MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION • '' HELD AT THE CITY HALL ON MONDAY, JUNE 10, 1963, AT 8:00 P. M. Present: Henry G. Isaacs Preben Johansen J. B. Claiborne C. B. Lawrence, Jr . Chas . R. Moore, Commissioners and Frank Thompson, City Attorney John R. Printon, City Manager Adele S , Grage, City Clerk The meeting was called to order by the Mayor-Commissioner , Mr . Isaacs . Mr Isaacs welcomed visitors present and called for any busi- ness from the floor not on the agenda, but there was none. Minutes of the meeting of May 27 , 1963, were approved as written upon motion of Mr. Johansen, seconded by Mr . Moore and carried. Minutes of the special meeting of June 5, 1963, will be presented at the next meeting. Bids were received for tennis courts at the new playground as follows: Whalen Service Company - $5, 306 . 10 (including fence) 4, 487 .00 (without fence) This bid is the only one received and is in line with speci- fications as advertised in the Florida Times-Union. Certified proof of publication is attached to these minutes and made a part thereof. Mr. Printon advised that this is the only com- pany that specializes in tennis courts and Mr. Claiborne feels the price is terrific, being much less than Selva Marina Country Club paid for their tennis courts . The matter was dis- cussed at length and it was decided that the better thing to do would be to take without the fence. Mr . Johansen feels the funds should be transferred in the budget to take care of this, but was advised that this could be done at any time. Also, the matter of making payment in November was discussed and the City Manager is to contact Mr . Whalen about this . Mr . Claiborne moved that the bid without fence of Whalen Ser- vice Company be accepted subject to their agreeing to 11-1-63 payment, seconded by Mr. Lawrence and the call vote was: Aye; Claiborne, Lawrence Nay; Johansen, Isaacs Pass: Moore Minutes 6/10/63 Page 2 Whereupon the Mayor declared the motion carried. Mr. Isaacs next read in full an Ordinance amending Zoning Ordinance 90-59-3, calling for the rezoning of specified acreage on the north side of Levy Road from Residence D to Industrial. Certified Proof of Publication of Notice of this Public Hearing is attached to these minutes and made a part thereof. The meeting was next declared to be in session for Public Hearing on said Ordinance #90-63-16 and, as no one appeared either for or against said Ordinance, Mayor Isaacs declared the Public Hearing closed. Whereupon, Mr. Johansen moved that Ordinance 90-63-16 covering the rezoning of parti- cular acreage on Levy Road as cited in the Ordinance, be passed on second and final reading, seconded by Mr. Claiborne and carried. Mr. Printon presented a request from Mrs. Shirley Ball for a refund on a building permit, as she had procured two building permits for the same job due to having changed contractors on the work. Mr . Printon recommended $12.00 of Building Permit #7358 be refunded to Mrs. Ball, as only a small part of the work covered by this permit was done. Mr. Johansen moved that approval be given to refund $12.00 as requested, seconded by Mr. Moore and carried. Mr. Arthur J. Birchall appeared before the Commission in response to Mr. Printon's letter answering Mr. Birchall 's letter protesting utility service charges. He spoke at length outlining his ideas regarding the charges. There was a lengthy discussion, but no action taken. Mr. Printon presented a bill in the amount of $427 .46 from Mr. falter J. Parks, Engineer, for professional services ren- dered in connection with the addition to the water pumping station and recommended its payment, whereupon Mr . Moore moved that the bill, as rendered, be paid, seconded by Mr. Lawrence and carried. Mr. Printon presented a request for building permit for a storage room at the Cabana and advised that it meets code and specifications and recommended that the permit be granted. Mr. Claiborne moved that the permit be issued as requested, seconded by Mr. Moore and carried. Mr. Buddy Jones of Jones Roofing Company appeared relative to his permit for alterations and additions to the existing facilities on his lots 10 and 11, Section H, Atlantic Beach, and prevented the plans and specifications for same. Mr. Minutes 6/10/63 Page 3 Printon advised that they meet the building code and recom- mended that the permit be issued. Mr , Claiborne moved that the permit be granted to the Jones Roofing Company for this work, seconded by Mr. Lawrence and carried. A communication was read from the Beaches Junior Chamber of Commerce in the form of a Certificate of Appreciation for the cooperation of the City in their endeavors. A letter from Athletic Director of the Duncan U. Fletcher High School in the form of a Certificate of Appreciation was also read, thanking the Commission for their interest in the school and its athletic program. A letter from Smith & Gillespie, Engineers, was read in full by the Mayor. They advised that they were withdrawing their proposal as regards the ocean front study at no charge to the City. Resolution 63-11 transferring $10, 000.00 from the Sewer Fund Savings Account at the Beach Federal Savings and Loan to the General Fund was presented and read in full. Mr . Johansen moved the adoption of the Resolution, seconded by Mr. Clai- borne and carried. Copy of Resolution 63-11 is attached to these minutes and made a part thereof. Resolution 63-12 covering the transfers of funds to the vari- ous accounts was presented and read in full. Mr . Claiborne moved the adoption of said Resolution 63-12, seconded by Mr. Moore and carried. Copy of said Resolution 63-12 is attached to these minutes and made a part thereof. Mr. Thompson advised that for information of the Commission, he had been notified that the Federal Government is fore- closing on the mortgage on the Atlantic Gardens Apartments and that the City of Atlantic Beach is named in the fore- closure suit for the purpose of extinguishing taxes. It was advised that the 1962 taxes have been paid and only the current 1963 taxes would come under question. Mr. Thompson also advised that he will handle the matter and try to see if we can obtain the current taxes when they become due.
