HELD AT THE CITY HALL ON TUESDAY, FEBRUARY 5, 1974, AT 8 :00 P . M.

The meeting was called to order by Mayor-Commissioner, Mr. Howell.
Resolution No. 74-2 Utility Tax, Jacksonville Electric Authority°
Mayor Howell presented and read in full Resolution No. 74-2 stating
that the resolution would clarify Ordinance No. 70-58-1, as amend-
ed, and instruct the Jacksonville Electric Authority to eliminate
the E'% utility tax on the fuel oil adjustment charge. It was
moved by Commissioner Fogg, seconded by Commissioner Cook and
carried that Resolution No. 74-2 be adopted. Copy of said resolu-
tion is attached hereto and made a part hereof.
Committee Report: Four Door Six Cylinder Sedan Vehicle:
Commissioner Cook reported that the committee, after reviewing the
bids submitted for a Four Door, Six Cylinder Sedan Type passenger
vehicle, recommends that the low bid from Lynch-Davidson Motors, Inc.
of $3 , 223 .05 be accepted. It was moved by Commissioner Rosborough,
seconded by Commissioner Fogg and carried that the low bid of
$3, 223.05 be awarded to Lynch-Davidson Motors, Inc.
There being no further business Mayor Howell declared the meeting
adjourned.

RESOLUTION NO. 74-2
WHEREAS, the City of Atlantic Beach, Florida, pursuant to its
duly adopted Ordinance No. 70-58-1, as amended (code of the City of Atlantic
Beach, Florida, Article IV) imposes a utility tax of eight percent (8%) upon
the sale of the various utility services within the corporate limits of the
City of Atlantic Beach including electrical utility services, and
WHEREAS, the suppliers of electrical utility services to the
citizens of the City of Atlantic Beach, i.e. the Jacksonville Electric
Authority, has imposed upon the purchasers of said service, a surcharge
commonly referred to as a fuel oil adjustment charge, and
WHEREAS, the above referred to Ordinance is silent and vague
as to the application of the utility tax upon the additional fuel oil
adjustment charges imposed upon the electrical utility service, therefore
necessitating this legislative expression of the Atlantic Beach City
Commission's intent of the application of said utility tax upon the
additional utility charges of the fuel oil adjustment.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY COI1ISSION OF THE CITY OF
ATLANTIC BEACH, FLORIDA, AS FOLLO S:
1. That Ordinance No. 70-58-1, as amended, being labelled
"Utility Tax" (Code of the City of Atlantic Beach,
Florida, Article IV) has no application as to the fuel
oil adjustment charge upon the electrical utility
services imposed upon the purchasers of the electric
utility within the corporate limits of the City of
Atlantic Beach, Florida.
2. The effective date of this Resolution and its
interpretation of the Utility Tax Ordinance shall
be the first day of February, 1974.
3. That a copy of this Resolution be respectfully
submitted to the proper authorities of the Jacksonville
Electric Authority.
Passed by the City Commission on the 5th day of February, 1974.
