MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, OCTOBER 28, 1974, AT 8:00 P . M.

The meeting was called to order by Mayor-Commissioner, Mr. Howell.
The invocation was given by Commissioner Minton, followed by the
pledge to the flag.
The minutes of the meeting of October 14, 1974 were approved as
written upon a motion by Commissioner Cook, seconded by Commissioner
Rosborough and carried°
Recognition of Visitors
Mrs. William Koenig, 780 Redfin Drive, stated that she appreciated
the additional speed signs placed in the Royal Palms area but
people are still violating the law by speeding . She asked if
stop signs could be place at the Pic N Save exits? Mr. Hilliard
stated that the Pic N Save was private property and the city has
no control over private property.
Mrs. Page, 920 Sailfish Drive, requested speed bumps be installed
throughout Royal Palms. She stated that the Highway Department
informed her that it was legal, Mayor Howell stated that a
liability situation existed when a city installs speed bumps, Mr.
Vogel stated that speed bumps do not prevent accidents.
Mrs. Paluszynsi, 955 Sailfish Drive, stated that she was concerned
about the recent articles in the newspaper about the number of
missing children. She suggested that parents could place a sign
in the window with "Helping Hand" imprinted and any child in dis-
tress or trouble could go to that home for help. Mr. Vogel stated
that the idea was basically sound, but the city could not get in-
volved with this unless the volunteers submit to interrogation
and examination by the Police Department and then the city could
endorse such a program upon the recommendation of Chief Stucki.

Mayor Howell suggested that Mrsn Paluszynsi obtain more information
on this type of operation from other cities and bring it back before
the City Commission.
Fletcher senior High - Band Parents Association
The city received a request to place an ad in the Concert Band Pro-
gram for the Fletcher High School. It was moved by Commissioner
Fogg; seconded by Commissioner Rosborough and carried that the City
of Atlantic Beach place an ad in the Fletcher High School Concert
Band Program in the amount of $40n00 to be taken from account 206
Ordinance No, 55-74-14 Plumbing Code - Final Reading - Public Hearing
Mayor Howell read Ordinance Noe 55-74-14 amending the Code of the
City of Atlantic Beach, Chapter 17 entitled "Plumbing" being an
ordinance "Providing for the Regulation and Governing of Plumbing
Construction, and Certification of Master and Journeyman Plumbers"
in full on third and final reading. Said ordinance was posted in
line with charter requirements . Mayor Howell then declared the
meeting in session for a public hearing° As no one appeared either
for or against said ordinance, Mayor Howell declared the public
hearing closed. Commissioner Minton moved for passage of Ordinance
No, 55-74-14 on third and final reading, seconded by Commissioner
Fogg and carried.
Resolution Noe 74-10 - 701 Local Planning Assistance
Mayor Howell presented Resolution Non 74-10 requesting the State of
Florida Department of Community Affairs to include the City of
Atlantic Beach in its application for planning assistance for 1975 .
It was moved by Commissioner Fogg, seconded by Commissioner Ros-
borough and carried that Resolution No. 74-10 be adopted. Copy
of said resolution is attached hereto and made a part hereof°
Jones, Forester and Hodge - Rezoning Saltair Sec. 2 Business A
Mayor Howell stated that the above item was withdrawn from the agenda.
Mills & Lewis Building Service - Building Permit on Unit B of M & L
Office Complex, Donner Road
Mr. Vogel presented plans to the City Commission for an addition to
Unit B of the Mills and Lewis Complex, Donner Road. The plans and
specifications meet the required zoning and the Southern Standard
Building Code. It was moved by Commissioner Minton, seconded by

Commissioner Cook and carried that the plans be approved.
Mre Vogel presented plans for a warehouse located on Roberts Street,
being more particularly described as the North 100 feet, Lot 4,
Block 4, Donner Replato This request for approval of the plans was
inadvertently obmitted from the agenda and Mr. Vogel suggested
that the rules be waived. The plans and specifications meet the
zoning requirements and the Southern Standard Building Code. It
was moved by Commissioner Cook, seconded by Commissioner Minton and
carried that the rules be waived and the plans and specifications
be approved as presented.
John B. Chandler Co. - Portable Building on Levy Road
Mr. Vogel presented plans and specifications from Mre John B .
Chandler to place a portable warehouse on Levy Road. (Being more
particularly described as part of Government Lot 4, Section 17,
Township 2 South, Range 29 East of the current public records of
Duval County) . Mro Hilliard stated that the City Code prevented
any type portable building. The city requires foundations, footings,
ground clearance and anchorage on any buildings. Commissioner
Minton moved that this request be denied, seconded by Commissioner
Fogg and carried.
Mrs . Paluszynsi
Mrs. Paluszynsi stated that she had several items to be discussed
before the City Commission. The following is a brief summary of
her statements and questions.
"1. A clarafication of the procedure for obtaining a building
permit to enclose a carport and the provision for off-
street parking. She stated that she had obtained a permit
to enclose her carport and was told that she would need
off-street parking and that limerock would be acceptable.
Now, I am informed that it must be paved with concrete or
blacktoppedo
2e Why is is necessary to purchase new police cars every year?
3 , In January of this year a large group of people attended
the City Commission meeting and asked to be informed of
the laws and ordinances of the city. It was suggested,
at that time, that we form a smaller group of approxi-
mately six or eight people. We formed the committee nine
months ago and to date we have been unable to accomplish
anything because of the lack of cooperation of the city.

4. The City Commission complains that they are paid $10.00
per month. The commissioners knew the salary when they
accepted the job and if it is not enough, perhaps, the
commissioners should step down and let someone else
take their place. "
Mayor Howell suggested that the City Commission consider each one
of these points one at a time.
In reference to the off-street parking, Mr, Vogel quoted from
the ordinance. . "for each family dwelling unit of any building
hereafter erected for dwelling purposes, there shall be pro-
vided on the same lot therewith not less than one off-street paved
parking space. Such off-street paved parking space shall not
occupy any part of a required front yard" . (Section 28-5 - of the
Code of Atlantic Beach)
Mayor Howell stated that he did not know about Mrs . Paluszynsi ' s
particular case wherein she was told that the off-street parking
could be filled with limerock. If you were told limerock, then
I for one will be very happy to stand behind you should you have
to appear before the municipal court and will suggest to the judge
that in your particular case this requirement be waived due to
misinfromation given to you at the time you applied for your build-
ing permit. Mayor Howell stated that approximately 25 letters
were sent out this past week to those citizens who are in violation
of the building code. At this time, Mayor Howell stated that when
the ordinance states "paved" it means only one of two things, con-
crete or blacktop.
On the question of purchasing new police cars every year, Mayor
Howell stated that our police cars are used 24 hours a day, seven
days a week. The city intends to have competent, reliable equip-
ment that the police can travel in and in order to do this the cars
must be traded every year. The expense of maintaining the equip-
ment after a year gets beyond the economic point of trying to keep
them running.
In reference to the committee being formed in Royal Palms, Mrs.
Gregg came to my office and we discussed the matter and to the best
of my knowledge Mr. Hilliard and the Public Works Department
carried out the suggestions made by the committee to the best of
the city' s ability. Since that time I have heard nothing from this
committee.

Mr. Vogel explained the pay scale of the city commission. The
annual salary of the commissioners shall be one hundred twenty
dollars until changed by ordinance, but shall not be increased
during the current term of commissioners enacting such ordinance.
None of the previous commissions have taken the initiative to
change the charter provision.
Mayor Howell explained that if anyone feels that an ordinance is
unconstitutional, it may be changed by the right of the initiative
and you are free to do so if you wish to follow that provision in
the City Charter.
Report on the Florida League of Cities Convention
Mayor Howell reported on the recent Florida League of Cities
Convention held in Tampa, Florida . The following resolutions
were passed°
A resolution urges that utility taxes levied by muncipa-
lities be maintained,
A resolution supporting the proposed State Constitutional
Amendment No, 6 to amend section 10 of Article VII of the
State Constitution to allow laws to authorize "Municipal-
Private Electric Company" joint ventures,
A resolution opposing proposal to exempt from federal in-
come taxes any interest income earned on bonds issued by
non-government, private, investor-owned utilities .
A resolution to oppose the Bureau of Criminal Justice
Planning and Assistance Standard PO-5 .02--Combined Police
Service.
A resolution urging the Department of Transportation of
the State of Florida to place greater emphasis upon
maintenance of state rights-of-way with cities.
A resolution was tabled proposing that the State of Florida
legislate to grant funds for the purpose of beach maintenance
to cities having public beaches .
A resolution reiterating the position of the FLC regarding
income tax relief from utility taxes .

A seminar was held on the Public Disclosure & Conflict of Interest
Act.
Oliver C . Ballo City Attorney, reported that Mayor Howell was re-
elected to the Board of Directors for the Florida Leggue of Cities.
Mr. Hilliard stated • at Ocean Village I, North Atlantic Beach,
there are quite a few emply condominiums . He has pulled and tagged
all the water meters in the empty condominiums. Mr. Hilliard re-
ported that they have used 392,000 gallons of water in the empty
buildings. Mayor Howell stated that according to the report and
figures given him by Mr. Hilliard, the developers of Ocean Village
I owes the city $584.64 for water. After discussion, it was moved
by Commissioner Minton, seconded by Commissioner Fogg and carried
that the City Manager be instructed not to turn on any more water
until such time as the $584.64 has been paid in full, a meter in-
stalled on .the swimming pool and the lift station.
Mr. Hilliard stated that the contractor doing the work on the park.
in Selva Marina is unable to complete the work. He suggested a
committee be formed to work out plans to complete the work. Mayor
Howell appointed Commissioner Cook, Mr. Vogel and Mr. Hilliard,
along with the contractor, Mr. Parsons . The City Manager to arrange
the time and place of the meeting .
There being no further business Mayor Howell declared the meeting
adjourned.

RESOLUTION NO. 74-10
RESOLUTION REQUESTING THE STATE OF FLORIDA
DEPARTMENT OF COMMUNITY AFFAIRS TO INCLUDE
THE CITY OF ATLANTIC BEACH IN ITS APPLICATION
FOR PLANNING ASSISTANCE FUNDS FOR 1975
WHEREAS , the Board of City Commissioners of Atlantic Beach
has recognized certain problems in the Community which relate
to planning and management , and
WHEREAS, the Comprehensive Planning Assistance Program
administered by the State of Florida Department of Community
Affairs offers the opportunity to strengthen the community
development process through the conduct of a planning program,
NOW, THEREFORE, the Board of City Commissioners of Atlantic
Beach officially requests the State of Florida Department of
Community Affairs to include Atlantic Beach in its application tc
the U. S. Department of Housing and Urban Development for local
planning assistance funds for the fiscal year beginning July 1,
1975.

Affairs , the City of Atlantic Beach is submitting the following
inventory of problem areas in the community:
