Commissioners. MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, MARCH 12TH,1962 AT 8 P.M. Present: Henry G. Isaacs Preben Johansen J.B. Claiborne C.B. Lawrence • Chas. R. Moore, Commissioners and Frank Thompson, City Attorney J.F. Waggoner, • Jr. , City Manager Adele S. Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Isaacs. Minutes of the meeting of February 26th, 1962 were approved as written upon motion of Mr. Moore, Seconded by Mr. Lawrence and carried. Mr. Isaacs recognized visitors present and called for any business from the floor; Mr. Russell Smith addressed the Commission on the subject of dogs and advised that he is ready to take legal action, if necessary, if the full rules of the Ordinance are not abided by: He advised that in Section 3 of the Dog Ordinance that a licensed dog that may be committing a nuisance, etc. is subject to being picked up. Mr. Howell stated that he thinks the point in question is the word "nuisance", and that what constitutes a nuisance to one person might not be a nuisance to another therefore he thinks there should be a written com- plaint made: There was a lengthy discussion during which Mr. Smith named dogs which he considered a nuisance. It was the consensus of opinion that the Commission intends to carry out the Ordinance with those dogs subject to being picked up, so done provided the proper complaint is made or warrant issued; A letter was read from the Joint Railroad Brotherhood on the pending railroad mergers, and it was agreed that this was not a matter for Commission action. A letter was presented from Mr. Archie A. Dyal requesting per- mission to operate Ice Cream Vending business in Atlantic Beach: Mr. Dyal, who was present, presented a brochure show- ing the type of machine he will use and advised that he car- ries liability insurance and his drivers all have Duval County health cards. He also advised that he handles only packaged items and they do not contact the actual product itself. The Commission asked Mr. Waggoner if he knew of any reason not to grant the license, and he advised he did not, whereupon Mr. Moore moved that Mr. Dyal' s application be approved and license issued, seconded by Mr. Claiborne and carried. Minutes 3-12-62, Page #2 A letter was received from Mr. Harcourt Bull, Jr. requesting that 3 of the new street lights be placed on Selva Marina Drive within the limits of Selva Marina Unit #5. It was ad- vised that the plans for the location of the new lights had been referred to the City Manager with the City Commission to look over the locations again. The original plan submitted called for 2 lights in this area. Mr. Lawrence thinks one should be put at the far end, and one about midway of the sec- tion , but does not care for one at his corner. The request of Mrs. Frances Conner to change the location of her Beauty Shop will be studied at the committee meeting fol- lowing this meeting. The plans for the Fire Station addition are still being stud- ied and are not ready yet for bidding. Mr. Claiborne advised that Mr. Parks suggests that we take steps immediately to put a well on the suggested site if we can get the necessary easement across the airport. The matter of put- ting a pump in the present well was also discussed. Mr. Jo- hansen feels we should float more revenue certificates if nec- essary and secure the right-of-way to get to another well and do the big job if we can. He favors the big expansion to meet the anticipated needs. It was agreed that we should try to get the right-of-way, and if not then see about pumps.. Mr.. Harcourt Bull advised that easements can be had, and he sug- gests that an appraisal be made and that he might accept the appraisal. It was decided to meet with Mr. Bull directly fol- lowing this meeting. The matter of the next Unit of the Selva Marina Sub-division was next discussed. Mr. Claiborne advised that he had rather not give an answer right now. Mr. Johansen advised that he thought they had all agreed that on the original request the majority of the Committee had said "no". Mr. Lawrence said he was under the same impression. Mr. Isaacs feels Mr. Bull is entitled to an answer, After further discussion Mr. Clai- borne moved that Mr. Bull' s request covering the next phase of Selva Marina development be denied, seconded by Mr. Moore and the Clerk was requested to show that the vote was Claiborne, Johansen, Moore "aye ", Lawrence and Isaacs "nay", whereupon the Mayor declared the motion carried. Mr. Waggoner advised that sometime ago it was requested that the Minnesota Mutual Life Insurance Co. be requested to raise Mrs. Grage' s insurance back to $4,000.00, as they had automat- ically lowered it to $2000.00 when she became 65. When the new rate and invoice for March came it appears that the City' s premium has been raised $1.00 per month per Thousand or ap- proximately $100.00 per month additional premium. Mrs.. Grage advised she was not willing for the City to have to pay that much premium in order to get her the additional $2000.00. All. other City Executives policies are for $4000:00. The matter was referred to the Finance Committee for study and investiga- Minutes 3-12-62, Page #3 tion of this particular item and to make further study as to insurance plans for employees and bring recommendations to the Commission. Mr. Waggoner sub;itted the February Man-hour report which was received and filed. Ordinance #57-62-4,covering the Fixing and Establishing a Reward for Information Leading to the Arrest and Conviction of any Person or Persons Maliciously Starting fires, was pre- sented for second and final reading, and was read in full. The Mayor declared the meeting in session for Public Hearing on said Ordinance, notice of said Public Hearing having been posted in line with provisions of the charter. No one appeared either for or against said Ordinance therefore the Mayor declar- ed the Public Hearing closed. Whereupon Lir. Moore moved that Ordinance #57-62-4 be passed on second and final reading, sec- onded by Mr. Lawrence and passed. The Mayor declared said Ordinance adopted on second and final reading. An Ordinance creating an Advisory Planning Board for the City was presented on first reading by title only. The title hav- ing been read in full, Mr. Moore moved its adoption on first reading by Title only, seconded by Mr. Johansen and carried. March 26th, 1962 was set hs date for Public Hearing on said Ordinance: An Ordinance was next presented covering Annexation of Selva Marina Country Club site to be considered by Title Only on first reading. Mr. Johansen moved that the rules be waived and that said Ordinance be considered by Title Only, seconded by Mr. Claiborne and carried. Whereupon the Title was read in full following which Mr. Johansen moved that said Ordinance be passed by Title Only on first reading, seconded by Mr. • Claiborne and carried. The date of Public Hearing was set as March 26th, 1962. An Ordinance Amending Zoning Ordinance #90-59-3 by changing the Zoning Map for that Parcel of Land lying on the East side of Mayport Road between the Atlantic Beach Villa and The Plaza to Business A was presented for 2nd and final reading. The Ordinance was read in full followiztg which the Mayor declared the meeting in session for Public Hearing on said Ordinance. Copy of certified proof of publication of Public Hearing is attached to these minutes and made a part thereof. As no one appeared either for or against said Ordinance, Mayor Isaacs declared the Public Hearing closed: Mr. Lawrence moved that this Ordinance # 90-62.13 be passed on 2nd and final reading, seconded by Mr. Moore and carried. Whereupon the Mayor de- clared said Ordinance passed on second and final reading. The report of the Chief of Police, Mr. McClung, was received and filed. • Minutes 3-12-62, Page #4 The report of Fire Chief Wm. S. Howell for the month of Feb- ruary was received and filed. Mr. Lawrence advised that the Traffic Committee has met with State and County representatives, but that he is not ready with a report at this time.
