11-30-92 v MINUTES OF THE WORKSHOP MEETING OF THE CITY COMMISSION AND THEE i PRESERVATION BOARD IN CITY HALL, 800 S MINOLE ROAD, AT 7:30 PM ON MONDAY, NOVEMBER 30, 1992 PRESENT: City Commission: William I. Gulliford, Jr., Mayor Glenn A. Edwards Lyman T. Fletcher Adelaide R. Tucker J. Dezmond Waters, III Tree Conservation Board: Carolyn Woods, Chairman Jim Pelkey Thomas Frohne John Weldon, Jr. And: Kim D. Leinbach, City Manager Alan C. Jensen, City Attorney Maureen King, City Clerk The meeting was called to order by Mayor Gulliford. He explained the meeting had been scheduled to provide an opportunity for the City Commission and Tree Conservation Board to discuss the proposed revision of the city's tree protection ordinance. He indicated the purpose of the revised ordinance appeared to be different from the original ordinance and he felt the purpose of the ordinance needed to be clarified and a compromise reached that would be acceptable to all concerned. Commissioner Fletcher felt the major purpose of the new ordinance was to provide for tree protection on residential property as well as property being developed, and to protect and maintain the beauty and uniqueness of Atlantic Beach. Commissioner Waters felt some legal problems relative to the existing ordinance needed to be resolved. He also indicated he would like to see the revised ordinance written in such a way as to require no net loss of trees. Following further discussion, the proposed ordinance was reviewed, section by section, beginning with definitions. The following changes were recommended: Page 2, Definition of DBH (Diameter Breast High) . . . "Trees that fork shall be considered multi-trunk trees and their DBH shall be determined by adding together the DBH of the tae-{2} three (3) largest trunks". . . ; Definition of Drip Line, "A vertical line extending from the outermost branches of a tree to the ground, to be no less than a ten f18}-feet-erele five (5) foot radius from the center of a tree at its trunk base." • Page 'IWo Minutes of joint meeting of City Commission and Tree Board Monday, November 30, 1992 The Mayor felt the ordinance discriminated against developers since they were required to comply with the regulations but homeowners were exempted from those regulations. He suggested requiring both developers and homeowners to replace trees on some established ratio. Further discussion ensued and it was the general consensus that the city did have the right to regulate the removal and planting of trees in a similar manner to which other matters are regulated throughout the city. In further discussion the following were identified as desirable goals to be achieved thorough passage of a tree protection ordinance: protect the beauty and uniqueness of Atlantic Beach, provide wild life habitat, protect property values, and save the maximum number of trees. Following further discussion a second meeting to continue discussions of the proposed tree ordinance by the City Commission and Tree Board was scheduled for 7:00 PM on Thursday, December 10, 1992.
