The meeting was called to order by Mayor Persons. The invocation,
offered by Commissioner Van Ness, was followed by the pledge to the flay.
Commissioner Gulliford suggested that Commissioner Van Ness be desig-
nated permanent Chaplain. The Commission unanimously agreed.

Recognition of Visitors
Mr. George Bull, Sr. was recognized by the Chair. He spoke in reference
to the December 28, 1981 meeting at which the Advisory Planning Board
recommended tentative approval of the PUD application submitted by
TRECO on the Church property without first reviewing and approving the
covenants and restrictions. A Public Hearing has been set for February
8, 1982. Mr. Bull objected to the covenants and restrictions draft that
TRECO had furnished him saying they were nothing but a stereotype, and
he expressed the opinion that the Commission, as in the past, should
not set a Public Hearing until after the Advisory Planning Board had
reviewed and approved both the plans and covenants and restrictions,
Mayor Persons asked the city Attorney if final approval was required
before setting a Public Hearing and Mr. Ball replied no, that the
Advisory Planning Board was advisory only, and action could be taken
without the Planning Board's recommendation. Mr. Bull stated that the
city's precedent has been set never to do that, and asked why now?
Commissioner Gulliford responded with a case in point of the time frame
that the city passed on the Public Hearing being a shorter period than
Mr. Bull had experienced. Commissioner Gulliford stated that the original
date was changed from January 11, 1982 to February 8, 1982 just to be
consistent, not to correct, and stated that he did not personally feel
the city was trying to single anyone out. Commissioner Van Ness reminded

Mr. Bull that she had sat on the Advisory Planning Board for the
past four years and they had approved one of Mr. Bull's Selva Marine
Units without the covenants and restrictions after Mr. Bull advised
the Board the covenants and restrictions were basically the same as
his other units, and he would present them at the Public Hearing.
She added that, in the case of TRECO, the Advisory Planning Board
will meet on January 19th to review their covenants and restrictions
and the Board will submit their recommendation on February 8th before
the Public Hearing is held. Discussion followed. Mayor Persons
advised Mr. Bull that he could rest assured if the covenants and
restrictions did not meet the requirements of the Advisory Planning
Board or the Commission,final approval of the Planned Unit Development
application would not be granted.
Advisory Planning Board
Commissioner Van Ness reported that the Board will meet on January
19, 1982 at 7:30 p.m. and the public is cordially invited.
City Manager's Report
A. Item #1 - Award of Contract for Four "Police Package Automobiles'
Mr. Moss presented a written report and tabulation of bids for the
four "Police Package" automobiles. Of the eleven area automobile
dealerships receiving specifications and bid documents, only one
firm, Nimnicht Chevrolet, submitted a bid. The bid price submitted
by Nimnicht Chevrolet is as follows:

Discussion followed. The suggestion was made that in the future,
perhaps it would be wise to join Jacksonville Beach, who specifies
a similar automobile, so that the order will be more than the
minimum of five vehicles in order to obtain the police package.

Action on Resolutions - Resolution No. 82-1
Mayor Persons presented and read in full Resolution No. 82-1, a
Resolution of the City Commission of the City of Atlantic Beach
urging the State Legislature to include the Beach Cities in the
same Legislative district.

Commissioner Van Ness suggested that each Commissioner and every
citizen contact the Duval delegation and let them know the City of
Atlantic Beach wants to be included with the Beach Cities in the
same Legislative district. Discussion followed. The Mayor agreed
to write a letter to the City of Jacksonville and the Mayor asking
their support and endorsement of our Resolution.

Action on Ordinances - Ordinance No. 5-81-7-3rd and Final Reading
AN ORDINANCE CREATING THE DEPARTMENT OF FINANCE AND ESTABLISHING
QUALIFICATIONS, POWERS, DUTIES, AND METHOD OF APPOINTMENT OF THE
DIRECTOR OF FINANCE; PROVIDING AN EFFECTIVE DATE.
Said Ordinance was presented in full, in writing, and read on third
and final reading by the City Manager. Said Ordinance was posted in
line with charter requirements. After the reading, the Mayor openec
the meeting for a public hearing. As no one spoke for or against,
the Mayor declared the public hearing closed.

Miscellaneous Business
A general discussion was held on drafts to amend the nuisance
Ordinance. On Ordinance amending chapter 13 of the City Code of the
City of Atlantic Beach, to prohibit certain acts, occurrences and
conditions which constitute a nuisance, the Mayor stated that this
draft is addressing the problem the City has, but he had some _

questions as to the language that was used to do so as far as the
required specificity of the language: (a) remove the words-to the
prejudice of any person and add which may be injurious to the
health and well being of any person due to noxious odors, noise,etc.
(b) too broad; (c) remove -so as to become offensive to other persors
by weeds growing and add which may be injurious to the health
and well being of any person; include the words horses and chickens;
also check to see if (d) and (e) conflicts with other Ordinances;
(f) remove the word children and add any human being; (h) delete
the word serious; (i) Scratch; Section 2 - Penalty- change the
position of section 3 to Section 2 to have the penalty after the
notice. Change the wording--after notice as prescribed in Section 2-
any person who violates any provision of this chapter shall be fines .
Section 3 - Section 13-2 should read 13-1; (a) send primary notice
that the cost of the work to cover City administrative expenses
will be assessed to the property owner,and also notice to occupant.
(b) and (c) should read property owner and occupant, not and/or.
An Ordinance declaring weeds to be a nuisance and establishing the
procedures to abate: - Section 2 - remove the words matter found
lying and re-word; take out section - "or upon any sidewalk". Section
3 - the owner should get notice.
Commissioner Gulliford requested that the draft on An Ordinance
regulating vehicles stopping, standing and parking be deferred until
a later time. Commission agreed.

Mr. Ron Gray advised the Commission of a potential hazardous situation
at the corner of Ocean Blvd. and Atlantic Blvd. (game room) by the u>e of
a bright strobe light and two flood lights to advertise his business .
Chief Stucki stated that the problem would be taken care of immediately.
There being no further business, the Ma . .eclared the meeting
adjourned.

CITY MANAGER'S REPORT
Item #1:
Subject: Award of Contract for Four "Police Package" Automobiles
Background_
Attached for review by the City Commission is the tabulation of bids for four
"Police Package" automobiles. Of the eleven area automobile dealerships
receiving specifications and bid documents, only one firm submitted a bid.
At the request of the City Manager, staff surveyed several dealers to deter-
mine why a proposal was not submitted. Jack Lynch Chevrolet advised that
dealers were required to order a minimum of five vehicles in order to obtain
the police package. Lynch advised they could not order five vehicles.
Thompson Chevrolet suggested that they did not bid for a combination of rea-
sons, which included requirement to purchase five cars, and the fact that the
plants were closed down over the holidays. Nimnicht Chevrolet, the sole
bidder, concurred that they were required to buy five vehicles, and that they
had hoped to sell the fifth vehicle elsewhere.
In 1979, the City paid $5,700 per vehicle with trade. The bid price submitted
by Nimnicht Chevrolet with trade-ins is $8,076.09 per vehicle, an increase of
42%. Calls were made to two cities which recently purchased police package
automobiles. Fernandina Beach, which specified a few more options, received a
low bid of $9,600. This was the lowest of three bids. Jacksonville Beach,
specifying a similar automobile, received a low bid of $8,955 from Thompson
Chevrolet.
Because many dealers received the specifications and were afforded the opportunity
to submit proposals, and because there does not appear to be any evidence that
the only bid price is significantly out of line with prevailing prices, the City
Manager suggests that the City Commission may wish to waive their requirement
that two or more bids be received for this purchase. Under special conditions,
the City Commission may waive the requirement for two or more bids.
Nimnicht Chevrolet offered $4,220 for the trade-in on six vehicles. Two of the
vehicles are scrap --- hence their value is negligible. Assuming the trade-in

value was to apply against the four police vehicles being traded in, each
vehicle received a trade in value of $1,055. The City has no way of knowing
whether or not we can obtain more by selling the vehicles through an auction.
Jack Lynch had advised, however, that in evaluating whether they would submit
a bid, they had determined that a trade in value of $1,100 would have been
appropriate. A used car dealer in town has advised that his wholesale house
suggested they may pay $1,050 to $1, 350.
Delivery of the new vehicles is not expected for at least another 70 days.
The City Manager suggests that we commit these vehicles to be traded and make
future maintenance decisions accordingly.
Recommended Action:
Award of contract by City Commission is requested.

RESOLUTION NO. 82-1
A RESOLUTION OF THE CITY COMMISSION OF THE CITY
` OF ATLANTIC BEACH URGING THE STATE LEGISLATURE
TO INCLUDE THE BEACH CITIES IN THE SANE LEGIS-
LATIVE DISTRICT
WHEREAS, the State Legislature of the State of Florida is required
to reapportion the legislative districts in the 1982 legislative session; and
WHEREAS, the State Legislature must determine new House and Senate
district boundaries to conform with population shifts in the past ten years;
and
WHEREAS, in the past, the Duval County cities east of the Intercoastal
Waterway have not been in the same legislative districts; and
WHEREAS, these Beach municipalities have common interests unique to
these Beach cities; and
WHEREAS, the Beach cities have demonstrated their ability to work
jointly to solve common problems in order to meet the needs of their citizens;
and
WHEREAS, it would be in the best interest of all citizens of the Beach
municipalities to be within the same legislative district, whether single or
multi-member,
NOW, THEREFORE, BE IT RESOLVED:
Section 1. That the City Commission of the City of Atlantic Beach
strongly objects to any legislative redistricting which will separate the City
of Atlantic Beach from the other beach municipalities.
Section 2. That the Legislature of the State of Florida be and hereby
is urged and requested to draw new House and Senate District lines which will
provide for the inclusion of the Beach cities in the same district.
