04-24-81 v MINUTES OF THE SPECIAL CALLED MEETING OF THE ATLANTIC V V BEACH CITY COMMISSION HELD AT THE CITY HALL ON APRIL 24, O O 1981 AT 6:30 P.M. T T PRESENT: William S. Tucker, City Clerk I O Y NAME OF ONEN COMMRS. N D S 0 The meeting was called to order by Mayor Howell for the purpose of discussing the resignation of the City Manager. The Mayor read Mr. Davis's letter of resignation. The letter is attached hereto and made a part hereof. Jensen x Motion: Accept the resignation of Mr. Bill M. Davis. Mhoon x Minton x x Van Ness x x * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Howell x After the vote was taken, the Chair recognized Mr. Bernard C. Gray, 1895 Live Oak Lane, who wished to speak on behalf of Mr. Davis. Mr. Gray stated that he was a relatively new citizen to Atlantic Beac`i, but he was impressed enough with the City to purchase a burial plot at the cemetery located within the city limits of Atlantic Beach. Mr. Gray said he had met with Mr. Davis on three different occasions and had found the city manager to be a very accommodating, very personable, and efficient person. He made a prayer to the City Commission that the City Manager's resignation be held in abeyance until Mr. Davis has his day in court. He further stated that the Grand Jurys do an excellent job, but are journeymen, and subject to mistakes. Mr. Gray expressed the opinion that the court is the final decision to determine whether the City Manager is guilty or not guilty. He further added that he would like to see the Commission take the resignations of the apparently faithful employees that at this time are placed under question but have not been proven guilty of anything wrong be placed in abeyance and give them a vote of confidence to return to their occupations until such time they are proven guilty or not guilty. The Mayor thanked Mr. Gray for his comments and stated that his reason for voting yes was that he had discussed the matter with Mr. Davis and that Mr. Davis feels that inasmuch as the final conclusion will be some months away, Mr. Davis feels that it is not fair to the city to have to remain in a state of limbo for that lengtz of time. The Mayor assured Mr. Gray that the resignations that have been presented have been done so in the best interests, as far as the individuals are concerned, on the part of the City of Atlantic Beach, and in due respect to their wishes, he had voted to accept their resignations. A re-vote was taken and it was unanimous to accept Mr. Davis's resignation. Corrected page • V V PAGE TWO Names of MINUTES Commrs. Minton x x Van Ness x * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Howell x The Mayor then instructed Chief Stucki to take his seat as Acting City Manager. The Mayor suggested to the Commission that they instruct the Acting City Manager to get with the City Attorney and the City Auditor to meet with the State Attorney's office to discuss with him those matters in their presentation that had just been receives, and to take all necessary immediate steps to correct anything in those allegations that the Grand Jury feels that are necessary to correct any deficiencies in this city government. Commissioner Van Ness asked if any of the Commissioners should also go. The Mayor answered if any Commissioner wished to go, they certainly should feel free to do so. Commissioners Minton and Van Ness expressed a desire to attend the meetings. Commissioner Van Ness requested that a committee be appointed to start a search for a new City Manager. The Mayor agreed and instructed the Commission to start immediately to advertise in the necessary journals and the Florida League of Cities Municipal Record. The City Commission agreed unanimously. Mr. George Bull asked if the Commission could discuss his plat that had been in abeyance for months. The Mayor answered yes, if all the engineering problems had been worked out. Mr. Bull stated that he had sent a letter to the Commissioners relative to his plans in settling the problems. Mr. Parks stated that he had just received a letter from Mr. Potter that met with his satisfaction, and the plat, as presently prepared, in his opinion, meets the city's requirements. Commissioner Jensen stated that he had not seen the letter or the plans and moved that the matter be passed over until they had a chance to review the letter.
