg and carried that the plans for an addition to the J. R. Johnson Construction Company, 780 Atlantic Blvd. be approved. Codification of Atlantic Beach Charter - Michie City Mr. Vogel requested permission to purchase one hundred sets of the Code of Atlantic Beach for $1,428.00 and twenty-five binders at $9.00 each. it was moved by Commissioner Minton, seconded by Com- missioner Rosborough and carried that the City Manager be given permission to purchase the codes and binders for the city. Ordinance No. 10-74-11 Alcbholic Beverages - Public Hearing Ordinance No. 10-74-11 amending by adding thereto Ordinance No. 10- 61-8 by an ordinance entitled "Alcoholic Beverages" , regulating the consumption of alcoholic beverages on vendors ' premises was presented in full and read on third and final reading by Mayor Howell. Said ordinance was posted in line with charter requirements. He then declared the meeting in session for a public hearing. As no one appeared either for or against said ordinance, Mayor Howell declared the public hearing closed. Commissioner Minton moved for passage of Ordinance No. 10-74-11 on third and final reading, seconded by Commissioner Fogg and carried. Resolution No. 74-12 Personnel Rules and Regulations Mayor Howell presented Resolution No. 74-12 establishing personnel rules and regulations for the City of Atlantic Beach. It was moved by Commissioner Cook, seconded by Commissioner Minton and carried that Resolution No. 74-12 be adopted. Copy cf Resolution No. 74-12 is attached hereto and made a part hereof. Mayor Howell reported on the Charter Revision meeting in Jacksonville with the Duval delegation and the city councils He stated that the majority of member of the Duval delegation were ready to pass the admendments as recommended by the attorney for the Duval delegation, MINUTES DECEMBER 23, 1974 PAGE THREE the attorney for the City cf Jacksonville and the attorney for the Beaches and the Town of Baldwin. However, one or two of the council- men from Jacksonville brought up a number of points which threw everything into a total state of confusion to the point that the Duval delegation and members cf the committee were so frustrated with the proceedings that the Duval delegation moved that the meeting adjourn and the committee be disolved. Mayor Howell stated that several months ago the city had a request from the Almond Construction Company for water and sewer service to Oak Harbor. At that time, the city was attempting to double the size of the sewer plant but because of the environmental control the city was unable to start this project. The Almond Company has presented a set of plans for furnishing water to them in con- nection with their project. It was moved by Commissioner Minton, seconded by Commissioner Rcsborough and carried that the plans be turned over to the city engineer for his study and recommendations. Howell (Seal) Mayor-Commissioner ATTEST: Gloria Ju e Knight City Clerk RESOLUTION NO. 74-12 PERSONNEL RULES AND REGULATIONS FOR THE CITY OF ATLANTIC BEACH, FLORIDA WHEREAS, the Federal Government has enacted the Fair Labor Standards Act which applies to State and Local Government employees, and WHEREAS, said act includes minimum wage, overtime, wage payments, equal pay, age discrimination, child labor, executive, administrative and professional employees, fire protection and law enforcement personnel, and WHEREAS, Section 26 of the Charter of the City of Atlantic Beach provides that the City Manager shall be the Chief Executive Officer and head of the Administrative Branch of the City Government. NOW, THEREFORE, BE IT RESOLVED THAT THE CITY MANAGER SHALL BE RESPONSIBLE TO THE CITY COMMISSION FOR THE PROPER ADMINISTRATION OF THE FAIR LABOR STANDARDS ACT, AND IS ALSO DIRECTED TO UPDATE THE PRESENT PERSONNEL PROGRAM TO COMPLY WITH FEDERAL REGULATIONS. * * * * * * * * * * * * * * * * Adopted by the City Commission of the City of Atlantic Beach, Florida, on December 23, 1974.
