From Florida Municipal Health Trust Fund re Health Ins.Rate Increase Mayor Howell acknowledged receipt of a letter from Florida Municipal Health Trust Fund advising of a rate increase effective January 1, 1984 and instructed the letter be filed for information. Advisory Planning Board - no report City Manager's Report A. Item #1-1983-84 Capital Improvements Program The City Manager presented an update on the 1983-84 capital improvements program. He reported they are ready to complete the resurfacing of Selva Marina Drive, and they are proposing to also resurface a portion of Ahern Street and a portion of Sturdivant St. The plans are now being prepared for the city hall renovation and hopefully will be brought to the Commission for review on January 9, 1984. B. Item #2-Authorization to Disburse $1,038,00 to Roto Rooter for Emergency Sewer Clean-out The City Manager requested authorization to disburse $1,038.00 to Roto Rooter for an emergency clean-out of the sanitary sewer line from Ocean Blvd. to Seminole Road on Ninth Street (approximately 500 feet of 10" line) Cook Motion: Authorize the City Manager to disburse $1,038.00 to Roto Rooter Gulliford x x for the clean-out of the Ninth Street sewer main, Korris x Van Ness x x The motion carried unanimously. Meal charges must be substantiated by receipts. Discussion followed on the breakdown for meals and allowances. Ordinance No. 5-83-13 AN EMERGENCY ORDINANCE AMENDING SECTION 2-1.2 OF THE CODE OF ORDINANCES, THE SAME BEING THE SECTION OF THE CODE REGULATING CONFISCATED OR LOST PROPERTY. Mayor Howell explained that the proposed Ordinance would provide for the transfer of property to another governmental agency. The Florida School for the Deaf and Blind has inquired as to whether the City could transfer several of the bicycles from the Police Department (confiscated or lost and found property) to their school in time for Christmas. Tucker City Clerk RESOLUTION NO. 83-20 A RESOLUTION AUTHORIZING AN EPA CONSTRUCTION GRANT APPLICATION WHEREAS, the City of Atlantic Beach, Florida, proposes to construct a program for the abatement of water pollution consisting of wastewater treatment works, effluent disposal facilities, and collection system pumping station improvements, and WHEREAS, the City of Atlantic Beach, Florida, is eligible for federal grant assistance under Title II of the Federal Water Pollution Control Act of 1972, PL 92-500, and the Clean Water Act of 1977, PL 95-217, NOW, THEREFORE, BE IT RESOLVED that the City of Atlantic Beach, Florida, prepare and submit an application through the Florida Department of Environmental Regulation to the United States Environmental Protection Agency for a Construction Grant for Wastewater Treatment Works under provisions of PL 95-217, BE IT FURTHER RESOLVED that the City Manager of the City of Atlantic Beach, Florida, is authorized to execute all forms and applications on behalf of the City of Atlantic Beach, Florida, for this project and that henceforth all documents so executed will be valid and will reflect the intent of the City of Atlantic Beach, Florida. * * * * * * * * * * * * * * * * * * * * * * * * * * * * Passed by the City Commission on December 12, 1983 ATTEST: (SEAL) Adelaide{R7`Tucker` eLC Zi City Clerk CERTIFICATION I certify this to be o true and correct copy of the record in my office. WITNESSETH my hand and official seal of the City of Atlantic Beach, Florida, this the/y= day of p � dvc c pi Clark RESOLUTION NO. 83-21 A RESOLUTION APPEALING FOR THE RE-ESTABLISHMENT OF DIVISION OF COUNTY COURT IN THE BEACHES AREA AS PROVIDED BY REVISED ARTICLE V OF THE CONSTI- TUTION OF THE STATE OF FLORIDA WHEREAS, the Chief Judge of the Fourth Judicial Circuit of the State of Florida discontinued the practice of conducting court one day per week in Jacksonville Beach approximately five years ago, and WHEREAS, the citizens of Atlantic Beach and their government have found this to be a great disservice and inconvenience to the beach area residents, business community, military, and law enforcement agencies, and WHEREAS, the direct and indirect costs associated with the lack of a court in the beaches area have placed an unjust burden upon those residents living and working east of the intracoastal waterway, and WHEREAS, the rapid growth in the eastern portion of Duval County, including the expansion of the Naval Facilities Mayport, require increased and expanded services for all governmental agencies, and WHEREAS, the court case load from the eastern portion of Duval County justifies a division of the court in the beaches area, NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF ATLANTIC BEACH, FLORIDA: Section 1. That the City Commission of the City of Atlantic Beach urge the Chief Judge of the Fourth Judicial Circuit to re-establish a division of the County Court at the beaches as provided in revised Article V of the Constitution of the State of Florida. Section 2. That the City Clerk of the City of Atlantic Beach is directed to transmit a copy of this resolution to the Honorable Clifford B. Shepherd and to the Duval County Legislative Delegation. Section 3.
