THIS CAUSE came for public hearing before the Code Enforcement Board and the Board
having heard testimony under oath, received evidence, and heard arguments respective to all appropriate
matters, and thereupon issues the Findings of Fact, Conclusions of Law and Order as follows:
FINDINGS OF FACT
1. That the Respondent owns the property located at 1390 ROSE STREET, Atlantic Beach,Florida.
2. That notice was posted and sent by certified mail and that Respondent was present at the
hearing.
3. That notification of the violations of the City of Atlantic Beach, were made and served on the
Respondent as evidenced in this hearing.

two(2) feet shall be enclosed by a fence, wall or equivalent barrier at least four(4) feet in height and designed in
compliance with all applicable state and local regulations.
CONCLUSIONS OF LAW
THAT the Respondent, is found in violation for the time in violation and now in compliance.

missing multiple pickets. The home (my home) will be vacant soon and its very possible that the new
renter will have a small child or pet. I believed the current fence (if not replaced) will continue to be a
safety hazard and potentially dangerous.
TO WHOM IT MAY CONCERN:
I own 130 Jackson Rd, I noticed that 2 (or 3) lots west of my home were recently demolished. I
looked on COJ property search for information, however, the old home owners are still listed at140
and 174.
Please tell me what is planned for these vacant lots and who owns them now.

Good morning,
I got a message late in the day yesterday and by the time I had listened to it, it was too late to call. I tried to forward it
to you at the very end of the day, but I never know if those actually go through. I will call her first thing this morning if
you have not contacted her. It was Ms. Rhonda Hutto, Case#17-0048. She said they received a letter in May and they
have fixed the gate and the fence (?),and she said she emailed you on 6/19/17 to tell you everything was taken care
of. Then she got the NOH letter dated 7/31/17. Her number is 904-571-1033.
Let me know if you got the message and if you talked to her. Otherwise, I want to call her as a courtesy so she knows I

to be in violation of the City of Atlantic Beach, Code of Ordinances,to wit:
VIOLATION
Sec. 24-164 Swimming Pools (c) Fences: All swimming pools and any ornamental pool with a
depth greater than two (2) feet shall be enclosed by a fence, wall or equivalent barrier at least
four(4) feet in height and designed in compliance with all applicable state and local regulations.

This letter requests that the noted violations be corrected by securing the swimming pool
by installation of a secure fence or wall as outlined above upon receipt of this notice.
To avoid having this case be referred to the Code Enforcement Board, all listed violations on this
notice must be in compliance on or before the date established by Atlantic Beach Code
Enforcement. The Board may impose fines up to two hundred fifty ($250.00)per day for
continuing violations. Upon completing the corrective action required, it is your responsibility to
contact Atlantic Beach Code Enforcement and arrange for an inspection to verify compliance.
It is our goal to keep our neighborhoods looking well maintained while protecting property
values and your cooperation in this matter is greatly appreciated. Please contact Atlantic Beach
