MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, JULY 22, 1974, AT 8:00 P . M.
PRESENT: William S. Howell, Mayor-Commissioner

The meeting was called to order by Mayor-Commissioner, Mr. Howell.
The invocation was given by Commissioner Minton, followed by the
pledge to the flag.
The minutes of the meeting of July 8, 1974 were approved as written
upon a motion by Commissioner Fogg, seconded by Commissioner
Rosborough.
Mayor Howell recognized visitors and called for any business from
the floor not on the agenda. There was none.
Correspondence
The City received a request to place an ad in the Fletcher High
School Yearbook. It was moved by Commissioner Minton, seconded by
Commissioner Fogg and carried that the City of Atlantic Beach place
an ad in the Fletcher High School Yearbook in the amount of $50.00
to be taken from Account 206 Advertising.
Joel Kauffman Re: PUD Seminole Road - Public Hearing
Mr. Joel Kauffman requested PUD on lots 274 and 275, 268 and 269
Saltair Subdivision. During the presentation Mr. Kauffman pre-
sented plans for two townhouses. The property is presently zoned
Residence A - Single Family. He stated that the lots are 50 foot
lots and that it is difficult to utilize the land properly on such
a small lot . Mr. Kauffman proposes to build two townhouses with
zero lot lines. The townhouses will have a common wall with 25
feet side lines .
Mayor Howell declared the meeting open for a Public Hearing

Several members of the audience were opposed to this type housing.
Mr. Glennon Smith, 360 Seminole Road and Mr. Pete Dowing, 366
Seminole Road objected stating that there is not a single two story
house or duplex on Seminole Road. Mr. Smith and Mra Dowling agreed-
ed that townhouses are too much of a departure from the existing
construction in the neighborhood.
Mayor Howell declared the Public Hearing closed.
During the discussion, Mayor Howell asked Mr. Kauffman how long
he had owned the property and if he was aware of the zoning prior
to purchase . Mr. Kauffman stated that he had a contract to pur-
chase that is not completed and that he had full knowledge that
lots 274 and 275, 268 and 269 Saltair Subdivision is zoned Resi-
dence A Single Family. Commissioner Minton vehemently expressed
his opposition to this proposal. It was moved by Commissioner
Minton, seconded by Commissioner Fogg and carried that the request
for PUD on lots 274 and 275, 268 and 269 be denied.
Rueben Bennett - Business Offices Seminole Rd. and Atlantic Blvd.
Mr. Vogel presented plans to the City Commission for office build-
ings to be constructed from the existing structures on Seminole
Road and Atlantic Boulevard. The City Commission had several
questions concerning the plans and specifications. Mr. Bennett was
not present, therefore, it was moved by Commissioner Minton,
seconded by Commissioner Rosborough and carried that the plans be
tentatively denied.
A. L. Outlaw Re: Water and Sewer Connections
Mr. A. J. Outlaw requested a letter from the City Commission stat-
ing that sewer and water is not available to a part of Government
Lot 1, Township 2, South Range 29 East Duval County (commonly re-
ferred to as the Lowe Property) . He plans to put into operation
his own package treatment plant. Mr. Outlaw asked if the City
Commission had any objections? Mayor Howell stated that if the
City is unable to furnish Mr. Outlaw with service he would be able
to do whatever the Department of Pollution Control and the Environ-
mental Protection Agency will allow him to do. Mr. Walter Parks,
City Engineer, stated that when the capacity of the city sewer
system could accept the affuent from the apartment complex, the pre-
vailing rate and connection charge in effect at that time will
prevail.

Planning Board Approval for Mobile Homes in Sec. H Under PUD
Mr. Vogel reported that the Advisory Planning Board has approved
the concept of installation of mobile homes in Section H under
the PUD ordinance. Mayor Howell stated that the City Commission
does not need to take any action on this recommendation, but in
the future all mobile home installation in Section H will be
brought to the City Commission under the PUD ordinance.
Ordinance No. 80-74-12 Sewer Connection Charge Second Reading
Ordinance No. 80-74-12 amending Ordinance No. 80-71-10 and Chapter
19 of the Code of the City of Atlantic Beach, Florida for the im-
position and collection of a connection charge for the capitali-
zation of the sewer plant fund was presented by Mayor Howell on
second reading by title only. Said ordinance was presented in full
and in writing. Commissioner Minton moved that Ordinance No. 80-
74-12 be approved on second reading by title only, seconded by
Commissioner Rosborough and carried. Public Hearing to be held on
August 12, 1974.
Mr. Vogel requested permission to call for bids to update the
hospitalization plan for the city employees and a call for bids on
the workman' s compensation. Mayor Howell suggested that Mr. Vogel
delay this action until later in the year. He also suggested that
the bids be called for a nine month period.
The City Manager would like to instigate a pension plan for the
police and firemen. Mayor Howell instructed the City Manager to
bring the necessary information to the City Commission for consi-
deration.
There being no further business Mayor Howell declare• he meeting
adjourned.
