(9) Correspondence: (a) Mr. Glover Weiss (b) Request for Day Nursery (10) Commissioners (11) Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, DECEMBER 10, 1962, AT 8:00 P. M. Present: Henry G. Isaacs Preben Johansen J. B. Claiborne C. B. Lawrence Chas. R. Moore, Commissioners and John R. Printon, City Manager Adele S. Grage, City Clerk Frank Thompson, City Attorney The meeting was called to order by the Mayor-Commissioner, Mr. Isaacs. . Minutes of the meeting of November 26, 1962, were approved as written upon motion of Mr. Johansen, tconded by Mr. Claiborne and carried. Minutes of Special Meeting of November 27, 1962, were approved as written upon motion of Mr. Johansen, seconded by Mr. Claiborne and carried. Mr. Isaacs recognized visitors and called for any business from the floor not on the Agenda. Mrs— Kenneth Scudders of the Atlantic-Neptune P.T.A. , together with Mrs. Russell Scott, requested information as to what was going to be done about protecting the school children, as they understood Mrs. Durham will no longer be on the school front. Mr. Printon advised that the Police Department is taking over this duty and that there will be a policeman on duty at the hours now covered. He assured them that they would have the necessary protection for the school children and that the officer would not be pulled off to handle any other matter. The Commission advised that they, too, had children in the school or were exceedingly interested in the children and would not let them be without any patrol protection. It was also suggested that Mr. Printon talk to Neptune Beach in regard to some help at the crossing at Atlantic Boulevard and Penman Road. He will do this. Report for the month of November, 1962, was received for filing from Police Chief McClung. There was no report from the Fire Department. Mr . Lawrence advised that he still does not have the answers in regard to the landfill charges. The matter was discussed Minutes 12-10-62 Page 2 at great length and it was advised that the annual report of the East Duval Mosquito Control District will be out soon and perhaps some information can be obtained from this report. Mr. Lawrence advised that since he cannot come up with anything, we should go ahead and sign the contract in line with previous action of the Commission. It was the con- sensus of opinion that this be done. Mr. Isaacs presented Ordinance #67-62-4 and read same in full. He then declared the meeting in session for Public Hearing on said Ordinance. Public Hearing was advertised in line with provisions of the City Charter. As no one ap- peared either for or against said Ordinance, Mr. Isaacs declared Public Hearing closed, whereupon Mr. Johansen moved that Ordinance 67-62-4 amending Subdivision Ordinance as re- gards Drainage Ditches be passed on Second and Final reading. Motion was seconded by Mr. Moore and, having been duly considered, was unanimously carried. Mr. Isaacs presented Ordinance #20-62-6 covering the Budget for the Year 1963 and read same in full. He then declared the meeting in session for Public Hearing on said Ordinance. Certified proof of publication of Notice of Public Hearing on this Ordinance is attached to these minutes and made a part thereof. As no one appeared either for or against said Ordinance, Mr. Isaacs declared the Public Hearing closed, whereupon Mr. Claiborne moved that Ordinance #20-62-6 be passed on Second and Final reading, seconded by Mr. Moore and, having been duly considered, the Roll Call was as follows: Aye: Claiborne, Johansen, Lawrence, Moore, Isaacs Nay: None Mayor Isaacs therefore declared said motion carried and said Ordinance #20-62-6 covering the 1963 Budget passed. Mr. Printon presented proposals he had received on heating and air conditioning the City Hall. It appears that each proposal is different due to the firms handling different types of equipment and having different ideas as to what is needed to accomplish the heating and air conditioning. Mr. Claiborne suggested that a committee be appointed to study this matter, whereupon Mr. Isaacs appointed Mr. Claiborne and Mr. Printon as a committee. There was still further dis- cussion on the subject, but the matter was left in the hands of the committee to come up with suggestions and proposals. Minutes 12/10/62 Page 3 Mr . Isaacs appointed a committee to study the Beach and Sea Wall preservation as follows: C. B. Lawrence, chairman; Harcourt Bull; and John R. Printon A letter was presented from Mr. Glover Weiss regarding the sand bags and Beach erosion. Mr . Johansen moved that this letter be turned over to the above committee to be used in their study, seconded by Mr. Claiborne and carried. Application was received for the operation of a Day Nursery at 270 Mayport Road to handle approximately 40 children. The zoning ordinance does not specifically eliminate or de- signate this business area for such use, but seems to be discretionary. The matter was referred to Mr. Printon to confer with the City Attorney and if found to be legal, then to go ahead with granting the application. It was advised by Mr. Lawrence that Neptune Beach has agreed to pay $3, 000.00 a year for three years for radio service, same to be paid in monthly payments. Mr. Lawrence moved that we agree to this arrangement and have our City Attorney, Mr. Thompson, draw up the necessary papers to cover. Seconded by Mr. Claiborne and carried. Mr. Thompson advised that he had been contacted by the attorney for the City of Jacksonville and he stated that he cannot find where the City of Atlantic Beach has the authority to levy a Special Assessment against the City of Jacksonville for the sewer improvement at their property on Ahern Street. Mr. Thompson advised that on checking same, he cannot find that any authority, has been granted to us to make this assess- ment and therefore, it will have to be cancelled from the Special Sewer Assessment Roll. The Clerk 's office will have to take a clerical error on this matter. Mr. Isaacs requested Mr. Thompson to draw up a resolution covering the cancelling of this assessment from the roll. A bill was presented from Mr. Walter J. Parks, our Engineer, in the axr:ount of $308.06 to cover services rendered on Part 1 of Sewer Extension in Area "L". Mr. Lawrence moved that this bill be paid, seconded by Mr. Johansen and carried. It was decided that since we were not having a regular meeting of the City Commission on the 24th of December that special meetings would be called when necessary to take care a I Minutes 12/10/62 Page 4 of business that needed to be handled before the end of the year.
