N D S 0 The meeting was called to order by Mayor Howell, The invocation, offered by Commissioner Minton, was followed by the pledge to the flag. Approval of the Minutes of November 24, 1980 Jensen x Mhoon x x Motion: The minutes of the regular Commission meeting of November 24, Minton x 1980 be approved as submitted. Van Ness x x * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Howell x Advisory Planning Board "Tmmissioner Van Ness reported that the board met on Wednesday, December 3. 980 with Mr. George Gould, from Tallahassee, and the city's consultant, Mr. Marvin Hill. They started work on the 701 project to work out a land development section of the code in accordance with the city's comprehensive plan. Commissioner Van Ness added that several meetings would be held in the near future and hoped that members of the Commission would be able to attend. City Manager's Report The City Manager presented an oral report. He requested permission to enter into a grant program with the City of Jacksonville Beach through the Florida Bureau of Highway Safety FY 1981 Funding Assistance for traffic engineering technicians. He stated that the City of Atlantic Beach would have a minimum cost the first year of $1,000, and in the future would probably be on a population basis. MS Y N New Business - Mike Ash continued he has recently purchased. The new addition would be used as a person&l office. Mr. Davis stated that the plans met all the requirements of the code of the City of Atlantic Beach. Motion: Mr. Ash's plans be approved as submitted to erect an Mhoon x x addition to the existing office building at 625 Atlantic Blvd. size to be 15' x 41' . Ordinance No. 95-80-21- Third and Final Reading - Public Hearing AN ORDINANCE OF THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA, CREATING THE CODES ENFORCEMENT BOARD OF THE CITY; DESCRIBING QUALIFICATIONS AND TERMS OF MEMBERS, AND THE JURISDICTION, POWERS AND PROCEDURES OF THE BOARD; PROVIDING NOTICE AND HEARING PROCEDURES; PROVIDING FOR PENALTIES WHERE VIOLATIONS ARE FOUND TO EXIST; FURTHER PROVIDING FOR AN APPEAL BY WRIT OF CERTIORARI TO CIRCUIT COURT; REPEAL- ING ALL ORDINANCES OR PARTS OF ORDINANCES IN CONFLICT HEREWITH; PROVIDING A SAVINGS CLAUSE; PROVIDING AN EFFECTIVE DATE. ..aid Ordinance was presented in full, in writing, and read on third and final reading by Mayor Howell. Said Ordinance was posted in line with charter requirements. After reading, the Mayor opened the meeting for a public hearing. Mr. Ruth Gregg, 905 Sailfish Drive, asked if the Commission had chosen the members to serve on the board. Mayor Howell answered that the recommendations would be submitted at the next meeting. As no one else spoke for or against, the Mayor declared the public hearing closed. Jensen x Motion: Said Ordinance No. 95-80-21 be passed on third and final Mhoon x x reading. Minton x x Van Ness x Howell x Mayor Howell asked for discussion and Commissioner Jensen questioned one point. On page three the Ordinances states "After one (1) year from the filing of any such lien which remains unpaid the City may foreclose the lien in the same manner as mortgage liens are foreclosed% Commissioner Jensen pointed out that the Florida's statutory law on liens states that you have to file within one year, not after. M S Y N Miscellaneous - continued • 1 Mr. Davis read a letter from the Jacksonville Beach Fire Department Conference Committee advising that they are going to host the. 54th. Annual Conference of the Florida State Firemen''s Association which. will be held in the beaches area. They requested that the City of Atlantic Beach place an ad in the "Official Program"', Motion: Approve the purchase of a full page ad, in the amount Jensen of $200.00 for the "Official Program" of the 54th Annual Mhoon x Conference of the Florida State Firemen's Association, Minton x x Van Ness * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Howell _x Mayor Howell announced that he had received a letter from,Mr. Preben Johansen stating that due to conditions beyond his control? he was tendering his resignation as the City's appointed member of the CATV Board. The Mayor asked that the Commission give consideration for a replacement for Mr. Johansen, and be prepared to appoint someone at the next meeting on December 22, 1980. Mr. Davis added that he would be furnishing each Commissioner with a list of the Advisory Planning Board members and the Board of Adjustment :,ambers that terms have expired, with the suggestion that new members rerhaps could also be appointed at the next meeting, There being no further business, the Mayor declared the meeting adjourned.
