Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, SEPTEMBER 23, 1974, AT 8:00 P M. PRESENT: William S . Howell, Mayor-Commissioner L. W. Minton, Jr. F. W. Fogg Robert R. Rosborough, II , Commissioners AND R. C . Vogel, City Manager Oliver C . Ball, City Attorney Gloria June Knight, City Clerk ABSENT: Robert B. Cook, Sr. , Commissioners The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of September 9, 1974 were approved as written upon a motion by Commissioner Rosborough, seconded by Commissioner Fogg and carried. Recognition of Visitors Mr. Burt Claiborne, 1042 Beach Avenue, requested permission to speak before the City Commission. Mr. Claiborne stated that he would like for the City Commission to think about the financial aspects of the city just as they do their own business and personal budgets. The City Commission is in effect the Board of Directors of a million dollar corporation and the citizens are the stockholders. He urged the City Commission to be tough on the City Manager. Mr. Claiborne stated that it behooves all of us, in the months ahead, to take a good look at the expenditures of the city and cut all the corners that are possible. Ordinance No. 55-74-16 Garbage Fees - Final Reading Mayor Howell read Ordinance No. 55-74-16 amending Chapter 18 of the Code of the City of Atlantic Beach and regulating the accumulation, removal and disposal of garbage and garden trash in residential and business zones and areas within the limits of the City of Atlantic Beach, Florida in full, in writing and read on third and final read- ing. Said ordinance was posted in line with charter requirements. Mayor Howell then declared the meeting in session for a public hear- ing. Mr. Burt Claiborne asked how these changes compared with the rates for an independent company? Mr, Vogel stated that the City of MINUTES SEPTEMBER 23, 1974 PAGE TWO Atlantic Beach is still cheaper. To get equivalent service from an independent company, it would cost the taxpayers twice as much. Mr. Paul Fox, Fox Garden Apartments, stated that he was glad and pround to build in the City of Atlantic Beach and thought the new rates were reasonable and fair. There being no further discussion, Mayor Howell declared the public hearing closed, Commissioner Fogg moved for passage of Ordinance Noe 55-74-16 on third and final reading, seconded by Commissioner Minton and carried. Ordinance No. 20-74-29 Budget 1974-75 Final Reading Public Hearing Mayor Howell read Ordinance Noe 20-74-29 adopting the budget for the City of Atlantic Beach, Florida, for the fiscal year 1974-75 and appropriating money to provide for the debts and expenses of the City of Atlantic Beach in full, in writing and on third and final reading. Said ordinance was posted in line with charter require- ments . Mayor Howell then declare the meeting in session for a pub- lic hearing . Mr. Burt Claiborne stated that the City Commission should be congratulated on being able to lower the millage rate at 4.0222 per $1,000,00. As no one else wish to speak either for or against said ordinance, Mayor Howell declared the public hearing closed, Commissioner Rosborough move for passage of Ordinance Noo 20-74-29 on third and final reading, seconded by Commissioner Minton and carried. Resolution Noo 74-9 Budget Transfers Mayor Howell presented Resolution Noe 74-9 covering budget transfers and changes in the 1973-74 Budget. It was moved by Commissioner Minton, seconded by Commissioner Fogg and carried that Resolution No. 74-9 be adopted. Copy of said resolution is attached hereto and made a part hereof. Ordinance Noe 55-74-1 4 Plumbing Code - First Reading Mayor Howell read Ordinance Noe 55-74-1 4 amending the code of the City of Atlantic Beach, Chapter 17 entitled "Plumbing" being an ordinance "Providing For The Regulation and Governing of Plumbing Construction, and the Certification of Master and Journeyman Plumb- ers" on first reading by title only, Said ordinance was presented in full and in writing. Commissioner Minton moved that Ordinance No. 55-74-13 be approved on first reading by title only, seconded by Commissioner Fogg and carried, Public Hearing to be held October 28, 1974. MINUTES SEPTEMBER 23, 1974 PAGE THREE Trade of Garbage and Trash Trucks with City of Neptune Beach Mr. Hilliard, Director of Public Works, asked for Commission approval to trade a garbage truck for a large trash truck. This trade will be with the City of Neptune Beach. Mr. Hilliard ex- plained that it would be an even swap and no money would be exchang- ed. It was moved by Commissioner Minton, seconded by Commissioner Fogg and carried that the trade be approved and the City Clerk be authorized to transfer the title. Gloria June Knight, City Clerk, reported that the sale of Occupa- tional Licenses was going well and that the refunding of the money from Jacksonville and the collection for the past two years has been expediated with very few problems . Ocean Village One - North Atlantic Beach Mr. Vogel stated that he had recently had correspondence with Mr. Milton Lionheart and Mr. Hertz Rotenstein, owner of Ocean Village One. The letter stated the following: "Enclosed are copies of two letters, one addressed to Mro Ca Eo Bohannon, Earth Movers and Utility Corporation, and the other copy is a copy of a letter of July 9, 1974 addressed to both of you gentlemen. Mr. Parks advised me this date via telephone, that the final inspection has not been completed and in fact we have had no response to the above mentioned letters. This matter can no longer be ignored and unless corrective action has been taken before our next Commission Meeting on September 23, 1974, this matter will be reported to the Commission for their official action. We cannot recommend to the City Commission that sewer service to your apartment complex be continued until it has been demon- strated to our satisfaction that we are not receiving excessive quantities of ground water from your installations Subject to Commission action, we will have no alternative but to dis- continue service until we have received a satisfactory response from you. " Mr. Vogel stated that he had attempted to contact Mr. Bohannon, Earth Movers & Utilities Corporation, and to date neither he nor Mr. Parks, City Engineer, have received any correspondence from him. MINUTES SEPTEMBER 23, 1974 PAGE FOUR Mr. Vogel suggested that the city notify Mr. Rotenstein and Mr. Lionheart, owners of Ocean Village One, that unless they take the necessary steps to meet the plans and specifications as drawn up by the City Engineer and have complied with his letter of September 11, 1974, that the water service will not be available to new tennantso It was moved by Commissioner Minton, seconded by Com- missioner Fogg and carried that the City Manager notify Ocean Village One that there will be no more water service cut-on until the letter of September 11, 1974 is complied with and that the City Commission turn the matter over to the City Attorney to in- stigate the necessary legal procedures . Commissioner Rosborough asked the status of the work to be com- pleted in Selva Marina Park? Mayor Howell stated that the con- tractor, Mr. Parson, will be unable to complete the work due to ground being too wet .
