The invocation, offered by Commissioner Fletcher, was followed by the pledge to the flag. 1. Gulliford x Edwards x x Motion: Approve minutes of the Special meeting of February Fletcher x 17, 1992 Tucker x x Waters x In discussion before the vote, Commissioner Waters requested a Gulliford x correction of the motion on page five to read as follows: "Commissioner Waters moved to adopt the city's proposal, but approve a 4% cost of living allowance instead of the proposed 3%, retro active to October 1, 1991." The minutes were unanimously approved as corrected. 2. Recognition of visitors: Bob Weiss, 253 Seminole Road, reported he had recently attended a meeting with the Department of Natural Resources regarding the proposed relocation of the Coastal Construction Control Line (CCCL) in Duval County. He said Eric Olson of Olson Associates, Inc. , of Jacksonville, presented reasons why the CCCL should not be relocated as presently proposed by the DNR. He said DNR had agreed to review the matter and he felt some concessions may be made. Ray Salman, 1633 Park Terrace East, commented on the recent hearings to resolve the impasse between the city and the fire fighters. He expressed some concern regarding the charges of distortion of the facts presented to the City Commission. He felt the City Commission needed to have accurate information in order to make the proper decisions. Now that the process was complete he felt the tapes of the meetings should be reviewed to see where the information given to the City Commission may have been inaccurate. MSYN He suggested the City Commission consider appointing a committee to review the material and report back before the next contract negotiations. Mayor Gulliford said he would take the matter under advisement and requested this matter be placed on the agenda for the next meeting for further discussion. 3. Appearances: A. Jerry Johnson, Jacksonville Chamber of Commerce, requesting permission to use the end of Atlantic Boulevard, east of East Coast Drive on Thursday, April 23, 1992 Mr. Johnson explained the Chamber of Commerce would hold its annual membership drive from April 7, 1992, to May 29, 1992. This year's theme would focus on the "Jewels of Jacksonville." In this connection he requested permission to use Atlantic Boulevard, east of East Coast Drive from 5:30 PM to 7 :30 PM on Thursday, April 23, 1992, to hold related activities and report on the success of the membership drive. He said the Sea Turtle Inn had offered to help with parking, traffic and security and personnel would be on hand to provide clean-up after the event. Motion: Authorize the Chamber of Commerce to use Atlantic Edwards x x Boulevard eastward of East Coast drive from 5:30 PM Fletcher x to 7:30 PM on Thursday, April 23, 1992, for Tucker x activities related to their annual membership drive Waters x x Gulliford x In discussion before the vote, Mr. Johnson said the neighboring businesses which he had contacted were supportive of the event. The question was called and the motion carried unanimously. - At this time Mayor Gulliford introduced Hope Van Nortwick who had recently been appointed to the Tree Conservation Board. - The Mayor also reported the recent monthly report from Waste Management indicated the city's recycling program continued to be very successful and participation in Atlantic Beach during the month of December was 114% above the county average. 4. Old Business: A. Discussion and related action relative to Use by Exception for pest control business George Worley reported a public hearing had been held on this request at the previous meeting. He introduced David Honrath, owner of the company. Mr. Honrath reported the pest control business was strictly regulated by the Department of HRS. He said his company was involved in household pest control and termite control only. • PAGE THREE V V MINUTES NAME OF FEBRUARY 24, 1992 COMMRS. MSYN Edwards x x Motion: Grant Use by Exception to David Honrath to operate a Fletcher x x pest control business at 1447 Mayport Road, in a CG Tucker x district Waters x Gulliford x Commissioner Waters inquired whether Mr. Honrath had the proper back flow preventers on the trucks and at the business to prevent accidentally contaminating the city's water supply. Mr. Honrath stated that all vehicles with 100-gallon tanks were fitted with back flow preventers as required by law. He said he would not be mixing any chemicals at the facility and would not require the back flow preventers there. In response to a question from Commissioner Tucker Mr. Honrath explained he was state certified for pest control, was licensed and had met HRS inspection standards. He further explained that his employees took the trucks home and were responsible for keeping them clean. Only the exterior of the vehicles was washed and it was not necessary to wash or flush out the interior of the tanks. The question was called and the motion carried unanimously. 5. Consent Agenda A. Referral to the Community Development Board of preliminary replat of ocean front property, south of Beachside, as requested by Robert B. Van Cleve Edwards x x Fletcher x Motion: Approve passage of Consent Agenda Tucker x x Waters x No discussion before the vote. The motion carried unanimously. Gulliford x 6. Committee Reports: A. Water and Sewer Committee report Commissioner Fletcher reported bids had been invited for improvements to the city's No. 1 and No. 2 water plants. He said the committee recognized the importance of keeping DER informed of the city's efforts to comply with the consent order and Public Works Director Kosoy will submit monthly reports to DER. He felt it may not be possible to complete the project by the deadline established by DER but they would keep the DER apprised of the progress being made. He said he had learned that low interest federal and state monies may be available for capital improvements and the committee planned to pursue this matter. Commissioner Fletcher reported plans were now complete for the Mayport Road bore and jack project and the project would be advertised in March. • PAGE FOUR V V MINUTES NAME OF FEBRUARY 24, 1992 COMMRS. MS Y N Commissioner Fletcher reported DER had imposed new testing requirements at greatly increased costs. Mr. Kosoy will discuss this matter with Jerry Owen of DER. A copy of the complete report is attached hereto and made a part hereof. Mayor Gulliford reported a letter had recently been received from Mike Burton of Burton and Associates, relative to additional charges for work performed. He requested the Water and Sewer Committee review the letter and report back with their recommendations. B. Report and recommendations by Commissioner Edwards of the Awards Committee regarding ditch cleaning bid award #9192-3 Commissioner Edwards reported four bids ranging from $2,985 to $11 ,556 had been received for chemical spraying of ditches and lagoons in Atlantic Beach. After review of the bids, and upon recommendation of the Public Works Director, the committee recommended awarding a contract to the low bidder, Surface Water Management. Motion: Award contract for chemical treatment of ditches and Edwards x x lagoons in accordance with the specifications in Bid Fletcher x No. 9192-3, to Surface Water Management at the bid Tucker x x price of $2,985.00 Waters x Gulliford x The Public Works Director said because of the disparity in the bids, he had contacted the low bidder to ascertain that they would be able to perform the work in accordance with the specifications for the bid price and that their work would be satisfactory. Mr. Kosoy said Surface Water Management had indicated their bid for the project was low because they wanted to establish a reputation in the Jacksonville area but they would be able to meet the bid specifications and their work would be satisfactory. Mr. Kosoy said the DNR had indicated that the chemicals proposed to be used by Surface Water Management would be effective. After further discussion, the question was called and the motion carried unanimously. 7. Ordinances: B. Ordinance No. 75-92-9 - Public Hearing AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ATLANTIC BEACH, AMENDING CHAPTER 21, TRAFFIC AND MOTOR VEHICLES, REPEALING SECTION 21-22, COMMERCIAL, RECREATIONAL, ETC. , VEHICLE; WEIGHT REQUIREMENTS AND ADDING A NEW SECTION 21-22, COMMERCIAL, RECREATIONAL, ETC. , VEHICLES; WEIGHT REQUIREMENTS, AND ADDING A NEW SECTION 21-27, RESIDENTIAL PARKING STICKER PROGRAM, AND PROVIDING AN EFFECTIVE DATE. • PAGE FIVE V V MINUTES NAME OF FEBRUARY 24, 1992 COMMRS. MSYN Mayor Gulliford presented in full, in writing, ordinance No. 75-92-9, said ordinance having been posted in accordance with Charter requirements. He opened the floor for a public hearing and invited comments from the audience. Barbara Bonner, 463 Selva Lakes Circle, asked where the parking spaces would be located and was advised the ordinance provided that zones would be established at the discretion of the City Commission, but would probably be located close to the ocean. Bob Weiss, 253 Seminole Road, expressed some concern regarding how the Corps of Engineers would view "resident parking" as it relates to beach renourishment but the Mayor pointed out the City Attorney was of the opinion resident parking would be considered public parking. Lois Weiss recommended looking into the feasibility of running a shuttle bus on weekends from other parking areas to the beach. Mayor Gulliford said this idea had been discussed, but he questioned whether the city or the county should be responsible for providing such a service. Pam White, 2069 Selva Marina Drive, proposed charging non-residents for parking rather than charging Atlantic Beach residents. John Meserve, 2087 Vela Norte Circle, expressed the opinion that parking was only a problem in a short period and opposed the ordinance because it could be perceived as anti-Jacksonville and said he doubted that the fees would be adequate to cover administration and signage for the program. Former Commissioner Bob Cook and Mike Kring, 302 Magnolia Street, concurred with Mr. Meserve's comments. Mr. Cook felt the designation could jeopardize future beach renourishment and strongly urged the City Commission not to pass the ordinance. Ray Salman, 1633 Park Terrace East, supported the ordinance and said similar programs had been implemented and were operating successfully in other beach communities. Motion: Approve passage of Ordinance No. 75-92-9 on final Tucker x reading Waters x Commissioner Edwards said he supported the portion of the ordinance relating to vehicle weight restrictions, but was opposed to the parking sticker program and the additional signs which would be involved. Commissioner Waters said he did not feel the ordinance was intended to be anti-Jacksonville and would not prevent non-Atlantic Beach residents from coming to the beach. MSYN Substitute Motion: Amend ordinance to read as follows: Edwards x Section 2(2) "A street or a portion thereof may be Fletcher x x designated as a residential parking street by the Tucker x City Commission acting on its own upon public notice Waters x x and hearing, or upon request by residents." Gulliford x Section 2(3) "The City Commission may, at any time, upon petition as aforesaid or on its own motion, upon public notice and hearing, withdraw the designation of an existing residential parking street," and approve passage of ordinance No. 75-92-9 as amended on final reading. Commissioner Tucker inquired whether the City Attorney had any assurance this action would not be detrimental to the beach renourishment project. The City Attorney said he had not spoken to the Corps of Engineers but it was his opinion nothing in the ordinance prohibited access to the beach. After further discussion the question was called and on roll call vote, the motion carried on a 4 - 1 vote with Commissioner Edwards voting nay. A. Ordinance No. 40-92-17 - Public Hearing AN ORDINANCE AMENDING THE CODE OF ORDINANCES OF THE CITY OF ATLANTIC BEACH, EXTENDING THE EXISTING FRANCHISE OF CONTINENTAL CABLEVISION THROUGH MAY, 2005, REDUCING THE BOND REQUIREMENTS, AND PROVIDING AN EFFECTIVE DATE Mayor Gulliford presented in full, in writing Ordinance No. 40-92-17, said ordinance having been posted in accordance with Charter requirements. Prior to opening the floor for a public hearing, he invited Dave Reid of Continental Cablevision to explain his company's request to extend the franchise. Mr. Reid explained that the current cable television franchise would expire in July 1995 and Continental was requesting an extension of the franchise to 2005. He said federal law required that they request an extension between thirty and thirty-six months prior to expiration of the franchise. Mr. Reid said he felt many improvements had been made to the system under their ownership. Commissioner Fletcher asked Mr. Reid to explain the frequent outages in service. Mr. Reid said many of the outages were due to lines being cut during the Section H project. The Mayor then opened the floor for a public hearing and invited comments from the audience. Ruth Gregg, 905 Sailfish Drive, inquired about new features which had been added and Mr. Reid said new technology would allow many more channels, increasing the program choices. Jimmy Hill, 659 Beach Avenue, inquired whether color or editing features would be available on the cable access channel and Mr. Reid said this would be possible. PAGE SEVEN MINUTES V V FEBRUARY 24, 1992 NAME OF COMMRS. MSYN Ray Salman, 1633 Park Terrace East, said he had reviewed the various ordinances relative to cable television franchise since 1976. He said he had several questions which needed to be addressed and asked that action on the ordinance be deferred until these questions could be reviewed. Alan Potter, 374 Second Street noted that power outages occurred on Sunday mornings and inquired what type of emergency power Continental used. Mr. Reid responded that they had generators capable of providing power for two hours but, on occasion, these generators have been struck by lightning. There being no further comments from the audience, the Mayor declared the public hearing closed. Edwards x x Motion: Defer action on Ordinance No. 40-92-17 and continue Fletcher x x public hearing at the City Commission meeting on Tucker x March 9, 1992 Waters x Gulliford x The Mayor appointed a committee comprising Commissioner Fletcher, the City Manager and Ray Salmon to review the questions raised by Mr. Salmon and report back at the next meeting. 8. New Business: A. Discussion and related action regarding benefits related to all employee groups Mayor Gulliford provided a breakout of the benefits granted to the various groups of employees during contract negotiations. He noted that there were inconsistencies between the benefits enjoyed by one group as opposed to another and he felt the city should be more consistent in its dealings with employees. He felt the hours accumulated in the leave bank should be budgeted and funds set aside and restricted to the payment of personal leave. He suggested the Commissioners review these items and requested the City Manager place this matter on the next City Commission agenda for further discussion. B. Discussion and related action concerning disposition of abandoned, found and stored bicycles Chief Thompson reported the city acquires a large number of bicycles which have been found or stolen each year. In the past these bicycles were stored by the city and disposed of at public auction, but proceeds from the auction were hardly enough to cover administrative costs. He said storage was a problem as space was limited. He recommended that the Police Department be authorized to dispose of confiscated/recovered bicycles by donating them to non-profit organizations. The motion carried unanimously. Mayor Gulliford introduced John Barnhart who had presented the city with an outline for a traffic and parking study. He said the city was seeking proposals for a traffic study and Mr. Barnhart's outline would be beneficial to that study. The City Manager was authorized to proceed to advertise for proposals for a traffic study. 9. City Manager reports and/or correspondence: The City Manager presented each Commissioner with a report on the recent goal setting session. He thanked the Commissioners for their time and efforts in this matter. Public Works Director Kosoy reported the Buccaneer wastewater treatment plant had experienced a broken shaft in a clarifier. He recommended replacing missing blades on the brushes while the plant was out of service. The proposed repairs were estimated at between $3,500 and $5,000 and he wanted to make the City Commission aware of the problems. Mr. Kosoy was instructed to request an emergency meeting for approval of expenditures if it appeared the cost of the repairs would exceed $5,000. Eugene Cruz, 777 Vecuna Road, complained of the declining appearance of the Royal Palms subdivision and in particular, a neighboring property which he felt was a nuisance. Code Enforcement Officer Ford requested that Mr. Cruz fill out a complaint form so he would understand the nature of the problem. The Mayor said the Royal Palms area had changed from primarily owner/residents to renters and the area had declined accordingly. He felt the city needed to intensify code enforcement efforts in this area before the neighborhood further deteriorates. After further discussion of the problems, the Mayor appointed Commissioner Waters and City Planner George Worley to study the property improvement options in the Royal Palms area and report back at the next meeting. Commissioner Waters felt property rental was a business which should be regulated by the city. Commissioner Edwards reported the Municipal Revenue Sharing bill was proceeding through the legislative process. He said if this law was not changed, Dade County would get all the revenue sharing funds in the next two decades. He also reported Senator Burt had introduced a bill which would repeal the municipal authority to collect occupational licenses from insurance companies unless they had a corporate office in the PAGE NINE MINUTES V V FEBRUARY 24, 1992 NAME OF COMMRS. MSYN city. This legislation would prohibit the Florida League of Cities from collecting these escaped or delinquent license taxes in the future. Commissioner Edwards also reported that Governor Chiles had proposed to extend the state 2 1/2 percent gross receipts tax to municipal water, sewer and garbage bills. The Mayor suggested drafting letters opposing these bills for signature by the Commissioners. Commissioner Fletcher noted that appliances which had been put out for collection had not been picked up. The City Manager said in some cases where the resident had not purchased a sticker, after a certain period of time, in order to improve the appearance of the neighborhood, the city had picked up the item without payment of the fee. Commissioner Fletcher commented on a letter from Edward Martin relative to drainage problems at Selva Marina caused by the removal of the weirs during the construction of Fleet Landing. After further discussion, Bob Kosoy reported a meeting had been scheduled for the following Thursday between city staff and Haskell representatives. Commissioner Waters requested that Mr. Martin be invited to attend this meeting. Mr. Kosoy agreed to provide each Commissioner with a report of this meeting. Commissioner Waters said the sticker program approved earlier in the evening did not address designation of loading/unloading parking spaces at beach accesses. It was agreed to include this in the parking study. Commissioner Waters commented on a newspaper article relative to Mayor Austin's Insight Committee. The Mayor pointed out Ray Salmon from Atlantic Beach, was a member of that committee. Commissioner Tucker inquired into the status of the search for a Prosecuting Attorney for the Code Enforcement Board. She was advised applications would be received until February 28, and a short list should be available for consideration by the City Commission at the next meeting. MSYN Mayor Gulliford inquired into the status of the search for a new Finance Director and the City Manager said he had received about sixty applications and he would be beginning the interview process this week. The Mayor also inquired into the status of the Sixteenth Street beach access. Mr. Jensen reported the easement on the east lot would be settled this week, following which he would present the various options regarding the west lot to the City Commission for their consideration. The Mayor reported he would be meeting with the other Duval County Mayors on Thursday of this week. At Mayor Austin's request he had submitted as topics for discussion the Interlocal Agreement, Wonderwood Road, and improvements to Church Road, and the possibility of expanding the Atlantic Beach boundary on Atlantic Boulevard westward to the Intracoastal Waterway. The Mayor reported he had received a letter complaining about the conduct of a city employee. He said city staff were employed to serve all residents and he asked the City Manager to look into the matter and report back. Kosoy/Director of Public Works RSI _ RE: WATER AND SEWER COMMITTEE MEETING #12 On February 13, 1992 Commissioner Fletcher, Alan Potter, Ernie Beadle, Dr. Ray Salman, Shelton Flowers, Harry McNally and Bob Kosoy met to discuss the following water and sewer items: 1. A. B. WTP'S 1 b 2 IMPROVEMENTS: This major project was advertised on February 12, 1992 and bids will be opened on March 11, 1992. The DER has approved a one-year permit extension to September 10, 1992 to complete some specific improvements. We discussed Andy May's letter of February 10, 1992. (See attachment ) Bob Kosoy will send a letter to DER informing them that the project is out to bid and transmit a copy of the plans and specifications to DER. In addition, a letter will be sent to DER informing them when the bids have been received and awarded. Lastly, progress reports will be sent monthly to DER to inform them of our progress. The Committee felt that DER should be apprised of the major milestones otherwise penalties could be incurred by the City if the stiff deadlines were not met and they were informed at the "eleventh hour". 2. FINANCING FOR WATER AND SEWER PROJECTS It was agreed that applications for Federal or State Funding should be submitted to include the City of Atlantic Beach's projects on their Priority List. Funding will not be available until FY 92-93, at the earliest, and at that time Federal Minimum Wage Standards will not be required on funded projects. 3. MAYPORT ROAD BORE AND JACK With the Atlantic Beach WTP plans now complete, Andy May will now submit this bid package and check on FDOT permit. It is recommended that this project be advertised in mid March. 4. BUCCANEER CHLORINE CONTACT CHAMBER AND TON HANDLING FACILITY Four technical proposals were received and evaluated by City staff. It was decided that cost proposals would be requested from three (3) firms : J. Lucas & Associates, Pitman, Hartenstein & Associates, and Flood Engineering & Associates. 5. WATER DISTRIBUTION SYSTEM The plans must be prepared and submitted for permitting. If favorable bids are received for the Water Plant Improvements and excess funds are available, additional funds should be committed to the Water Distribution System. 6. NEW PERMIT AT BUCCANEER Harry McNally expressed great concern over the new testing requirements imposed by DER, effective when the new operating permit goes into effect. We effectively will be testing for mortality rates for freshwater species, such as Brook Trout, while dumping into the St. John's River. The cost of testing will increase from $1200. 00 every six (6) months to $2500. 00 every two (2) months. Alan Potter suggested that Bob Kosoy discuss the matter with Jerry Owen from DER. 7. WASTEWATER CONFERENCE (2/7/92) @ TAMPA Bob Kosoy reviewed the key issues presented at this DER/FES sponsored seminar: 1. Capacity Analysis Reports - Required at each WWTP 2. Atlantic Beach is impacted because the Department took five months to approve a one-year permit extension. Approximately seven months remain to meet the September 10, 1992 deadline for completing some specific improvements. We do not believe the total project can be reasonably advertised, bid, awarded and constructed by this date. For instance, approximately twelve months will be required for construction, completion, start-up and certification. However, we do believe the City can complete consent order items 12 , 14 , 13 , 16 and 20 for WTP No. 2 before September 10, 1992 , given a reasonable advertising and award timeframe. As we discussed in our meeting of January 23 , 1992 , construction priority will be given to completing WTP No. 2 improvements first. Although some construction will be occurring at WTP No. 1 & 2 simultaneously, WTP No. 1 should not be taken off-line to complete the reservoir modifications (Item 12) until WTP No. 2 is able to carry the city wide demand. The inability to take both plants out of service will probably hamper completin:, chlorination improvements to WTP No. 1 by September 10, 1992 . We make the following recommendations: 1. Advertise, bid and award as efficiently as possible. Contract specifications will require the contractor to complete WTP No. 2 consent order items in 90 days. WTP No. 1 consent order items should be completed in another 60 days. Assuming contract award by April 1, 1992 , the Contractor should be able to complete the consent order items by September 1, before the deadline. 2 . Request a permit extension by August 10, 1992 to allow construction to be completed. DER will not grant the total construction time needed at this time due to unfulfilled requirements of the consent order. However, it is reasonable to expect that a construction permit extension will be given at the end of the summer when progress can be documented to the DER. Summarizing the above, a construction schedule can be specified that will allow Atlantic Beach to meet the requirements outlined in DER' s permit. Although consent order items should be finished by their prospective deadlines, project construction will not be complete and one of the two plants may not be operational.
