City Manager 11. Conissioners 12. Mayor 13. Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, NOVEMBER 11, 1974, AT 8:00 P . M. PRESENT: William S . Howell, Mayor-Commissioner L. W. Minton, Jr. Robert R. Rosborough, II F , W. Fogg Robert B. Cook, Sr. , Commissioners AND R. C. Vogel, City Manager Oliver C . Ball, City Attorney Gloria June Knight, City Clerk ABSENT: None The meeting was called to order by Mayor-Commissioner, Mr. Howell . The invocation was given by Commissioner Minton, followed by the pledge to the flag . The minutes of the meeting of October 28, 1974 were approved as written upon a motion by Commissioner Fogg, seconded by Commissioner Rosborough and carried. Recognition of Visitors Mrs. Paluszynsi, 955 Sailfish Drive, asked if anything could be done about the Royal Palms Theatre allowing under-age children to see "R" rated movies? Mr. Ball, City Attorney, stated that the City of Atlantic Beach has a pornography ordinance that is quite explicit. Mr. Vogel stated that if Mrs . Paluszynsi knew of such violations of the law, she should sign a complaint. Chief Stucki stated that to his knowledge, the police department has not received official complaints from any parents . Mayor Howell suggested that the Chief of Police call on the manager of Royal Palms I and II , discuss this problem with him and give him a copy of the city ' s ordinance on pornography. Bid Openings - Garbage Truck Sutherlin Chevrolet, Jacksonville Beach, Florida Garbage Truck Chassis and Body Net $22, 914. 93 This price is subject to an increase on the FMVSS121- Anti-Skid System Law on all air brake vehicle effective March 1, 1975. MINUTES NOVEMBER 11, 1974 PAGE TWO Lee Chevrolet, Inc. , Jacksonville, Florida Garbage Truck Chassis and Body Net $23, 999.00 Mayor Howell suggested that the bids be referred to committee for study due to the special contingency concerning the Air Brake Vehicle law effective March 1, 1975. It was moved by Commissioner Minton, seconded by Commissioner Fogg and carried that the bids be sent to committee for study and report back at the next meeting . The Mayor appointed Commissioner Rosborough, Mr. Hilliard and the City Manager to serve on this committee. Ordinance No . 10-74-10 Mayor Howell read Ordinance No. 10-74-10 regulating the hours for the sale of alcoholic and intoxicating beverage in the City of Atlantic Beach on first reading by title only. Said ordinance was presented in full and in writing. Commissioner Rosborough moved that Ordinance No. 10-74-10 be approved on first reading by title only, seconded by Commissioner Minton and carried. Public. Hearing to be held December 9, 1974. The City Clerk reported that she had received a request from Craft Motors, Inc. , 1930 Mayport Road requesting a refund on an occupa- tional license purchased from the city. He has gone out of business and requested that the money be refunded. Mayor Howell stated that the City Commission cannot refund money on occupational license. The City Clerk was instructed to write Craft Motors, Inc. and advise him that a refund will not be forthcoming. Mr. Vogel stated he had received a letter from Warren Brothers giving a firm quotation on limerock at $4.65 per ton and asphalt for paving at $13 .50 per ton. He requested commission approval to purchase limerock and asphalt at these prices when needed. Mro Vogel stated that asphalt is a petroleum product and the city has to take it when they can get it . It was moved by Commissioner Fogg, seconded by Commissioner Minton and carried that the City Manager be allowed to purchase limerock and asphalt, as needed, without the City Commission ' s approval. Commissioner Minton asked about supplements to the Code of the City of Atlantic Beach. Mrs. Knight stated that all the ordinances have been sent to the publishers for codification. MINUTES OCTOBER 11, 1974 PAGE THREE Mayor Howell stated that there will be a meeting Wednesday, Nov. 13, 1974 at 1: 30, City Hallo Jacksonville, Florida, concerning the $475, 000 ,00 that the city is due from the City of Jacksonville.
