Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, AUGUST 26, 1974, AT 8:00 P. M. PRESENT: William S. Howell, Mayor-Commissioner L. W. Minton, Jr. F. W. Fogg Robert R. Rosborough, II Robert B. Cook, Sr. , Commissioners AND R. C . Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk ABSENT: None The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of August 12, 1974 were approved as written upon a motion by Commissioner Minton, seconded by Commission- er Rosborough and carried. Recognition of Visitors James Hallman, twelve years old, requested permission to speak be- fore the City Commission. He stated that two weeks ago he came to City Hall and requested permission to use Jack Russell Park for a carnival. The money received would go to the children that have Muscular Dystrophy. James Hallman presentedabrochure and litera- ture that he had received from the Muscular Dystrophy Association. He stated that he wanted to set up tables for refreshments and games generally found at a carnival . The young people in his neighbor- hood are helping him with this project . The date of the carnival will be September 7 , 1974, between the hours of 1:00 until 3: 00 P.M. Mayor Howell stated that he certainly did admire the enthusiasm and interest James has in helping children who have Muscular Dystrophy and recommended that the City Commission do whatever is necessary to help with this project. It was moved by Commissioner Rosborough, seconded by Commissioner Minton and carried that James Hallman be allowed to use the Jack Russell Park for a carnival for the Muscular Dystrophy Association. Mayor Howell instructed James Hallman to contact the City Manager to work out the details, such as adult supervision, location, etc. MINUTES AUGUST 26, 1974 PAGE TWO Correspondence Mr. Vogel stated that he had received a letter from Mr. David Thillen, 859 Ocean Boulevard, requesting permission to place a fence around his property and that he be allowed to invade city property by 5 ' 4" . He stated that Mr. Thillen would sign an agree- ment to move the fence off city property if it becomes necessary. Mayor Howell stated that he did not see how the City Commission could approve this request. It was the consensus of the City Com- mission that the request be denied. P .U.D. Sec. H Mobile Home - N. W. Chatman Mr. Chatman requested permission to place a mobile home in Section H under the P .U.D. ordinance. This request was approved by the Advisory Planning Board subject to certain contingencies. It was moved by Commissioner Rosborough, seconded by Commissioner Minton and carried that a Public Hearing will be held September 9, 1974 to consider this request . Reuben Bennett Re: Business Offices Seminole Road and Atlantic Blvd. Mr. Bennett was not present, therefore, Mayor Howell suggested that this item be passed over and removed from the agenda. There were no objections from the City Commission. Ordinance No. 58-74-2 Second Reading Mayor Howell presented Ordinance No. 58-74-2 levying and imposing upon all insurers, now or hereafter engaging in or carrying on the business of property insurance, an excise or license tax in addition to any tax now levied, of 2% of the gross amount of receipts of all premiums collected on property insurance policies insuring property within the corporate limits of the City of Atlantic Beach on second reading by title only. Said ordinance was presented in full and in writing. It was moved by Commissioner Minton, seconded by Commiss- ioner Cook and carried that Ordinance No. 58-74-2 be approved on second reading by title only, Public Hearing to be held September 9, 1974. Ordinance No. 58-74-3 Second Reading Mayor Howell presented Ordinance No. 58-74-3 levying and imposing upon all insurers, now or hereafter engaging in or carrying on the business of insuring with respect to casualty risks an excise or license tax in addition to any tax now levied, of 1% of the gross MINUTES AUGUST 26, 1974 PAGE THREE amount of receipts of all premiums from casualty insurance policies insuring property within the municipal limits of the City of Atlantic Beach on second reading by title only. Said ordinance was presented in full and in writing. It was moved by Commissioner Fogg, seconded by Commissioner Minton and carried that Ordinance No , 58-74-3 be approved on second reading by title only . Public Hearing to be held September 9, 1974. Ordinance No . 55-74-16 Garbage Fees - First Reading Mayor Howell presented Ordinance No . 55-74-16 amending Chapter 18 of the Code of the City of Atlantic Beach and regulating the accumu- lation, removal and disposal of garbage and garden trash in resi- dential and business zones and areas with the limits of the City of Atlantic Beach on first reading by title only . Said ordinance was presented in full and in writing . Commissioner Fogg moved that Ordinance No . 55-74-16 be approved on first reading by title only, seconded by Commissioner Minton and carried. Public Hearing to be held September 23, 1974. Ordinance No. 20-74-29 Budget 1974-75 First Reading Mayor Howell presented Ordinance Noo 20-74-29 adopting the budget for the City of Atlantic Beach, Florida on first reading by title only. Said ordinance was presented in full and in writing. Com- missioner Fogg moved that Ordinance Noo 20-74-29 be approved on first reading by title only, seconded by Commissioner Minton and carried. Public Hearing to be held September 23, 1974. Mayor Howell stated that he received word from Washington, D. C. notifying the city that our application for Federal Revenue Sharing has been approved. It is now in the division that determines how much money the City is due for the past two years, He stated he would advise the City Commission when news is forthcoming. In reference to State Revenue Sharing, Mayor Howell presented the City Commission a schedule reflecting the amount of the State of Florida Revenue Sharing Funds received, distributed to, and undis- tributed by the City of Jacksonville. The auditors, Tyson and Evans, figures that Jacksonville owes the City $427 , 881. 30 for the past two years . Mr. Shorstein, attorney for the City of Jacksonville, seems to feel that since the opinion of the Supreme Court and the First District Court of Appeals did not state specifically that the City of Atlantic Beach is entitled to Revenue Sharing retroactively, he is taking the position that perhaps the City is not entitled to the money retroactively. MINUTES AUGUST 26, 1974 PAGE FOUR Mayor Howell stated that he would be meeting with the City of Jack- sonville, hopefully, sometime this week. He will keep the City Commission advised. Mayor Howell stated that he wanted to set up two meetings on the budget to meet as a committee, as a whole . One meeting to discuss that portion of the budget concerning payroll and another meeting to discuss the balance of the budget. The meetings were scheduled for Tuesday, August 27 , 1974, to discuss the balance of the budget. The meeting to discuss payroll will be hold Wednesday, August 28, 1974 at 8:00 P . M.
