Commissioners 12 . Mayor 13 , Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, JULY 8, 1974, AT 8:00 P . M. PRESENT: William S. Howell, Mayor-Commissioner L. W. Minton, Jr. F. W. Fogg Robert B. Cook, Sr. , Commissioners AND R. C. Vogel, City Manager Oliver C . Ball, City Attorney Gloria June Knight, City Clerk ABSENT: Robert R, Rosborough, II, Commissioner The meeting was called to order by Mayor-Commissioner, Mr. Howell. The invocation was given by Commissioner Minton, followed by the pledge to the flag . The minutes of the meeting of July 24, 1974 were approved upon a motion by Commissioner Minton, seconded by Commissioner Cook and carried. Mayor Howell recognized visitors and called for any business from the floor not on the agenda. Mrs . Ruth Gregg, 905 Sailfish, stated that at the City Commission meeting of May 13, 1974, Mayor Howell instructed the City Manager to cut down all shrubbery on city property that is blocking the view at intersections. Mrs . Gregg reported that this has not been accomplish- ed Mayor Howell stated that the city has an ordinance pertaining to shrubbery, bushes, etc. in relationship to blind corners. He then instructed the City Manager to enforce the ordinance. Correspondence The city received a request to place an ad in the Fletcher Senior High School Football Program. It was moved by Commissioner Minton, seconded by Commissioner Cook and carried that the City of Atlantic Beach place an ad in the Fletcher Football Program in the amount of $60.00 to be taken from Account 209 Advertising. Joel Kauffman Re: PUD It was moved by Commissioner Minton, seconded by Commissioner Cook and carried that Mr. Joel Kauffman' s request for P .U.D. be accepted. Boyd, Jr. has a credit with the City of Atlantic Beach in the amount of $8, 234.02 . Mr. George Bull re- quested that the sewer and water assessments for C. T. Boyd' s lots in Saltair be paid from this amount. The orginal resolution states that the credit balance be applied and assigned by C. T. Boyd, Jr. , individually and as Trustee, for the payment of real estate taxes. Mayor Howell suggested that Resolution No. 71-33-A be altered to in- clude payment of sewer and water assessments. It was moved by Com- missioner Minton, seconded by Commissioner Fogg and carried that Resolution No. 71-33-A be altered to include payment for sewer and water assessments on C. T. Boyd' s lots in Saltair. Copy of Resolution No. 71-33-A is attached hereto and made a part hereof. A. L. Outlaw Re: Water and Sewer Connections Mr. A. L. Outlaw was not present so Mayor Howell recommended that this item be passed over until the next meeting. There were no objections from the City Commission. Approval of Expense from Account 209 Advertising It was moved by Commissioner Cook, seconded by Commissioner Minton and carried that the City of Atlantic Beach place an ad in the Annual Policeman Ball Program in the amount of $50.00 to be taken from Account 209 Advertising. Opinion of Land Exchange - Public Works - Mr. Ball Mr. Ball stated that the minutes of June 24, 1974 reflect the City' s position on the land exchange. Mayor Howell read from the minutes of June 24, 1974. . . . "in order for the land exchange to take place the city would need receipts stating that the taxes are paid and that the title is insurable. " The city has not received paid tax receipts or an insurable title. Ordinance No. 80-74-12 First Reading - Sewer Connection Charge Ordinance No. 80-74-12 amending Ordinance No. 80-71-10 and Chapter 19 of the Code of the City of Atlantic Beach, Florida for the imposition and collection of a connection charge for the capitalization of the sewer plant fund was presented by title only. Said ordinance was presented in full and in writing. MINUTES JULY 8, 1974 PAGE THREE Commissioner Minton moved that Ordinance No. 80-74-12 be approved on first reading by title only, seconded by Commissioner Fogg and carried. Public Hearing to be held August 12, 1974. Mr. Vogel stated that he received an application to build a service garage in an area zoned Business AA, The building will be used to service Southern Bell telephone trucks. No mechanical work will be done at this garage. Mayor Howell stated that this type project would require re-zoning or P.U.D. Commissioner Fogg moved that this request for re-zoning or P .U.D. be denied. The motion was seconded by Commissioner Minton. During discussion, Commissioner Cook stated that the City Commission should have more information concerning this request. A substitute motion was introduced by Commissioner Fogg, seconded by Commissioner Minton and carried to refer this request to the Advisory Planning Board for consideration and recommendation. Mr. Vogel stated that in lieu of passing an ordinance that would re- gulate the installation of mobile homes in Section H subdivision, that the City Commission could maintain perpetual control if each installation were required to be under P .U.D. This is suggested due to the fact that there are very few streets within the area that are developed or passable and the development of property in an under- developed area creates a pressure on the City to open and pave streets, etc. After discussion, it was moved by 'Commissioner Minton, seconded by Commissioner Cook and carried that the Advisory Planning Board study the recommendation of placing the installation of mobile homes in Section H under the P .U.D. ordinance. There being no further business, Mayor Howell la - e /eeting adjourned. Al '0-1 H.well May. -Commissioner (Seal) ATTEST: 4416460- 1-- cp/140, Gloria June night City Clerk RESOLUTION NO. 71-33-A WHEREAS, it has been decided by the City Commission of the City of Atlantic Beach, Florida, that certain lands should be purchased to provide the citizens a Public Park to be used as a park and for recreational purposes, and WHEREAS, the land to be purchased is legally described as follows: Lots 77, 79, 158, 159, 160, 161, 295, 296, 297, 298, 299, 300, 301, 302, 303, 304, 307, 308, 309, 310, 313, 314, 315, 319, 320, 321, 322, 327 , 330, 331, 332 (except part recored in Deed Book 805, page 351) , 334, 335, 346, 347, 348, 349, 350 and 359, SALTAIR, Section 3, according to plat thereof recorded in Plat Book 10, page 16, of the current public records of Duval County, Florida, and WHEREAS, said lands are owned by C. T. Boyd, Jr. , individually and as Trustee, joined by his wife, Ruth P . Boyd, and WHEREAS, a purchase price for said above described lands has been agreed upon at the appraised figure of $10,175.00, and WHEREAS, real estate taxes upon certain lots in the above described property have been delinquent, due and owing for the year 1971 and prior years, and WHEREAS, C. T. Boyd, Jr. , individually and as Trustee, joined by his wife, Ruth P . Boyd, and the Commissioners of the City of Atlantic Beach, Florida, have reached an agreement regarding the sale of the above described property and the payment of real estate taxes and to become due, NOW, THEREFORE, BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA, AS FOLLOWS: 1. That the City of Atlantic Beach, Florida, purchase the aboe described property for the purpose of a Public Park and for recreational purposes. 2. That the total price to be paid by the City of Atlantic Beach for the above described property shall be $10, 175.00. 3. By Agreement with C. T . Boyd, Jr. , individually and as Trustee, joined by his wife, Ruth P . Boyd, that the sum of $10, 175.00, sale price shall be used in the manner following: The sum of $1,187.00 shall be applied to delinquent, due and owing taxes on said lands for years prior to 1971 and for the year 1971. Part of the remaining balance of $8,987 .89 shall be used by C. T. Boyd, Jr. , Trustee, to pay all taxes due on property exclusively owned by him for the 1972 tax year. That any balance remaining after payment of taxes due for the 1972 tax year may be applied and assigned by C. T. Boyd, Jr. , individually and as Trustee, joined by his wife Ruth P. Boyd, for the payment of real estate taxes, sewer and water assessments and subsequent tax year.
