CITY COMMISSION MELD AT THE CITY HALL ON MONDAY, MARCH
25 , 1974 AT 8 : 00 P .M.

The meeting was called to order by Mayor Pro Tem, Commissioner
Minton, The invocation was given by Commissioner Rosborough ,
followed by the pledge to the flag.
The Mayor Pro Tem, Commissioner Minton stated that the
City Clerk, Gloria June Knight was in Tallahassee on City
business and Mayor Howell was meeting with the Duval Delegation
in Jacksonville. He also stated that their absence was
excused because of City business .
The minutes of the meeting of March 11 , 1974 , were approved
as written upon a motion by Commissioner Rosborough,
seconded by Commissioner Cook and carried.
The Mayor Pro Tem, Commissioner Minton recognized visitors
and called for any business from the floor not on the
agenda . There was none .
Temporary Day Nursery - 745 Plaza Road
Mrs . George Terwillager having submitted a petition , asked
Commission approval to operate a day nursery until such time
as she could acquire property in Jacksonville Beach to
construct a day nursery. The Commission after discussion
approved the request for a temporary day nursery to be
operated until July 1 , 1974 , limited to five children .
Little League Baseball
Mr. Bill Grovenstein expressed the appreciation of members
of the Little League to the City of Atlantic Beach for the
facilities at Russell Park . He pointed out that the Little
League personnel had spent a lot of time and money assisting
Public Works in the care and maintenance of the primary
baseball diamond and he asked that it be reserved during
the season exclusively for the Little League . It was
pointed out by Mr . Ball that the City could grant the
Little League permission to use the facilities , but not
on an exclusive basis . After much discussion the Commission
approved a plan wherein use of the primary diamond be
primarily for organized adult supervised recreation and
sand lot type of baseball be delegated to the other practice
diamonds .

Zoning Change - Lowe Property
The Commission received a request by Beach Boulevard
Home Sales , Inc . that the zoning be changed from "C-1" -
Mobile Home Park to Residence "C" - Multi-family. The
Commission referred this to the Planning Board .
Water and Sewer Service North of the City - OMAA Investments
A request was received for water and sewer service to the
property north of Ocean Village One . The Commission tabled
the request until a final determination is received from
EPA.
Ordinance No. 90-74-62 - Second Reading
Mayor Pro Tem, Commissioner Minton presented Ordinance
No . 90-74-62 amending Chapter 28-11 (G) (3) of the Code
of the City of Atlantic Beach , Florida, entitled "Zoning"
for second reading .
Mr . Hilliard advised the Commission that Mosquito Control
had commenced cleaning the north end of the lagoon of
overgrowth, algae , etc .
Mr . Vogel presented a request of the City Commission to
change the water service to Ocean Village One from a master
meter to individual meters for each living unit. This
request was a result of the owners not following the approved
plans as submitted by Mr. Parks . It was pointed out that
if the owner would comply with four items presented by the
City Manager , it would be to the City ' s advantage to approve
the installation of individual meters . After discussion
the Commission approved the individual meter installation.
An application was presented by Mr. Orie Ellis to construct
ten (10) living units on two lots , Nos . 7 and 8 Block 4
Donners Subdivision. The purpose of the presentation was
to comply with instructions by the Commission at the last regular
meeting in which they instructed the City Manager not to
issue permits in conflict with Ordinance No . 90-74-62 .
The City Attorney advised the Commission that the Ordinance
under consideration was not indeed an Ordinance until its
final passage and therefore in his opinion it would not
be prudent to withhold approval based on an anticipated law.
Mr . Lee Ross presented a petition signed by adjacent property
owners to Lots 31 and 33 Block 11 Atlantic Beach. He asked
that a variance be granted on the sideline and setback
requirements . The Residence "AA" requirement is ten (10)
feet and he requested that the setback be waived to 7 1/2
feet which is a requirement in Residence "A" that prevails
in the balance of the block. After discussion the Commission
approved the variance .
