MINUTES OF THE SPECIAL AND ADJOURNED MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON TUESDAY, DECEMBER 26, 1967 AT 8:00 P. M. Present: William S. Howell, Mayor-Commissioner John W. Weldon Louis C. Holloway, Jr. Arthur J. Longo Robert R. Rosborough, III, Commissioners and R. C. Vogel, Acting City Manager Oliver Ball, Acting City Attorney Adele S. Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Howell. The Invocation was given by Commissioner Weldon. The minutes of the meeting of December 11, 1967 were approved as written upon motion of Mr. Rosborough, seconded by Mr. Weldon and carried. A typographical error had previously been corrected. Mr. Howell stated for benefit of those who arrived late that the discussion previous to the meeting was on water pollution and expansion of sewer plant. Mr. Howell recognized visitors present and called for any business from the floor not on the Agenda. Mr. Roy Stanfield of 768 Vecuna Road advised he has two Doberman dogs and has been ordered to dispose of them because another dog got into his yard and they killed it. Chief Vogel said he and Officer Craig investigated after receiving complaint from neighbors and he can truthfully say these dogs are vicious. Mr. Vogel stated he has searched Florida Statutes and can find no provision prohibiting keeping vicious animals within City, and recommended proceed with passing such an Ordinance. Mr. Stanfield advises he has the dogs as protection for his family and tries to keep them under control. There was a lengthy discussion during which Mr. Stanfield stated he understood his responsibility and liability. Chief Vogel advised he believed if any child got into the yard it would not come out alive. The fence is 4 feet high and has a sign on it - but a six year old child who could not read the sign could climb the fence. After further discussion Mr. Weldon moved that the City Attorney be requested to check into this matter and make appropriate recommendation based on applicable law and in the meantime no further action, seconded by Mr. Rosborough and carried. Mr. Howell advised Mr. Stanfield that before any ordinance was passed there is a Public Hearing. Mr. George Bull reported on status of Selva Marina Unit #6. He still hasn' t received any decision from the City of Minutes 12/26/67 Page 2 Jacksonville on underground electric lines so is going to try to get moving and put the electric wiring overhead. He stated Jax Utilities has advised that a month or 6 weeks after Christmas will not prejudice their bid. In getting financing set up, the financing media is concerned about what will be done with certain land in future development. It is land that is planned for park and doesn' t expect City to accept in present condition - but he would like authorization for the Mayor or City Clerk to write a letter advising the City will accept as park when area is put in substantially same condition as other park. There was discussion during which Mr. Bull advised does not know exact size until area is cleared off and does not expect City to accept unless developed in con- formity to park in Unit #2 . Following discussion Mr. Weldon moved Mr. Bull knows what he wants so suggest that he prepare proposed letter dated for next meeting and submit for action at next meeting, seconded by Mr. Longo and carried. Mr. Weldon has no further report on Jacksonville Library Service. He broached the question of possible month by month payments to Library Director and he advised he would take up with County Attorney - has no final report. Mr. Longo read report of the Awards Committee on Petroleum Products bids. Copy of report is attached to these minutes and made a part thereof. Gulf Oil Company was low and best bidder and Committee recommended acceptance of their bid on gasoline, oil and grease, and that McCall Service, Inc. be awarded kerosene bid. Mr. Rmsborough moved recommendation be accepted and awards made accordingly, seconded by Mr. Holloway and carried. Mr. Howell presented Ordinance #20-67-16 covering Budget for year 1968 and read same, following which he declared the meeting in session for Public Hearing on said Ordinance. As no one appeared either for or against, the Mayor declared the Public Hearing closed. Mr. Weldon moved that Ordinance #20-67-16 be passed on second and final reading. Mr. Weldon inquired as to the amount set up in Account #501 for loaders in Sanitary Department and he and Mr. Vogel resolved this point. Mr. Weldon inquired as to where money comes from in Account #123 "transfer from unbudqeted reserve", and was advised that it comes from monies left unexpended in General Fund at end of year. He inquired if we would have this amount and Mrs. Grage advised we would have some more than $97, 500.00. The Mayor then put the question and the motion carried. Approval was required to call for bids on a police car, a garbage truck chassis, and a garbage truck body. There was discussion in which it was determined that two cars would be for police and one car for City Manager and will be used as spare by police when needed. It was brought out that bids can Minutes 12/26/67 Page 44-3 be made by several manufacturers and are not keyed to just one. Mr. Holloway moved approval of call for bids on all three items, seconded by Mr. Rosborough, and following discussion the Mayor put the question and the motion carried. Mr. Weldon stated he has had numerous complaints of speeding on East Coast Drive and asked that something be done about it. There was discussion as to speeding throughout City and Chief Vogel advised he will check into and use radar. Copies of Municipal Court dockets for December 18th and 26th, 1967 were presented to Commission. There being no further business the Mayr declared the meeting adjourned. aol�;ii ' /0 / / AN J . Grage, City C1-0 CITY OF . . . mania Bea4-Teo4ida December 26, 1967 TO THE CITY COMMISSION: Subject: Petroleum Bids The undersigned Committee, after careful evaluation, has come to the conclusion that the bid of Gulf Oil Corporation for furnishing gasoline and oils and greases for the year 1968 was best and low, and there- fore recoiuuuend that the Commission accept this bid.
