Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, SEPTEMBER 9, 1974, AT 8:00 P . M. PRESENT: William S. Howell, Mayor Commissioner L. W. Minton, Jr. F. W. Fogg Robert R. Rosborough, II Robert B. Cook, Sr. , Commissioners AND R. C . Vogel, City Manager Oliver Ce Ball, City Attorney Gloria June Knight, City Clerk ABSENT: None The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of August 26, 1974 were approved as written upon a motion by Commissioner Minton, seconded by Commissioner Cook and carried. Correspondence The City Commission received a letter from McCall Service, Inc. thanking the City Commission for their support and cooperation during the past year. The manager of McCall Service, Inc. invited the employees and city officials to attend their picnic, September 21, 1974, at the Jack Russell Park. Bishop Kenny High School The city received a request to place an ad in the Crusader Year Book. It was moved by Commissioner Minton, seconded by Commissioner Cook and carried that the City of Atlantic Beach place an ad in the Bishop Kenny Crusader Year Book in the amount of $50.00 to be taken from Account 206 Advertising. P.U.D. Section H Mobile Home - N. W. Chatman Mr. Chatman requested permission to place a mobile home on Lots 1, 2 and 3, Block 146 and Lots 1, 2, and 3 Block 165, Section H. This request has been approved by the Advisory Planing Board with the following guidelines: 1. Minimum lot size 10,000 square feet or 100' x 100' . 2. 20 ' setback lines in the front, rear and side. 3 . Paved parking space inside of setback lines with access to right of way. MINUTES SEPTEMBER 9, 1974 PAGE TWO 4e Where city sewer is not available, a septic tank permit is a prerequisite for an installation permit. 5. 8" x 16" concrete footing with 21/2" reinforcing rods. 6 . Solid masonry foundation wall, minimum 18" high with proper ventilation and access. 7e Proper anchorage to the footing and foundation walls 8. When city water is not available another source of potable water shall be demonstrated to 4's_e satisfact: of the building inspector. 9. Any additions shall meet the Southern Standard Building Code. 10 , Wheels, undercarriage and trailer hitch shall be removed. 11 . Local conditions may add to or delete applicable items above, 12 . Each unit shall be considered individual and have no bearing on other installations . Mayor Howell then declared the meeting in session for a public hear- ing. As no one appeared either for or against this request for the installation of a mobile home, he then declared the public hearing closed. Commissioner Rosborough moved that Mr. Chatman be allowed to place a mobile home in Section H under the P .U.D. ordinance pro- vided he meets all the above mentioned guidelines, seconded by Commissioner Minton and carried. 385 Atlantic Boulevard - Addition to the Building Mr, Vogel stated that the lessee wanted to put a wing wall on the present building . Mayor Howell stated that this addition serves no purpose other than improving the looks of the building; getting away from the stereotype service station. Commissioner Minton moved for approval of the addition to the building located at 385 Atlantic Boulevard. Ordinance No. 58-74-2 Final Reading - Public Hearing Mayor Howell presented Ordinance No, 58-74-2 levying and imposing upon all insurers. now or hereafter engaging in or carrying on the business of property insurance, an excise or license tax in addition to any tax now levied, of 2% of the gross amount of receipts of all premiums collected on property insurance policies insuring property within the corporate limits of the City of Atlantic Beach in full, in writing and read on third and final reading. MINUTES SEPTEMBER 9, 1974 PAGE THREE Said ordinance was posted in line with charter requirements . Mayor Howell then declared the meeting in session for a public hearing. As no one appeared either for or against said ordinance, he declared the public hearing closed. Commissioner Fogg moved for passage of Ordinance Noo 58-74-2 on third and final reading, seconded by Commissioner Minton and carried. Ordinance No. 58-74-3 Ordinance Noe 58-74-3 levying and imposing upon all insurers now or hereafter engaging in or carrying on the business of insuring with respect to casualty risks an excise or license tax in addition to any tax now levied of 1% of the gross amount of receipts of all premiums from casualty insurance policies insuring property within the municipal limits of the City of Atlantic Beach was presented in full, in writing and read on third and final reading by Mayor Howell. Said ordinance was posted in line with charter requirements. He then declared the meeting in session for a public hearing. As no one appeared either for or against said ordinance, Mayor Howell declared the public hearing closed. Commissioner Cook moved for passage of Ordinance No. 58-74-3 on third and final reading, seconded by Commissioner Rosborough and carried. Ordinance No. 55-74-16 Second Reading - Title Only Ordinance No. 55-74-16 amending Chapter 18 of the Code of the City of Atlantic Beach and regulating the accumulation, removal and disposal of garbage and garden trash in residential and business zones and areas within the limits of the City of Atlantic Beach was presented by Mayor Howell on second reading, by title only. Commissioner Minton moved that Ordinance No. 55-74-16 be approved on second read- ing by title only, seconded by Commissioner Fogg and carried. Public Hearing to be held on September 23, 19740 Ordinance Noo 20-74-29 5,:ccnd Reading Ordinance Noe 20-74-29 adopting the budget for the City of Atlantic Beach, Florida, for the fiscal year 1974-75 was presented on second reading by title only. Said ordinance was present in full and in writing by Mayor Howell . Commissioner Rosborough moved that Ordinance No. 20-74-29 be approved on second reading by title only, seconded by Commissioner Minton and carried. MINUTES SEPTEMBER 9, 1974 PAGE FOUR The City Clerk asked for instructions from the City Commission on the collection of monies for occupational licenses for the year 1972 and 1973 . Mayor Howell stated that all the business people in Atlantic Beach have, over the past two years, been paying the City of Jacksonville for a municipal occupational license. The City felt at the time that this was illegal . The position of the City was later confirmed by the First District of Appeals and the Su- preme Court of the State of Florida. Those people who paid this fee will be refunded for their past two years. Therefore, the City should make every effort to collect for the years 1972 and 1973 . Mayor Howell stated that the City should wait until the citizens receive their refund from Jacksonville before the City of Atlantic Beach makes an attempt to collect for 1972 and 1973 . Mr. Ball stated that their refund will be greater than our occupational license fee. Mr. Hilliard requested permission to swap a garbage truck for a large dump truck. This exchange will be with the City of Neptune Beach. Mr. Ball, City Attorney, stated that Mr. Hilliard would need Commission approval and a resolution stating the terms of the trade. Mr. Ball suggested that this request be put on the agenda for consideration at the next meeting . Mayor Howell stated that Mr. Vogel had written to the owners of Place By The Sea Apartments informing them that their utility bill is in arrears . The letter pointed out that the utility bill has been delinquent since the cut-off date of August 15, 1974. The City Commission directed the City Manager to notify the tenants that the water service will be discontinued if payment is not received by September 10, 1974° Mr. Vogel reported that he had done research on cross corner visabil ty. In order to promote safety, he recommended placing "No Parking Here to Corner" signs. This will reduce the number of blind corners in Atlantic Beach, There were no objections from the City Com- mission. Mayor Howell reported that the Board of Adjustment members need to be re-appointed. The Board now consist of the following members: Mr. Gabriel Lazar, Mr. C , Te Tinsley, Mr, Jim Burton, Mr. George Bull, Jr. , and Mr. L. B . MacDonnel. Mr. Lazar requested that he not be re-appointed. Mayor Howell recommended Mr. John Onstott to replace Mr. Lazar. It was moved by Commissioner Fogg, seconded by Commissioner Minton and carried that the following members will serve on the Board of Adjustment: Mr. C. T. Tinsley, Mr. John Onstott, Mr. Jim Burton, Mr. L . W. MacDonnel and Mr. Geo':ge Bull, Jr, MINUTES SEPTEMBER 9, 1974 PAGE FIVE Mayor Howell presented to the City Commission a booklet entitled "Campaign 1974" published by the National Retired Teachers Associa- tion and the American Association of Retired Persons. This is for information only. At some future date the National Retired Teachers Association and the American Association of Retired Persons may re- quest some official backing from the City Commission. Resolution No. 74-9 Resolution No. 74-9 indicating intent to join with other general purpose units of local government in the Jacksonville-Duval County Metropolitan area to develop and implement a plan resulting in a coordinated waste treatment management system for the area was pre- sented by Mayor Howell. He stated that he had some misgivings about the resolution, but saw no alternative but to recommend passage. It was moved by Commissioner Minton, seconded by Com- missioner Rosborough that Resolution No. 74-9 be adopted. During the discussion, Commissioner Cook asked for clarification of the last paragraph that stated---"all proposals for grants for con- struction of publicly owned treatment works within the boundaries of the designated area will be consistent with the approved plan and will be made only by the designated management agency. " Mayor Howell explained that the Jacksonville Area Planning Board had to approve our existing sewer plant. The city must have a central agency to handle the entire area and the Jacksonville Area Planning Board is the designated management agency. There being no further questions, Commissioner Cook called for the question. The motion was carried adopting Resolution No. 74-9. (Copy is attached hereto and made a part hereof.)
