N D S 0 The meeting was called to order by Commissioner Edwards, substituting for Mayor Gulliford who was out of the country. The invocation, offered by Commissioner Tucker, was followed by the pledge to the flag. 1. Approval of the minutes of the regular meeting of August 26, 1991, and special meeting of September 3, 1991 Cook x Motion: Approve minutes of the regular meeting of August 26, Tucker x x 1991 Weldon x x Edwards x No discussion before the vote. The motion carried unanimously. Cook x x Motion: Approve minutes of the special meeting of September Tucker x x 3, 1991 Weldon x Edwards x No discussion before the vote. The motion carried unanimously. 2. Recognition of visitors: Carol Inman, 115 Orange Street, Neptune Beach, complained of noise from an outdoor band at the Sea Turtle Inn. She said she lived three blocks from the Sea Turtle and found the band to be a disturbance in the evening hours and asked that the city look into the matter and have the Sea Turtle comply with noise regulations. Chief Thompson reported the Police Department had received numerous complaints and would be meeting with the Sea Turtle personnel in that regard later that week. The matter was referred to the Police Chief and City Manager for further attention. Robert Weiss, 253 Seminole Road, reported he had attended the recent public hearing in Jacksonville Beach on the proposed movement of the Coastal Construction Control Line (CCCL) . He said Mayor Gulliford had made a most effective speech on behalf of all the beaches communities opposing the incursion of state government into the home rule powers of the beaches cities. He urged all interested persons to write to Governor Chiles and Representative Arnall opposing the proposed westward movement of the CCCL. PAGE TWO V V MINUTES NAME OF SEPTEMBER 9, 1991 COMMRS. MSYN Alan Potter, 374 Second Street, said the Department of Natural Resources had unsuccessfully attempted to enact similar regulations a few years ago and he felt they would continue to try to move the CCCL back in small stages. Commissioner Cook said he regretted he had been out of town and could not attend the public hearing but supported the Mayor in opposing the incursion of state government into the rights of municipalities. 3. Resolutions: Commissioner Edwards presented in full, in writing, Resolution No. 91-28, A RESOLUTION OF THE CITY OF ATLANTIC BEACH ADOPTING THE NON-AD VALOREM ASSESSMENT ROLL FOR SECTION H, PROVIDING AN EFFECTIVE DATE. Cook x x Tucker x Motion: Approve passage of Resolution No. 91-28 Weldon x x Edwards x No discussion before the vote. The motion carried unanimously. 4. New Business: A. Public hearing requesting approval for Use by Exception to permit CG permitted uses on property at 1221-1261 Mayport Road Commissioner Edwards asked Community Development Director George Worley for his comments in connection with this application for exception. Mr. Worley reported Mr. Akra felt he was at a disadvantage in conducting his business because of his CL zoning classification. He said Mr. Akra was surrounded by CG properties which attracted potential renters away from his vacant stores. Mr. Worley reported the Community Development Board had recommended granting the exception to permit CG uses, with the exception of 24-111(b) (6) "Retail sale of beer and wine." They further recommended the exception be granted to Mr. Akra personally, as owner of the property, and that the exception not be transferable to any other person or to any other property. Commissioner Edwards opened the floor for a public hearing and invited comments from the audience. Since no one spoke for or against the exception, Commissioner Edwards declared the public hearing closed. Commissioner Weldon inquired into the criteria for allowing the sale of beer and wine and Mr. Worley explained that the Community Development Board tried to limit the number of lounges and bars but Mr. Akra had indicated he did not intend to rent to beer and wine establishments. Amendment to Naval contracts regarding Commissary/Exchange Commissioner Weldon reported further negotiations with the Navy seemed to indicate that the Navy would be willing to pay the standard Buccaneer rates for service to their facilities and would accept future increases which were applied to all residents of that area. However, the number of seats in the restaurant and the number of other stores in the complex had still to be determined. Commissioner Weldon hoped to complete contract negotiations this week. 5. City Manager reports and/or correspondence: The City Manager reported: - He had been identifying certain parking areas for resident parking for the parking decal program. The speed strips had been installed between 18th and 19th Streets and he was drafting requests for proposals for engineering services for traffic and anticipated he would present the proposals to the City Commission for review in 2 - 4 weeks. - The Army Corps of Engineers had agreed to extend the beach renourishment 3,000 feet northwards and Mr. Leinbach was still trying to get them to continue northwards to Hanna Park. The Public Works Director reported: - The contractor had encountered a number of utility conflicts in connection with the Main Street paving project. It had also been discovered that no sewer service existed from Stewart to Levy Road. He had asked the contractor to submit an estimate for this work, and in the meantime, he would apply for a permit for this work from Bio-Environmental Services. When these items were in hand it would be brought to the City Commission for consideration. - Mr. Kosoy reported he had received two boxes of briquettes from Mosquito Control. These briquettes would be put in the catch basins to control mosquito breeding. Mr. Kosoy said the briquettes were expensive and a minimum order of $1,500 was required so he appreciated the two boxes they had been given. Commissioner Weldon inquired into the status of the drainage improvement plans for Levy Road. Mr. Kosoy said Connelly and Wicker should have plans ready shortly. Commissioner Edwards inquired into the status of the new surge tank for Buccaneer. Mr. Kosoy said the "Notice of Intent to Issue the Permit" had been advertised in the Florida Times Union. After fourteen days, if no complaints were received, the permit should be issued. PAGE FOUR V V MINUTES NAME OF SEPTEMBER 9, 1991 COMMRS. MSYN Commissioner Tucker inquired into the status of the outfall line repair project. Mr. Kosoy reported a permit would be needed only for the construction of the maintenance deck. He said the various agencies involved had required additional information. The testing had indicated that most of the pilings would have to be replaced and he was awaiting price quotes from the contractor for this replacement. Commissioner Cook inquired into the status of the drainage problems related to the wier which was removed from the Fleet Landing area. The City Manager reported on a recent meeting with Haskell Company representatives and it was the general consensus Haskell would remedy the situation immediately. The proposal was to cut the center culvert to accommodate a similar volume of water as the old system, along with the installation of a wier system for control. Commissioner Cook also inquired into the status of the project to install sidewalks between 10th and 12th Streets on East Coast Drive and Mr. Kosoy said this would be under way as soon as possible. Commissioner Cook also inquired into the status of the 16th Street beach access. City Attorney Jensen said he had scheduled a meeting with the property owner for the following week. Commissioner Weldon reported the new sign had been installed at the Adele Grage Community Center. Roofing and electrical work were under way. The dais had been removed but the platform was left in place. Commissioner Edwards reported the Board of Directors of the Florida League of Cities was checking into the feasibility of a Constitutional Amendment to increase the home rule powers of municipalities.
