MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, JUNE 24, 1974, AT 8:00 P . M.

The meeting was called to order by Mayor-Commissioner, Mr. Howell.
The invocation was given by Commissioner Minton, followed by the
pledge to the flag.
The minutes of the meeting of June 10, 1974 were approved as written
upon a motion by Commissioner Cook, seconded by Commissioner Minton
and carried.
Mayor Howell recognized visitors and called for any business from the
floor not on the agenda.
Mrs . C . R. Braddock, 1475 Main Street, requested permission to place
a trailer temporarily on a vacant lot in Section H. The trailer
will not be occupied. Mayor Howell instructed the City Attorney to
review the Code of the City of Atlantic Beach and advise Mrs. Brad-
dock of the legality of placing a trailer on property in Section H.
Joel Kauffman Re: PUD:
Mr. Vogel stated that Mr. Kauffman requested that this item be
passed over until the next regular City Commission meeting. There
were no objections from the City Commission.
Tom Jordan Re: Ziebart Rust--Proofing;
Mr. Vogel requested that the City Commission give permission for a
service station located at 385 Atlantic Boulevard to re-open as a
rust-proofing business. He stated that this type of business was
not in violation of the zoning ordinance . There were no objections
from the City Commission.

Resolution No. 74-8 J. Turner Butler Boulevard
Resolution No. 74-8 approving construction of State Road 202 (J.
Turner Butler Boulevard) from the University of North Florida site
at St. Johns Bluff Road to State Road AlA at the beaches, a distance
of 7 . 3 miles of limited access expressway with a high level bridge
over the intracostal waterway was presented by Mr. Vogel. It was
moved by Commissioner Cook, seconded by Commissioner Minton and
carried that Resolution No, 74-8 be adopted. Copy of said resolution
is attached hereto and made a part hereof.
Ordinance No. 90-74-64 Definitions of a Family - Public Hearing
Ordinance No. 90-74-64 amending Chapter 28 Section 28-1 Definitions
of the Code of the City of Atlantic Beach, Florida, entitled "Zon-
ing" by adding the definition of family therein was presented in
full, in writing and read on final reading by Mayor Howell. Said
ordinance was posted in line with charter requirements. He then
declared the meeting in session for a public hearing. As no one
appeared either for or against said ordinance, Mayor Howell declared
the public hearing closed. Commissioner Minton moved for passage
of Ordinance No. 90-74-64 on third and final reading, seconded by
Commissioner Cook and carried.
Proposal on Selva Marina Park
Mayor Howell read the following proposal from A. B. Parsons fcr
clearing and grading of the park in Selva Marina:
"This proposal is made to the City of Atlantic Beach for re-
moval of underbrush, vines, and debris from a nine acre park
located between Park Terrace East, Park Terrace West and be-
tween Club Drive and Saturiba Drive.
Take down diseased and dangerous trees. Remove all logs,
trees and stumps. Disposal of underbrush, stumps, tree logs,
etc. will be accomplished by burning or burying on the site.
The burying operation shall be done with sufficient compaction,
depth and fill dirt so that the surface can be adequately main-
tained as a park. Any burning shall be done only with approval
of proper authorities .
The topography of the area indicates that drainage can be
accomplished to a ditch that will flow north to a culvert at
Saturiba Drive. The drainage ditch is to be cleaned and
graded by hand if necessary, the land is to be leveled, all
depressions brought up to grade so that drainage will be
accomplished to the ditch.

The contract price for the above work is $9, 500.00. Progress
payments will be made each 30 days from the date of commence-
ment based on the amount of work accomplished as related to the
contract price with a retainage of ten percent. "
Mayor Howell stated that this project is to be funded by Five B' s,
Inc. , developers of Selva Marina. Mr. George Bull, Jr. deposited
with the city a check in the amount of $9, 500.00. It was moved
by Commissioner Minton, seconded by Commissioner Cook and carried
the the contract be awarded to Mr. A. B. Parsons.
Opinion of Land Exchange - Public Works, Mr. Ball
Mr. Ball stated that in order for the land exchange to take place
the city would need receipts stating that the taxes are paid and
that the title is insurable. Mayor Howell suggested that Mr. George
Bull contact Mr. Ball between now and the next meeting to work out
exactly how to handle this matter. It was moved by Commissioner
Cook, seconded by Commissioner Minton and carried that upon proper
clearance of the taxes due on the Bull property, the opinion from
the City Attorney and an insurable title the City Commission will
take action to make the necessary swap.
Commissioner Cook stated that for the record under the new financial
disclosure act he would resign from the City Commission if and when
he is required to comply with the law. Mr. Ball, City Attorney,
gave a brief explanation of the new law and stated that there are
any number of loopholes in the law. His interpretation of the law
requires that a percentage figure be filed.
There being no further business, Mayor Howell declared the meeting
adjourned.
