The invocation, offered by Commissioner Jensen, was followed by the pledge to the flag. Approval of the Minutes of December 14, 1981 Mayor Persons asked the City Clerk if the corrections were made that he had requested. The City Clerk answered in the affirmative. Mrs. McCreary requested permission to use the lights at Jack Russell Park and also Donner Park twice weekly on Tuesday and Thursday. She announced that a Jr. League was being formed for the 13 and 14 year old boys this year and hopefully they would also use the Mayport Navy base. Meeting of December 22, 1981 - PUD Application of TRECO.Inc, to develop Diocese of St. Augustine property located on Saturiba Drive between Sea Oats Drive and Live Oak Lane Mayor Persons advised that Mr. Moss reported that the Advisory Planning Board recommended approval of the PUD with certain stipulations (copy of December 28th memorandum from Mr. Moss covering the stipulations is attached hereto and made a part hereof. ) PAGE TWO V V MINUTES Names of DECEMBER 28, 1981 Commrs. Ordinance No. 45-81-5 AN ORDINANCE, AMENDING CHAPTER 10 ENTITLED "LICENSES" OF THE CODE OF 41110?HE CITY OF ATLANTIC BEACH, FLORIDA, BY ADDING THERETO A CLARIFYING SUB-PARAGRAPH: PROVIDING AN EFFECTIVE DATE. Said Ordinance was presented in full, in writing, and read on third and final reading by Mayor Persons. Said Ordinance was posted in line with charter requirements. After the reading, Mayor Persons opened the meeting for a Public Hearing. As no one spoke for or against, the Mayor declared the Public Hearing closed. William Moss, City Manager SUBJECT: PUD Application of TRECO, Inc. , as Agent for the Diocese of St. Augustine - - Property located on Saturiba Drive between Sea Oats Drive and Live Oak Lane On December 22, 1981, the Advisory Planning Board reviewed the proposed PUD request of TRECO, Inc. , for the above referenced property. A copy of the minutes of the meeting are attached for review by the City Commission. The Advisory Planning Board considered the proposed PUD to be an excellent development. The Board recommends approval of the PUD with the following stipulations: 1) That the drainage ditch with a 50-foot easement be granted to the City, and that the covenants and restrictions clearly indicate that property owners are not allowed to construct any structure, or in any way obstruct the City's efforts to maintain the drainage ditch. 2) That the setbacks be as follows: a) Front yard - 25 feet; b) Side yard - 10 feet; c) Rear yard - 20 feet. 3) That the City Manager be given flexibility to determine setback require- ments for Lot 38 in order to provide greater flexibility in the location of a residential structure among the trees on that lot. 4) That a copy of the proposed covenants and restrictions be submitted to the Advisory Planning Board for their reveiw and comment to the City Commission prior to final approval of the Planned Unit Development. TRECO, Inc. , has indicated to the Advisory Planning Board that the proposed amendments are acceptable. They further indicated that they would immediately provide to the City Manager a copy of the proposed covenants and restrictions. A meeting of the Advisory Planning Board will be held prior to the scheduled public hearing established by the City Commission, in order that the covenants and restrictions may be reviewed and that appropriate recommendations can be made to the City Commission at the public hearing. The plot plan and topographic survey have been reviewed by the City Engineer, Page 2 Mr. Walter Parks. Mr. Parks has indicated that the development is basically acceptable. He has made several recommendations concerning items such as the location of the hydrants, the diameter of the water lines, etc. Engineering considerations will be discussed with the developer by City staff to assure that the final plans incorporate a structure acceptable to the City. At this time, the City Commission may approve the application as a tentative plan, or before approval, may require the sponsor to modify, alter, adjust, or amend the application or any part thereof. The recommendations of the Advisory Planning Board appear to encourage architectural harmony and compatibility with the existing developments in the area, and should enhance the PUD. The City Manager concurs with the recommendations of the Advisory Planning Board that the application for Planned Unit Development be accepted as a tentative plan subject to the recommended amendments. Upon approval of a tentative plan, the City Commission is required by ordinance to set a proposed "PUD Zone for Public Hearing" in the same manner as for public hearings required prior to final adoption of City ordinances.
