MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION
HELD AT THE CITY HALL ON MONDAY, JUNE 10, 1974, AT 8:00 P . M.

The meeting was called to order by Mayor-Commissioner, Mr. Howell.
The invocation was given by Commissioner Minton, followed by the
pledge to the flag.
The minutes of the meeting of May 27, 1974, were approved as written
upon a motion by Commissioner Cook, seconded by Commissioner Ros-
borough and carried.
Mayor Howell recognized visitors and called for any business from the
floor not on the agenda.
Mr. George Bull, Jr. requested that the city do something about the
parking problem on Eleventh Street at Oceanfront. He stated that
more and more people are using 11th Street as an access to the beach.
The people are not obeying the "No Parking" signs. Mr. Bull request-
ed that the City Commission close 11th Street from Beach Avenue to
Oceanfront. Mayor Howell instructed the City Manager and the Direc-
tor of Public Works to look into the parking situation to see if the
city can do anything about alleviating this problem without closing
the street.
Bid Opening of Garbage Containers:
Service Systems, Inc. Atlanta, Ga. 10 Units $3, 150.00
National Compactor & Tech. Systems, Jacksonville, Fla. No Bid
No other bids were received.
It was moved by Commissioner Cook, seconded by Commissioner Rosborough
and carried that the bid be awarded to Service Systems, Inc.
Mr. Vogel stated that emergency repairs had to be made on the fire
engine because water was getting from the fire pump into the gear box.
It was necessary to take the fire engine to Atlanta for a complete
overhaul. It was moved by Commissioner Cook, seconded by Commissioner
Rosborough and carried that the cost of emergency repairs on the fire
engine be approved.

Tore King, Inc. Water Service Change:
The City Commission received correspondence from Tore King, Inc. re-
questing to have four water meter hook-up previously approved by the
City Commission changed from Lot 50 and 51 Ocean Grove Unit 2, to
Lots 19 and 20 Ocean Grove Unit 2 . The change would require a 6"
water line which would be paid for by Tore King, Inc. For the re-
cord, Mayor Howell pointed out that the City of Atlantic Beach has
no intentions of compensating Tore King, Inc. for any of the cost of
the line. Tore King, Inc. will build the line and turn it over to
the city free and clear of all encumbrances. Tore King, Inc. will
pay the out of city water rate charge prevailing from time to time.
Mr. Charles Collier, General Contractor for Tore King, Inc. agreed to
the above mentioned proposal. After discussion, it was moved by
Commissioner Rosborough, seconded by Commissioner Cook and carried
that the City of Atlantic Beach approve the water meter change from
Lots 50 and 51 Ocean Grove Unit 2, to Lots 19 and 20 Ocean Grove
Unit 2, provided the 6" water line be paid for by Tore King, Inc. and
turned over to the city free and clear of all encumbrances . Tore
King, Inc. will pay the out of city water rate charge prevailing from
time to time .
Report Uncompleted Park Selva Marina:
Mr. Vogel reported that he had received a firm commitment from one
contractor to complete the work in the Selva Marina Park. Mayor
Howell stated that a meeting with Mr. Bull will be planned later in
the week. He instructed the City Clerk to notify all interested
parties .
Ordinance No. 90-74-63 - Final Reading Public Hearing:
Ordinance No. 90-74-63 amending Chapter 28. 11,, 28. 11. 1, 28. 2 and
28. 12. 1 of the Code of the City of Atlantic Beach, Florida, entitled
"Zoning" was presented in full , in writing and read on final reading
by Mayor Howell. Said ordinance was posted in line with charter re-
quirements. He then declared the meeting in session for a Public
Hearing. As no one appeared either for or against said ordinance
Mayor Howell declared the Public Hearing closed. Commissioner Minton
moved for passage of Ordinance No. 90-74-63 on third and final read-
ing, seconded by Commissioner Rosborough and carried.

Ordinance No. 40-74-7 Franchise/JEA Final Reading Public Hearing:
Ordinance No. 40-74-7 granting to Jacksonville Electric Authority, its
successors and assigns, an electric franchise, and imposing provisions
and conditions relating thereto was presented in full, in writing and
on third and final reading by Mayor Howell. Said ordinance was post-
ed in line with charter requirements. He then declared the meeting
in session for a Public Hearing. As no one appeared either for or
against said ordinance, Mayor Howell declared the Public Hearing
closed. Commissioner Rosborough moved for passage of Ordinance No.
40-74-7 on third and final reading, seconded by Commissioner Minton
and carried.
Ordinance No. 90-74-64 Definition of a Family - Second Reading:
Ordinance No. 90-74-64 amending Chapter 28 Section 28-1 Definitions of
the Code of the City of Atlantic Beach, Florida, entitled "Zoning"
by adding the definition of family therein was presented by Mayor
Howell on second reading, by title only. Commissioner Cook moved
that Ordinance No. 90-74-64 be approved on second reading by title
only, seconded by Commissioner Rosborough and carried. Public Hear-
ing to be held on June 24, 1974.
Report on Sewer/Water Installation in Section "H" Survey:
Mr. Vogel stated he had been instructed by the City Commission to
notify the property owners on West 2nd, 3rd, 4th and 5th Streets,
Section "H" , to ascertain whether or not they wanted sewer and/or
water lines installed. The following is a breakdown of the response
received from the property owners: 12 pros; 4 no response and 1
opposing the installation. After discussion, it was moved by Com-
missioner Minton, seconded by Commissioner Rosborough and carried to
' nstruct the City Engineer to proceed with the plans for sewer and/or
water lines to West 2nd, 3-rd, 4th and 5th Streets, Section "H" .
Magnolia Apartments - Public Hearing - PUD:
Robert Allen Conner, architect, presented drawings of a proposed com-
plex located off Levy Road. He stated Phase I would have approxi-
mately 168 to 238 units and Phase II would have 242 units, for a
total of 480 units. The density will be 10 units to the acre. Mr.
Walter Parks, City Engineer, stated that after making a quick apprai-
sal there is a distinct possibility that the city ' s water and sewer
system will be overtaxed.

Mayor Howell stated that any approval of these plans would be subject
to the availability of water and sewer service. Commissioner Ros-
borough moved for approval of the tentative plans for Magnolia
Apartments, subject to sewer and water being available to the pro-
perty. The motion was seconded by Commissioner Minton and carried.
Chief Stucki reported that he was having difficulty policing the
fire hydrants outside the city limits. A discussion followed concer-
ning providing fire protection outside the city limits. Mayor Howell
stated that the city would have to responsed to calls outside the
city limits. He instructed the city engineer to look into the
proximity of the nearest fire hydrant on complexes outside the city
limits and make recommendations to the City Commission.
Commissioner Rosborough stated that on May 27, 1974, the city re-
ceived bids on an Additional Primary Water Pump. The committee
recommends that the bid be awarded to G. R. Hill & Company. It was
moved by Commissioner Rosborough, seconded by Commissioner Minton and
carried that the bid be awarded to G. R. Hill & Company for an Addi-
tional Primary Water Pump in the amount of $9, 962. 50.
Mayor Howell announced that there would be an Independence Ball at the
Jacksonville Beach Coliseum, Friday, June 14, 1974 and that the public
is invited.
There being no further business, Mayor Howell declared the meeting
adjourned.
