Adjounn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, AUGUST 12, 1974, AT 8:00 P . M. PRESENT: William S . Howell, Mayor-Commissioner L. W. Minton, Jr. F. W. Fogg Robert R. Rosborough, II Robert B. Cook, Sr. , Commissioners AND R. C. Vogel, City Manager Oliver C. Ball, City Attorney Gloria June Knight, City Clerk The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag. The minutes of the meeting of July 22, 1974 were approved as written upon a motion by Commissioner Minton, seconded by Commissioner Fogg and carried. Mayor Howell recognized visitors and called for any business from the floor not on the agenda. Mr. C . H. Godfrey, Park Terrace West, stated that he had inquired about the possibility of placing street lights on Park Terrace West. Mayor Howell stated that the request had been sent to the Jackson- ville Electric Authority for street lights on Sea Oats, Park Terrace West and Park Terrace East . Mr. Jack Bennett stated that at the time he built his home on Belve- dere Street he had agreed to maintain the street. Since that time, everyone at the north end of Belvedere have been using the street making it impossible for him to get to and from his home. He re- quested that the Public Works Department place rocks or build it up in someway. Mr. Hilliard stated that if the city builds up the street, this will only increase the traffic. He suggested that it would be better to barricade one end of the street. Mayor Howell instructed Mr. Hilliard to look into the problem and report back at the next City Commission meeting. Mr. Bennett also suggested that a traffic light be placed at the intersection of Atlantic Boulevard and Seminole Road. Mayor Howell reported that Atlantic Boulevard is a state road and therefore the City of Atlantic Beach can do nothing . Each year the City of Atlan- tic Beach have requested a traffic light at Plaza and Mayport Road, which is also a state road, and every year the city has been turned down. Mayor Howell stated that the city would be very happy to put in another request for a traffic light at Seminole Road and Atlantic Boulevard, Mayport Road and Plaza. MINUTES AUGUST 12, 1974 PAGE TWO Reuben Bennett Re: Business Offices Seminole Road Mr. Bennett was not present and Mayor Howell suggested that this item be passed over until the next meeting. There were no object- ions from. the City Commission. Julie Wilson Re: Bicycle Routes Miss Wilson stated that due to the increase in the number of people riding bicycles there have been many accidents. She had several suggestion that she wanted to present to the City Commission to help alleviate this problem. 1e Bike Way - a part of the road that is shown by signs stating "Bicycle Route" . 2 . Bike Lane - a separate lane on the street which is separated from the motor vehicle lane by a curb. 3 . Bike Trail - a separate lane completely off the street that other vehicles use . Miss Wilson stated that if Atlantic Beach could take the lead in putting up some routes for bicycles in order to decrease the number of bicycle accidents that the other beaches will follow and maybe the citizens will be able to travel a lot safer at the beaches, Mayor Howell appointed Commissioner Minton and Richard Hilliard to contact Miss Wilson for ideas and suggestions and report back to the City Commission. Ordinance No. 80-74-12 Final Reading - Public Hearing Ordinance No. 80-74-12 amending Ordinance No. 00-71-10 and Chapter 19 of the Code of the City of Atlantic Beach, Florida for the imposition and collection of a connection charge for the capitali- zation of the sewer plant fund was presented in full, in writing and read on third and final reading by Mayor Howell . Said ordinance was posted in line with charter requirements . He then declared the meeting in session for a public hearing. As no one appeared either for or against said ordinance, Mayor Howell declared the public hearing closed. Commissioner Minton moved for passage of Ordinance Nc. 00-74-12, seconded by Commissioner Fogg. During discussion, Mayor Howell stated that the increase in connection charge is based on national averages . The city has never had a downstream pollution charge but because of the requirements of the Environmental Pro- tection Agency and the Department of Pollution Control, the city is left with no alternative than to go with a connection charge to build up a fund to enlarge the sewer plant. MINUTES AUGUST 12, 1974 PAGE THREE Mayor Howell stated that the connection charge is well below the City of Jacksonville and Jacksonville Beach. There being no further discussion the vote was unanimous for passage of Ordinance No. 80-74- 12. Mr. Vogel presented plans to the City Commission for consideration on a proposed new building for Jax Liquors to be located next to the Royal Palms Theatre, Atlantic Boulevard. Jax Liquors will have to have Commission approval in order for them to move their permit. Mayor Howell asked Mr. Vogel if Jax Liquors had requested this? Mr. Vogel stated that he had received nothing in writing. Mayor Howell wanted to know if the plans showed that the open ditch behind the property will be covered and a culvert put in at their expense. Mr. Vogel stated that the plans specify that the ditch will be covered and a culvert put in at the expense of Jax Liquors. It was moved by Commissioner Rosborough, seconded by Commissioner Cook and carried that the plans for Jax Liquors be approved. Mr. Vogel requested that the rules be waived on Ordinance No. 58-74-2 and Ordinance No. 58-74-3 because of the time element. There are only four meetings before the new fiscal year beginning October 1, 1974. Mayor Howell presented Ordinance No. 58-74-2 levying and imposing upon all insurers, now or hereafter engaging in or carrying on the business of property insurance, an excise or license tax in addition to any tax now levied, of 2% of the gross amount of receipts of all premiums collected on property insurance policies insuring property within the corporate limits of the City of Atlantic Beach; and providing when said tax shall be due and payable by title only. Said ordinance was presented in full and in writing on first reading. Commissioner Rosborough moved that the rules be waived and that Ordinance No. 58-74-2 be approved on first reading by title only, seconded by Commissioner Cook and carried. Public Hearing to be held September 9, 1974. Mayor Howell presented Ordinance No. 58-74-3 levying and imposing upon all insurers, now or hereafter engaging in or carrying on the business of insuring with respect to casualty risks an excise or license tax in addition to any tax now levied, of 1% of the gross •amount of receipts of all premiums from casualty insurance policies insuring property within the municipal limits of the City of Atlantic Beach; and providing when said tax shall be due and payable by title only. Said ordinance was presented in full and in writing on first reading. MINUTES AUGUST 12, 1974 PAGE FOUR Commissioner Rosborough moved that the rules be waived and that Ordinance Noe 58-74-3 be approved on first reading by title only, seconded by Commissioner Minton and carried. Public Hearing to be held September 9, 1974. Mayor Howell reported that the City was attempting to enlarge the sewer plant and discharge into the intracoastal waterway still pro- viding 90% DOD removal . The Environmental Protection Agency does not seem to want to go along with this proposal and are requiring ammonia conversion. This will increase the cost of enlarging the sewer plant somewhere between one to three million dollars. Origin- ally the City had no intention of going in for a Federal Grant. Mayor Howell stated that he had received a letter from Mr. Walter Parks, City Engineer, recommending that the City file an applicatior. for a grant-in-aid from the EPA to pay for a substantial portion of the construction cost of enlarging the sewer plant .
