The meeting was called to order by Mayor Howell. He announced that
the Commission was meeting in Special Session for the purpose of
holding a public hearing on the third and final reading of the water
Ordinance, and also to hear the City Manager's report on Public Safety
equipment and animal control.
ORDINANCE NO. 80-81-19 (EMERGENCY) PUBLIC HEARING
AN ORDINANCE TO PROHIBIT OR CURTAIL CERTAIN NONESSENTIAL USES OF WATER
AND TO CONSERVE AVAILABLE WATER RESOURCES DURING A DECLARED WATER
SHORTAGE EMERGENCY.
Said Ordinance was presented in full, in writing, and read on third
and final reading by Mayor Howell. Said Ordinance was posted in line
with charter requirements. After the reading, Mayor Howell opened
the meeting for a public hearing. Mr. John McGuigan, 1915 Oak Circle
asked what the fee will be for decals showing proof of heat pumps.
and added that he did not think it fair to charge citizens a fee just
to prove they are not breaking the law. The City Manager advised that
he planned little or no fee and definitely not more than $2.00, and
explained to the audience and Commission that the City plans to have
application forms available immediately which will provide permanent
records for the city for any future use. Beth Geotto commented that
she works for the pollution control dept. in the city of Jacksonville
and has offered her services to the water conservation department in
the enforcement of the water shortage law. She highly recommended
using some type of decal as this would be a tremendous time saver for
the enforcement agencies. Candy Nordan expressed the opinion that
citizens needed to wash their cars daily to prevent rust and asked
the Commission to consider the same action Jacksonville Beach took and
allow the washing of autos with a bucket up to a three gallon capacity.
Mr. Ball advised this item was intended to be outlined in the ordinance
and suggested an amendment be made on final passage. Mr. Moss provided
an explanation of the Ordinance and the proposed procedures for enforce-
ment. As no one else spoke for or against, the Mayor declared the
Public Hearing closed. During discussion, Commissioner Jensen asked that
another amendment be added to the ordinance: Under Section I after the
words "water shortage" should read"as declared to exist by the St. Johr.s
River Water Management District". Commission agreed.

1. allow the washing of automobiles, trucks, mobile homes,
boats or any other type of mobile equipment from
water contained in a bucket or container not exceeding

City Manager's Report on Animal Control on the Beach
Mr. Moss verbally presented his repot to the Commission. He ex-
pressed the opinion that the current leash law can and should be
enforced so long as the law remains a part of the City Code. Also,
at least initially, the enforcement can be provided with existing
personnel and services with little or no additional cost. The
City Manager recommended a program of strict enforcement of
the existing leash law and listed the following ways to enforce
the existing ordinance in a fair and effective manner:
1. Direct the Public Safety Officers to issue citations to
dog owners who are violating the leash law.
2. Train and direct City lifeguards to issue citations to violatcrs.
Procedures and communication systems would be available to
call for backup support from Public Safety Officers.
3. Assure signs requiring the leashing of dogs are in place at
each beach access road and on lifeguard stands on the northerr
and southern borders of the beach.
4. Contract with the City of Jacksonville for animal control
wardens and two trucks for weekends if existing personnel are
unable to relieve the situation.
Mr. Moss added that after a period of strict enforcement of the
leash law, the City determines dogs (and their owners) continue to
pose health and safety problems for beach users a partial or
total ban of dogs on the beach may be the most effective way of
eliminating the problem. The following citizens participated in
a discussion following the city manager's report: Mr. Jack Feather,
494 Beach; Phil Jotto, 331 Seminole; Ralph Brown, Ocean Blvd. ;
Dick Valerien, 1798 Sea Oats; Karen Fay, 373 7th St. ; Bob Cook,
1475 E. Coast Drive; Phil Robinson; Julie Hite, 122 6th St. ;
and Tom Smith, a dentist from Mayport. Total banning of dogs on
the beach was approximately 50%. Mr. Bob Cook, former Commissionez ,
expressed the opinion the present law is a good one if it can be
enforced, and added that the government does not necessarily need
to be economical, it needs to be responsive to our needs. After a
lengthy discussion, Mayor Howell commented that a resident at the
last meeting had pointed out this really isn't a dog problem-it is
a people problem. He asked for a show of hands desiring a total ban

About half the audience responded. The Mayor then asked for a show
of hands that do not want to ban the dogs. Approximately half of
the audience raised their hands. The Mayor then reminded the
audience that the City Manager has just been appointed and he should
be given a chance to do his job. He instructed the City Attorney
to prepare an ordinance for a total ban and then in the interim
the city will see if the City Manager can enforce the leash law.
The Ordinance will be presented for first reading at the next
meeting.

Emergency Authorization to Purchase Public Safety Equipment
The City Manager recommended that immediate action be taken to
purchase new turn-out gear for the Public Safety Officers. He
presented informal quotations, as opposed to sealed bids, were
presented to the Commission.He recommended that contracts for the
emergency purchase of public safety equipment be awarded as
follows:

Mr. Moss stated that he and Chief Stucki are presently requesting
and reviewing proposals for equipment required to repair and
modify the existing communication system including the installation
of a repeater system. Until the city receives the required FCC
license for the system, the City Manager will continue to review
and solicit proposals and make recommendation for award at a later
date.
The City Manager added that specifications are being prepared and
bids will be invited for the purchase of four sets of breathing
apparatus (air packs). He intends to request this equipment in the
FY 1981-82 operating budget and award the contract at the beginning
of the fiscal year.

Mayor Howell advised the Commission that Mr. George Bull, Sr. was
not present at the last meeting when the matter of placing a sales _
trailer on his property at 19th and Seminole Rd was brought up.

matter and the Chair asked for a motion to allow him to speak at
a Special Called Meeting.

Mr. Bull stated that Mr, Eberling has proposed to the City that
he be allowed to put a sales trailer in the Selva Marina vicinity
that would both service his activities in the patio home section
and also would service his activities in his home building enterprise
in other parts of Selva Marina. Because the patio homes and other
homes will be built upon shortly, the location of the trailer on
a lot would shortly defeat itself, because it would have to be
re-located. Mr. Bull had suggested to Mr. Eberling that the trailer
be placed on his land that is referred to as the "commercial tract",
This property is still unzoned. Discussion followed and Mr. Bull
offered to furnish a sworn affidavit that he and Mr. Eberling will
not use the matter in any action before the City Commission or the
courts to try to impose upon the City against its will. Commissioner
Jensen objected to allowing the trailer to be placed on that location
giving his opinion that the City is setting a bad precedent. He
felt that the adjoining residents would object to the sales trailer
and he did not personally feel that location was the proper place
for the trailer.

stating that in no way this will indicate any commercial use.
