MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY
COMMISSION HELD AT.;THE CITY HALL ON MONDAY, FEBRUARY 13TH,
1961 AT 8 P.M.

The meeting was called to order by the Mayor-Commissioner,
Mr. Howell.
Minutes of the meeting of January 23, 1961 were approved as
written upon motion of Dr. Whitehurst, seconded by Mr. Moore and
carried.
Bids were next received covering Sanitary Sewer Extensions-
Donner "s Sub-division and Environs . Certified Proof of Publi-
cation covering Call for Bids on this project is attached to
these minutes and made a part thereof. Bids were as follows:

Mr. Moore moved that the bids be received for tabulation and
referred to the Commission acting as a committee and the City's
Engineer, Mr. Walter Parks, for study, seconded by Dr. Whitehurst
and carried.
Mr. Howell recognized visitors present and called for any busi-
ness from the floor.

Mrs. C.B. Adams appeared on behalf of Teen-Town of the Beaches
advising that they were now in full operation with elected of-
ficers and that they would appreciate any support-moral, finan-
cial or otherwise that could be given them. The Mayor advised
them that they had our moral support, but at present due to our
budget and charter limitations we could not do anything in a
financial way at this time.
Mr. John Bell of Atlantic Beach, representing the Fletcher Band
Parent' s Association, introduced Mr. N.W. Dellinger, President
of the Association who made an appeal for Atlantic Beach assist-
ance with a donation of $750. 00 to help send the band to the
Cherry Blossom Festival in Washington D .C. There is one school
band from each state invited and Fletcher is to represent Florida.
Jacksonville Beach has contributed $2, 000. 00 and Neptune Beach-
$600.00. There was discussion and it was advised that there is
nothing in our budget from which we could make such a donation,
and that neither does our charter permit such expenditures. The
Commission advised that they were in sympathy with the cause and
situation, but regretted that they have no alternative as they
must abide by charter rules.
A letter was presented from Mrs. Marie A. Perry asking permission
to operate a Day Nursery at Lot 18, Block 1, Royal Palms to be
operated from 6 A.M. to 12 midnight, su _table for working mothers ;
tThey also had attached a petition signed by adjacent
property owners and the Sales Manager for Hercules, Inc. relative
to granting of the permit. It was discussed and upon motion of
Dr. Whitehurst, seconded by Mr. Claiborne the request was re-
ferred to the Zoning Committee for study and recommendation to
next meeting,
The City Manager advised that Mr. Louis Holloway has built a 5 '
wall about 25 or 30 feet long down the north property line at
his new home on Lot 4, Block 54, and the Zoning Ordinance does
not permit a fence over 4 feet high on the property line. A fence
over 4 feet high must be in accordance with set-back regulations
for buildings. Mr. M.R. Bruning who owns the adjoining property
entered his objection to the fence very s.trenu3usly. Mr. Holloway,
who was present, was advised that he must comply with the Ordi-
nance, which he agreed to do.
A request was presented from Henry A. Holcomb, Lot 6, Block 11
known as 309 Plaza, asking permission to install a sink unit in
the downstairs room in the garage apartment. This would make this
an efficiency apartment room which would give 2 units in this
building. There is also a duplex on the front of this lot, and
the garage apartment was permitted by a former council after a
public hearing. It was discussed and upon motion of Mr. Moore
seconded by Mr. Claiborne the matter was referred to the Zoning

Board of Adjustment for investigation and consideration.
Mr. Waggoner presented a Replat of Royal Palms Unit 2A which
makes some corrections in Utility Easements, but in other respects
is same as the Plat which was approved on January 9th, 1961. Mr.
Moore presented Resolution #61-2 accepting this replat showing
the corrections in easements and directing the Mayor and City
Clerk to sign same, and moved its adoption, seconded by Dr.
Whitehurst and having been duly considered was unanimously car-
ried. Copy of Resolution #60-2 is attached to these minutes and
made a part thereof.
Mr. Waggoner asked direction for calling for bids on Royal Palms
Lift Station "F". Dr. Whitehurst moved that we go ahead with
this project and that we advertise for Call for Bids on this
lift station for February 27th, 1961, seconded by Mr. Claiborne
and carried.
Mr. Waggoner asked for permission to get bids on a street sweep-
ing contract for the City. It was discussed and Mr. Claiborne
moved that the City Manager get bids for contract on Street sweep-
ing, seconded by Mr. Moore, and carried.
The Cpmmission next went into session for Public Hearing on an
Ordinance providing for the keeping and registering of dogs in
the City, said Ordinance having been posted in line with charter
regulations. The Mayor advised that the Chairman of :this Com-
mittee is absent and it was understood that he has some changes
to recommend in this Ordinance, and he would suggest that final
passage of Ordinance be continued until the next meeting. How-
ever if anyone present wished to speak either for or against at
this time that they would be heard. As no one appeared either
for or against at this time, Dr. Whitehurst moved that the
Public Hearing and consideration of this Ordinance for 2nd and
final reading be postponed until February 27th, 1961, seconded
by Mr. Moore and carried. The Public Hearing at this time on
this Ordinance was declared closed.
The Commission next went into session for Public Hearing on Re-
Zoning of certain lots in Lewis Subtdivision from Residence "D"
to Industrial, said Ordinance having been posted and published
in line with charter requirements. Copy of Certified Proof of
Publication of said Notice is attached to these minutes and made
a part thereof. Mayor Howell presented and caused to be read
in full the Ordinance covering the Re-Zoning of Lots 1 thru 12,
Block 4, Lewis Sub-division from Residence "D" to Industrial
Zone.Mr. W. E. Dutton, who owns some property west of the City
limits, appeared against the passage as he objects to going by
an Industrial Area to get to his proposed residential area.

Mr. Robt. Lynch spoke against spot zoning and the damage that
might come to the Levy Road paving. John Lowe and F.R. McKenzie
who own property in the vicinity spoke objecting. l3he representa-
tives of the Southern Materials Co. who requested the re-zoning
advised that they do not intend to use Levy Road, but will use
Church St. , and they also intend this to be a permanent business.
The attorney for their company had requested that final action
on this Ordinance be postponed until next meeting. There were
scattered remarks regarding this re-zoning following which the
Mayor declared the Public Hearing closed. Mr. Claiborne moved
that final action on this Ordinance be postponed until February
27th, 1961 and a report can be made by the Zoning Committee chair-
man who is absent, seconded by Dr. Whitehurst and carried.
There being no further business the Mayor declared the meeting
adjourned.

RESOLUTION NO. 61-2
WHEREAS it was necessary to relocate several Utility
Easements in Royal Palms Subdivision Unit No. 2A and
the most satisfactory method of accommodating this
change was to replat portions of said Subdivision.
NOW BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY
OF ATLANTIC BEACH, DUVAL COUNTY, FLORIDA, That
The Subdivision Replat of Royal Palms Subdivision,
Unit No. 2A, submitted to the City Commission on Feb-
ruary 13, 1961, be and the same is hereby approved,
and that the Mayor-Commissioner and City Clerk be
instructed to sign said Replat.
