The invocation, offered by Commissioner Van Ness, was followed by the pledge to the flag. Approval of the Minutes of August 13, 1984 Motion: Approve the minutes of the regular Commission meeting of Cook x August 13, 1984 as presented. Gulliford x Morris x x The motion carried unanimously. Van Ness x x * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * Howell x Recognition of Visitors Elle Chair recognized Mr. Randall Whitfield, Jacksonville Beach. Mr. Whitfield asked for direction from the Commission regarding a rezoning of property located on the southwest portion of Levy Road with frontage on Mayport Road. The present zoning is Commercial General (CG) . Mr. Whitfield stated they had appeared before the Advisory Planning Board at the last meeting with a request to build mini-warehouses on the property. They had all indications from the Advisory Planning Board that the zoning they wanted would have been denied so the request was withdrawn. Discussion followed. It was the consensus of the Commission that they are against spot zoning, but agreed the current zoning on all of Mayport Road needs to be reviewed. Following discussion, Mayor Howell advised Mr. Whitfield that he would have to follow procedures and go back to the Advisory Planning Board for their decision and recommendation to the Commission. Correspondence - None Advisory Planning Board A. Request for Rezoning - Hiram Caroom - Part of Lots 2 and 3, Section 17-2S-29E - Mayport Road Commissioner Van Ness reported on the meeting as Commissioner Morris was out of town at that time. Commissioner Van Ness reported that Mr. Caroom wants to convert an existing residence to an office building. ?rior zoning was commercial. Present zoning is RG2 and Mr. Caroom asked for rezoning to CL. The Advisory Planning Board took no action on the matter, but agreed it would be a good idea to get a professional planner's opinion as to what would be the right thing to do with the PAGE TWO V V MINUTES Names of AUGUST 27, 1984 Commrs. Commissioner Van Ness added that the Board requested the City Commission consider the request in regards to rezoning to Commercial Limited (CL) . Commissioner Cook suggested a zoning work- shop meeting should be called. Mr. Caroom stated that he had talked with Bishop Brown, Mrs. Silman, and Mr. Wade, his neighbors, and they had no objections to an office building. Following discussion, Commis- sioner Gulliford moved for the following: Motion: Table the request for rezoning submitted by Hiram Caroom. Cook x Gulliford x x The motion carried unanimously. Morris x x Van Ness x It was agreed that a zoning workshop meeting should be called Howell x within the next few weeks and the Mayor asked the City Attorney to re- search the legalities on the Comprehensive Plan as soon as possible. If at all possible, perhaps the subject could be discussed during the meeting of August 30, 1984 (Public Hearing on the Budget) . * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * * h Request for Rezoning-Martin Oil Company - Lots 1 and 2, Blk 17 Donner's Replat - Ardella Road Commissioner Van Ness reported the Advisory Planning Board reviewed Mr. Martin's request for rezoning for the above referenced property on Ardella Road from Residential General (RG2) to Commercial General at their meeting on August 21, 1984. The Board recommended that the request for rezoning be denied. Motion: Table the request for rezoning submitted by Martin Oil Cook x x Company. Gulliford x x Morris x The motion carried unanimously. Request for Rezoning - David Nelson and Ervin Lane, Lots 1 through 4, Block 34, Section H - West 6th Street Commissioner Van Ness reported that the Advisory Planning Board met on August 21, 1984 and reviewed an application submitted by David Nelson and Ervin Lane to rezone the above referenced property on West Sixth Street from Commercial General to Commercial Intensive. The Advisory Planning Board recommended the request for rezoning be denied. Motion: Table the request for rezoning submitted by David Nelson Cook x x and Ervin Lane. MS Y N City Manager's Report A. Item #1 - Proposed Date for Final Public Hearing on Budget As there were no objections from the Commission, Mayor Howell set the final Public Hearing on the Budget for FY 84-85 for September 12, 1984 at 7:00 P.M. Mayor Howell reminded the Com- mission that the first Public Hearing on the tentative budget and millage rate is scheduled for 7:00 p.m. on August 30th. No further discussion was held on the budget. B. Item #2 - Sanitation Study Mayor Howell acknowledged receipt of the Sanitation Study of August, 1984 prepared by Harry E. Royal, Finance Director and instructed the study be held for information and discussion during the budget workshop meetings. New Business - None Unfinished Business - None Zeport of Committees - None Action on Resolutions - None Action on Ordinances A. Ordinance No. 65-84-10 AN ORDINANCE VACATING AND ABANDONING A PORTION OF WEST PLAZA ROAD Second and Final Reading - Public Hearing. Mayor Howell announced the Public Hearing was inadvertently incorrectly advertised for August 17, 1984 instead of August 27, 1984. The Mayor re-scheduled the Public Hearing for September 10, 1984 at 7:15 P.M. B. Ordinance No. 45-84-6 AN ORDINANCE AMENDING CHAPTER 10 ENTITLED "LICENSES" OF THE CODE OF THE CITY OF ATLANTIC BEACH. Said Ordinance was presented by Mayor Howell in full, in writing, and read on first reading, by title only. Motion: Said Ordinance be passed on first reading, by title only. Van Ness x Gulliford x During discussion before the vote, Commissioner Gulliford asserted that he had reviewed the proposed Ordinance several times and noticed the PAGE FOUR V V MINUTES Names of AUGUST 27. 1984 Commr s. M S Y N Action on Ordinances continued - Ord. 45-84-6 schedule of fees addressed some licensing for the operation of the telephone company, but he found nothing that addressed some license fee for the operation of anelectrical utility. He expressed the opinion that JEA is a business operating in the city of Atlantic Beach at absolutely no cost, and they should pay a fee to operate in Atlantic Beach just as any other business would pay a fee to operate a business in our community. A lengthy discussion followed. Following discussion on amount to charge, etc. Commissioner Morris moved for the following substitute motion: Substitute Motion: Ordinance 45-84-6 be passed over until the meeting of Cook x August 30, 1984. A committee composed of Commissioner Gulliford x x Gulliford, City Attorney Claude Mullis and City Manager Morris x x Moss will come with a recommendation as to the imposition Van Ness x of an Occupational License Tax for Electric Utility and Howell x Water and Sewer Companies operating within the City of Atlantic Beach. Fhere was no discussion before the vote.
