(8) Commissioners. (9) Adjourn. • MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, JUL' 22, 1963, AT 8:00 P. M. Present: Henry G. Isaacs Preben Johansen J. B. Claiborne C. B. Lawrence, Jr . Chas. R. Moore, Commissioners and Frank Thompson, City Attorney John R. Printon, City Manager Adele S. Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Isaacs. Mr. Johansen moved that the minutes of the meeting of July 8, 1963, be approved as written, seconded by Mr . Lawrence and carried. Mr. Johansen moved that the minutes of the special meeting of July 15, 1963, be approved as written, seconded by Mr. Lawrence and carried. Mr . Isaacs next recognised visitors present and called for any business from the floor not on the agenda. There was none. Mr. H. W. McMillin of 363 - 4th Street appeared in regard to a letter which he had written to the Commission- He advised he was requesting the City to take action to remove a screen porch on the building next to him. This porch is facing toward his daughter 's bedroom window and was built without a permit about a year ago. He has been working with Mr. Printon since February or March of this year, but so far the owners have not taken any steps toward removing it. Mr. Thompson advised that he had talked with the attorney for the owner of the porch and has ad- vised him that the porch was erected in violation of our Ordi- nance and would have to be taken off. 'Them -eras a lengthy discussion following which it was decided that the City Manager would file a complaint and have the owner at court on Friday night. Mr . McMillen advised for the record that he would like to indicate that the porch was put on in June of last year - he didn't complain then because the owner was an elderly lady and very quiet. She had the porch built while he was away. However, after the first of the year, the property was sold and he found out in February that the duplex was bought for rental purposes. The Mayor next read in full a letter from Mr, Gurtler regarding his quarterly utility bill. There was no action taken. Minutes - 7/22/63 Page 2 A letter from the first National Beach Bank was read, thanking the City for its account and advising that our business was greatly appreciated. A letter from Mr. Glover Weiss was read in full regarding pro- posed repairs to his and his neighbors seawalls. Mr. Printon advised he had issued building permits for this work, as he did not see how permits could be refused. There was a lengthy discussion regarding whether the City should continue this work along the street end at First Street in order to help protect adjoining property. The matter of being committed to work on other street ends was discussed. it was decided that the sea- wall committee would look into this matter and report back to the Commission as soon as possible in order that some action could be taken. It was felt that we should do something to help those citizens who are willing to repair their own seawalls and that some decision should be made. A letter from Mr. Robert Fowler regarding the drainage ditches abutting his property was read. Mr . Printon advised the building is built three feet below grade. We are going to have to go in and set grades and see where we can run ditches. Mr. Bull ad- vised that the Mosquito Control had dug some of the ditches to the side and back of the Fowler property and perhaps they should be contacted and asked to clean out their ditches. Mr. Printon is to handle the matter. A request was presented for approval of bills from Moore Dry Kiln Company covered by our Purchase Orders #3974, 3975 and 3976. It was advised that usually pipe was bought in smaller quantities and this amount had been purchased without a purchase order. Mr. Printon advised that the pipe was received and is in the ground, that the price was in line, but he did not know until June the quantity of pipe that had been ordered. Our auditor has requested that we obtain approval of these bills from the Commission. There was a discussion, following which Mr . Claiborne moved that the bills be approved, seconded by Mr. Lawrence and carried. Mr . Printon presented a survey of the Colonial Oil property and requested that their license be revoked as the pumps, etc. , are on the right of way and constitute a traffic hazard. Mr . W. M. Stewart of Colonial Oil Company appeared and wanted to know what has prompted this action. He was advised that the City had been trying for some time to get something done about this situation and that it was Mr. Printon 's feeling that the property is in- adequate to conduct this type of business. Mr. Moore asked Minutes - 7/22/63 Page 3 if the location was profitable. Mr. Stewart advised that it was not at the present time, that it had been in the past and that progress has caught up with them. Mr. Lawrence asked if the license were revoked would the Company have any objection to removing the building, which is definitely a traffic hazard. Mr. Stewart advised he would have to take this up with the Company. Mr. Lawrence advised that we have had many minor accidents at this location because people can't see. Mr. Moore moved that the license be revoked on the basis of Mr. Stewart's statement and that the license fee for 1963-64 be refunded to the Colonial Oil Company, seconded by Mr. Lawrence and carried. Mr. Moore asked about the pile of rubbish at the Gay Center and was advised that Mr. Gay is doing this work himself and would like to dispose of rubbish to anyone who will haul it away.
