Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, APRIL 8, 1974, AT 8:00 P . M. PRESENT: L. W. Minton, Jr. , Mayor Pro Tempore F. W. Fogg Robert R. Rosborough, II Robert B. Cook, Sr. , Commissioners AND R. C. Vogel, City Manager Gloria June Knight, City Clerk ABSENT: William S. Howell. Mayor-Commissioner, Out of the City Oliver C. Ball, City Attorney, Out of the City The meeting was called to order by Mayor Pro Tem, Commissioner Minton- The invocation was given by Commissioner Fogg, followed by the pledge to the flag. The Mayor Pro Tem, Commissioner Minton stated that Mayor Howell and City Attorney Oliver Ball are in Tallahassee for the Supreme Court review of the consolidation case. The absence of Mayor Howell and Oliver Ball was excused because of City business. The minutes of the meeting of March 25, 1974, were approved as written upon a motion by Commissioner Cook, seconded by Commissioner Rosborough and carried. Recognition of Iisitors: Mr. Walter J. Parks, City Engineer, presented preliminary plans for the installation of another primary pumping station. He pointed out that the additional water pumping station will take care of the deficit in primary pumping during the summer peak season. Mr. Parks stated that within the next twelve months the City should have a more comprehensive evaluation of water needs for the City. This fourth primary water pumping station will have a permanent value to the City and will not become obsolete. It was moved by Commissioner Rcsborough, seconded by Commissioner Fogg and carried that the City Manager, along with the City Engineer, be instructed to prepare the specifications and call for bids to accomplish the installation of another primary pumping station. Ordinance No. 90-74-62 - Public Hearing: Ordinance No. 90-74-62 amending chapter 28-11 (G) (3) cf the Code cf the City of Atlantic Beach, Florida, entitled "Zoning" amending maximum ratio of living units; from 20 per acre; to 10 per acre was presented in full, in writing and read on final reading by Mayor Pro Tem, Commissioner Minton. Said ordinance was posted in line with charter requirements. MINUTES APRIL 8, 1974 PAGE TWO He then declared the meeting in session for a Public Hearing. Mr. L. B. MacDonell, 1535 Selva Marina Drive, stated that he wanted tc formally protest the passage of Ordinance No. 90-74-62. As an investor he would be unjustly penalized because the value of the land would definitely diminish. Mr. George Bull, Sr. , 47 Eleventh Street, suggested that the City Commission not pass what he termed a "defensive ordinance. " He suggested that all multi-family dwellings be placed under the P .U.D. ordinance. Mr. Johnny Tucker, 42 Eleventh Street, stated that when he purchased hi$ property on the oceanfront several years ago he was aware that it was zoned multi-family and that he hoped that someday he would be able tc construct a condominium in that area. Mr. Tucker stated that under Ordinance Nc. 90-74-62 it would be econcmicaW unfeasible to construct a condominium with 10 units tc the acre and that the City Commission would be making a mistake without more consideration. He formally opposed passage cf Ordinance Nc. 90-74-62. Mr. Fred Mills, 355 Plaza, stated that he did not think 10 units to the acre is too small, that it depended upon the situation and the best usage of the land. Mr. Mills formally opposed passage of said ordinance. There was a question and answer period concerning the P.U.D. Ordi- nance, wherein Mr. Vogel explained that the ordinance simply means the builder must have a "plan, a unit and development" that are all to be tied together and the P .U.D. Ordinance supercedes any existing ordinance. The purpose of reducing the 20 units per acre to 10 units per acre is to prevent small lets from being built from property line tc property line. Mr. Bob Wardrep, Chairman of the Advisory Planning Board, stated that it was the intent of the Plahning Board to keep Atlantic Beach e residential community and that the Board could only make recommendations to the City Commiss- icr . They have no voting power. Commissioner Fogg moved that Ordinance No. 90-74-62 be approved. For lack of a second, the motion failed. Commissioner Fogg withdrew his motion and moved that Ordinance Nc. 90-74-62 be tabled until the next regular meeting cf the City Commission. The motion was seconded by Mayor Prc Tem, Commissioner Minton and ca.rrj,sde MINUTES APRIL 8, 1974 PAGE THREE Fred Mills - Additional Building on Mayport Road: Mr. Mills presented plans for construction cf three buildings; offices, stores and a motel complex. The first floor will be offices and stere rentals; the second floor will be a 41 unit motel. The third story will be a sun deck 60 feet wide and 320 feet long. The property is zoned Business "B" and the plans and specifications meet the Southern Standard Building Code. Commissioner Rosborough moved that the plans be referred to the Advisory Planning Board for further study, seconded by Commissioner Fcgg. The vote was: Aye - Commissioners Fcgg and Rosborough Nay - Commissioner Cook and Mayor Pro Tem, Commissioner Mintcn There being a tie vote, nc action was taken cn the motion. It was moved by Commissioner Cock, seconded by Commissioner Fogg and carried that the plans as submitted by Fred Mills be tabled until the next regular meeting of the City Commission. Beaches Leader - Advertisement: It was moved by Commissioner Fogg, seconded by Commissioner Cock and carried that the City of Atlantic Beach place an ad in the Leader for the Beaches Festival Weekend in the amount of $120.00 to be taken from Account 209-Advertising. Miss Senior High Pageant - Request fcr Advertisement from Fletcher Federation of Dad' s Club: It was moved by Commissioner Cook, seconded by Commissioner Fcgg and carried that an ad be placed in the Miss Senior High Pageant Pro- gram in the amount of $15.00 to be taken from Account 209-Advertising. Resolution Nco 74-4: Resolution No. 74-4 requesting that Amtrak initiate rail passenger service along the Florida East Coast was presented. It was moved by Commissioner Rosborough, seconded by Commissioner Cock and carried that Resolution No. 74-4 be adopted. Copy cf said resolution is attached hereto and made a part hereof. Chief Stucki stated that with the approaching summer season it will be necessary to acquire some type of facility to be used as a life guard station. He has checked cut various city locationsand stated that there is no feasible place tc build a permanent type station. Chief Stucki requested permission from the City Commission to MINUTES APRIL 8, 1974 PAGE FOUR purchase a small overnight type trailer that could be used on the beach and moved to various locations. He requested permission tc purchase this trailer frcm his capital account; not to exceed $900. It was moved by Commissioner Cock, seconded by Commissioner Fogg and carried that the Chief of Police be given permission to pur- chase a trailer, to be used as a life guard station, not to exceed $900.00. Commissioner Cook was appointed to serve on the committee along with the Chief of Police. Mr. Hilliard reported that two 130 H.P . motors had burned up during the past two weeks at the sewer plant. He requested permission tc pay the invoice in the amount of $646 .97 for emergency repairs. It was moved by Commissioner Rosborcugh, seconded by Commissioner Fcgg and carried that Mr. Hilliard be given permission to pay the in- voice in the amount of $646. 97 fcr emergency repairs at the sewer plant. Mr. Hilliard stated that the Public Works Department have removed the telephone pole barricades at the north end of Atlantic Beach, but Jacksonville has done nothing to fix the barricade at Seminole Beach. The City Commission instructed the City Manager to write the City of Jacksonville requesting that a fence be erected on Seminole Beach and report back at the next meeting their response. Mr. Vogel requested permission to refund the Government Council of Criminal Justice $674. 34. This represents un-spent money of the original $5000.00 that was paid to the City for jail renovation. It was moved by Commissioner Rosbcrcugh, seconded by Commissioner Fogg and carried that Mr. Vogel refund $674.34 to the Government Council of Criminal Justice. There being no further business, Mayor Pro Tem, Commissioner Minton declared the meeting adjourned. 0124/k4 L . Minton, Jr. (SEAL) Mayor Pro Tempore ATTEST: Gloria June night City Clerk RESOLUTION NO . 74-4 RESOLUTION REQUESTING THAT AMTRAK INITIATE RAIL PASSENGER SERVICE ALONG THE FLORIDA EAST COAST WHEREAS , the United States is presently going through a time when traditional sources of energy are greatly limited for transportation that relies on the oil industries ; and WHEREAS , the economy and continued growth of the State of Florida rely upon visitors from our sister states and their travels about the State of Florida; and WHEREAS , the State of Florida is faced with the possibility of a slow-down in economic prosperity due to limited modes of travel ; a result of the energy crisis along the east coast which borders the Atlantic Ocean ; and WHEREAS , Amtrak was created by a U . S . Congressional mandate to operate rail services throughout the United States for a profit; and WHEREAS , Amtrak is operated by quasi-governmental and quasi-private interests in conjunction with twenty-one par- ticipating railroads throughout the United States ; and WHEREAS , both the residents of the Florida east coast and Amtrak , could benefit by establishing routes along Florida ' s east coast with the Florida East Coast Railway Company , who presently has usable tracks and stations , so that passenger service could be furnished to those who wish to visit Florida , and so that East Coast residents would have an energy saving and economical means of transportation . NOW, THEREFORE , BE IT RESOLVED, THAT THE CITY COMMISSION OF ATLANTIC BEACH, FLORIDA , DOES HEREBY 1 . Support the creation of rail passenger services by Amtrak along the Florida East Coast . 2 . Request that Amtrak conduct a study to determine the desirability and identify the need for rail passenger services along the Florida East Coast . BE IT FURTHER RESOLVED , that this Resolution be forwarded to Amtrak , Washington , D.C . , the Governor of the State of Florida, the United States Senators and Representatives from the Congressional Districts within Duval County , and Florida East Coast Railway Company .
