05-18-83 v MINUTES OF THE COMMITTEE OF THE WHOLE MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MAY 18, 1983 AT 7:00 P.M. s 'RESENT: Robert B. Persons, Jr. , Mayor-Commissioner Robert B. Cook, Sr. William I. Gulliford,Jr. John W. Morris, Jr. Catherine G. Van Ness, Commissioners AND: A. William Moss, City Manager Alan C. Jensen, City Attorney Adelaide R. Tucker, City Clerk Mayor Persons called the meeting to order at 7:03 p.m. for the purpose of discussing the rezoning procedures as prescribed by Chapter 3 of the Land Development Code. After a lengthy debate, it was agreed that certain sections of Ordinance No.90-82-74 needed to be clarified. Commissioner Gulliford moved for the Committee to recommend the following amendments to the Commission to be implemented to the Ordinance: Page 2-17,Section II-B-107. Planning Agency should be defined as the Advisory Agency. Page 3-1, Section III-B-1-b. Strike out the last sentence. Page 3-1, Section III-B-1-b and c. Insert the word Advisory in front of Planning Agency. Section B-1-b would then read "To make amendments to these zoning regulations and zoning map by a simple majority vote of the City Commission after holding the required public hearing, and after receiving a written recommendation from the Advisory Planning Agency". The motion was seconded by Commissioner Van Ness, and carried unanimously. * * * * * * * * * * * * * * * * * * * * * Commissioner Cook moved to recommend the following amendment to the Commission to be implemented to the Ordinance: Page 3-1,Section III-B-1-c - insert the word disapprove. Section III-B-1-c would then read "To approve or disapprove all subdivision plans and Planned Unit Develop- ment (PUD) plans after holding any required public hearing and after reviewing a written recommendation from the Advisory Planning Agency. The motion was seconded by Commissioner Gulliford, and carried unanimously. * * * * * * * * * * * * * * * * Commissioner Gulliford moved to recommend the following amendment to the Commission to be implemented to the Ordinance: Page 3-8, Section III-C-2-c. Strike"which will meet the time limit required by the Planning Agency" and insert " provided that the request is received at least thirty (30)days prior to the meeting. PAGE TWO MINUTES MAY 18, 1983 Page 3-8, Section III-C-2-c would read "After the Administrative Official has received the request, the request will be placed on the agenda of the next meeting of the Advisory Planning Agency provided that the request is received at least thirty (30) days prior to the said meeting. The motion was seconded by Commissioner Cook and carried with four ayes and one nay. Commissioner Van Ness voted no. * * * * * * * * * * * * * * * * * Commissioner Gulliford moved to recommend the following amendment to the Commission to be implemented to the Ordinance: Page 3-8, Section III-C-2-c. Require a Public Hearing be held in conjunction with the consideration of the Advisory Planning Agency to comply with the State Statutes. Section III-C-2-c would read "The Advisory Planning Agency shall study each request for rezoning, shall conduct a Public Hearing, after due public notice, and make a written recommendation to the City Commission, The motion was seconded by Commissioner Cook and carried unanimously, * * * * * * * * * * * * * * * * * * the Commission directed the Administrative Official to make an appropriate charge for any request of change in zoning classification, This will not be a part of the Ordinance. * * * * * * * * * * * * * * * * * * Discussion was held with Mr. Louis MacDonnell on his proposed development for apart- ments west of Mayport Road. Commissioner Gulliford moved to recommend the following amendment to the Commission to be implemented to the Ordinance; Page 3-28, (g)-(2) . Under permitted uses-list apartment complexes. Commissioner Gulliford withdrew his motion for further consideration. * * * * * * * * * * * * * * * * * * Commissioner Gulliford moved to recommend the following amendment to the Commission to be implemented to the Ordinance: Page 3-28, (g)-(3) . Add (j) and list apartment complexes. The determination of what type of apartment complexes would be made by the Advisory Planning Board and/or the City Commission. Commissioner Morris seconded the motion which carried with a vote of three to two. )mmissioners Cook, Gulliford and Morris voted aye, and Mayor Persons and Commissioner _an Ness voted nay. * * * * * * * * * * * * * * * * * * * * PAGE THREE MINUTES MAY 18, 1983 Commissioner Cook requested the City Manager look into the possibility of paving Begonia into Main Street and part of Main Street.
