Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, JULY 10, 1967 AT 8:00 P. M. Present: William S. Howell, Mayor-Commissioner John W. Weldon Louis C. Holloway, Jr. Donald L. Goodling, Commissioners and Frank Thompson, City Attorney Murray H. Bennett, City Manager Adele S. Grage, City Clerk Absent: W. J. Parks, Jr. , Commissioner The meeting was called to order by the Mayor-Commissioner, Mr. Howell. The Invocation was given by Commissioner Weldon. Mr. Holloway moved that the minutes of the meeting of June 26, 1967 be approved as written, seconded by Mr. Weldon. Mr. Goodling stated he felt it would be well for the minutes to mention that the request to close part of Beach Avenue, as covered by the defeated Ordinance, was made by the property owner, Mr. Joe Adeeb. Mr. Weldon and Mr. Holloway had no objection. Mr. Howell then put the question and the motion carried. Mr. Howell recognized visitors present and called for any business from the floor not on the Agenda. Mr. A. J. Longo stated he would like to have read in the minutes that the police should be congratulated on an excellent job done over the Holidays. A letter was read from the City of Jacksonville acknowledging our letter and expressing appreciation of our cooperation on the new light poles that were set. The letter was received for information and filing. Mr. Bennett read the City Manager 's report, copy of which is attached to these minutes and made a part hereof. Mr. Bennett reported that he had talked to Mrs. Reva Silmon this morning relative to sewer service. He advised it has been found that the sewer line on Francis Avenue is deep enough so that the house on Richardson Lane can be connected to it at proper elevation. He also advised the laterals "as built" on Francis Avenue were done incorrectly and rise sharply from the sewer main to the property line and were too shallow to connect the Richardson Lane house to. Minutes 7/10/67 Page #2 Mr. Bennett advised that Mr. Art Reinertson will put a lateral across Francis Avenue to Mrs. Silmon 's property line for $100.00. He has talked to Mr. Oliver Ball, Mrs. Silmon's attorney, who advised she is willing to go ahead on this basis with the City furnishing the lateral and he advised she has received a price of $100.00 to take the line to her house. Mr. Bennett recommended that it be done - Mr. Goodling thinks should be on record that laterals are incorrectly installed in case comes up in future. Mr. Howell thinks this isn't quite the point - there are still lots on Richardson Lane that cannot necessarily be served from this line - lines were not improperly installed - they were installed to a point to serve what was there - only to go across Francis and quit and not serve houses in back of property. As it turns out can be worked out in that manner as it does not require any special action by Commission because under $500. 00. Minutes will reflect discussion and show that there are no objections from the City Commission. There was no report on OEP assistance on Beach erosion. Mr. Bennett requested approval to call for bids for new chlorinator to be used at Water Pumping Station, and turn the present water chlorinator over to the Sewer Department. Would also request to call for bids covering electrical work for pump controls at Water Department. Total estimated cost is $3500.00. It was advised that the money is budgeted. It was agreed that bids could be called for but want to study availability of money before award made. Following discussion Mr . Goodling moved approval of the specifica- tions for the chlorinator and the electrical equipment for pumping control, specifications to be issued and bids taken July 24th to be funded from Account #1411, seconded by Mr. Holloway and carried. Mr. Bennett reported that he talked to Mr. Robert Kilgo of Texaco, Incorporated, who advised they are ready to hook up as soon as sewer and water lines are brought across to their property. Mr. Thompson requested they pass to next meeting report on Motel water and sewer. Mr. Bennett requested approval to call for bids for pipe to put in drainage on East Coast Drive from 12th Street to City limits. The pipe will be 15 " to 13th Street, then 12 ", and is in the budget. Following discussion Mr. Goodling moved approval of call for bids to be received subject to plans and specifications being prepared in time to advertise for bids to be received either July 24th or August 14th. , seconded by Mr. Holloway and carried. An Ordinance amending 1967 Budget Ordinance #20-66-12 providing funds in Public Safety Department was presented in full in writing Minutes 7/10/67 Page #3 for first reading by title only. The Public Safety Accounts for uniforms, jail meals and supplies, and building maintenance are low. Mr. Goodling moved that the rules be waived and the Ordinance passed on first reading by title only. Following discussion the Mayor put the question and the vote was: Aye: Goodling, Holloway, Howell Nay: Weldon Absent: Parks Whereupon the Mayor declared the motion carried and the Public Hearing set for July 24th. Mr. Weldon stated he protested the irregular unusual action of acting without giving Commissioners opportunity to really consider properly, and if we are as short as indicated here it was improper not to bring it to the attention of the Commission before this time. The Mayor directed that the minutes so reflect. An Ordinance calling for a special referendum election for approval or disapproval of the amendment to House Bill 3029 was presented in full in writing, copies of said Ordinance having been sent to Commissioners last week. The amendment presents the question as to whether the City of Atlantic Beach will become the third Urban Service District and retain its officials, boards and laws in the consolidatd City of Jacksonville if House Bill 3029 is approved. Mr. Holloway moved passage of said Ordinance on first reading by title only, seconded by Mr. Goodling. Mr. Weldon questioned if necessary to approve. Mr. Thompson advised we have a bill which puts a direct obligation on the City to hold this special referendum - does provide that will hold in accordance with City Charter and Ordinances. Mr. Weldon questioned if we have no legal alternative but to hold it. Mr. Thompson stated that if we refuse to do so any citizen could bring proceed- ings and make you do it. Mr. Howell advised for information of general public would briefly explain what we are doing - as you know on August 8th there will be a county-wide vote on consolida- tion - there is also another vote that will be held at the Beaches and Baldwin to determine whether or not they wish to retain their municipalities - the Act setting up this special election and amendment to overall Charter provides that the Beaches cities shall provide for holding of said election - when you go into voting precincts on election day you will actually be voting in two separate elections - one machine will have two questions - overall consolidation - budget commission - leave that machine and registered voters in Atlantic Beach will vote as to whether or not wish to retain municipality - very important that under- stand question - if you wish to retain, must vote yes, if wish to abolish will vote no. Minutes 7/10/67 Page #4 There was further discussion during which question of closing of liquor places that day was asked and Mr. Thompson will check into and advise. Mayor Howell then put the question and the vote was: Aye: Holloway, Goodling, Howell Nay: Weldon Absent: Parks Whereupon the Mayor declared the motion carried and the Public Hearing was set for Saturday morning, July 15th at 8:00 A. M. Mrs. Grage presented names of following for approval as election officials: Mrs. Zoe ' Moore, Clerk, Mesdames Cynthia Whittlesey, Ivy Higginson, Shirley Gable and Margaret Armbruster as Inspectors. Mr. Goodling moved approval, seconded by Mr. Holloway and carried. Chief Vogel presented docket for July 3, 1967 and report of Police Department for June, 1967, for information and filing. The Chief advised is having complaints about dogs on the Beach. He requested a fully equipped year round dog catcher for the City as it is impossible for the police to work traffic and dogs. Mr. Holloway moved appoint a Committee to study the situation and report to Commission what procedures should take to enforce Ordinance, if need to hire another employee or appoint an existing one to act in such a manner, seconded by Mr. Goodling. Mr. Goodling stated he is opposed to motion as thinks similar motion is in minutes several months ago and served no useful purpose then, don't think will serve purpose now. There was discussion in which Mr. Holloway advised if going to have Ordinance on books that we should also provide some manner of enforcing - was only a suggestion to provide Committee to report. After further discussion Mr. Howell put the question and the vote was: Aye: Holloway Nay: Goodling, Weldon, Howell Absent: Parks Whereupon the Mayor declared the motion defeated. Mr. Holloway would like a report at next meeting as to how Ordinance is being enforced and why not enforced. Mr. Goodling requested that the Chair direct that a 6 months ' financial report be prepared for period from January 1st through June 30th - especially since have approved specifications involving some $5500.00 - and City Treasurer has advised need Minutes 7/10/67 Page #5 to be cautious due to cash position until tax receipt time. Report to include recommendations for anticipated appropriations for balance of year. Mr. Howell asked Mr. Goodling to head Committee and Mr. Goodling asked the City Manager and City Clerk to work with him. Mr. Goodling recalled he questioned motion regarding recent applica- tion for water in North Atlantic Beach as to whether or not specific enough so that administration knows what doing. Think everyone agreed that there was some question. Think should be discussed and some more positive instructions given rather than those on books right now. There was discussion in which Mr. Howell questioned - don't you feel that was intent that they be allowed to hook up but if hooking up of three additional cut ins results in decrease of water pressure of other people who are presently cut in (assuming decrease was warranted sufficient) that then the City would go in and disconnect then and that they fully understand. this? Mr. Goodling stated agrees with this interpretation but feels motion is vague and should be more Specific. Mr. Thompson suggested a clarifying motion. Mr. Goodling moved the motion be clarified, seconded by Mr. Holloway. Mr. Holloway does not feel motion needs clarifying and that interpretation is up to City government. Mr. Goodling offered a substitute motion that the previous action be rescinded, seconded by Mr. Holloway. In discussion it was brought out that no action has been taken to notify or connect the property owners. Mr. Howell put the question on the motion and the vote was: Aye: Goodling Nay: Holloway, Weldon, Howell Absent: Parks Whereupon the Mayor declared the motion defeated. Mr. Goodling stated that there are applicants to City Manager and thinks should interview applicants and he therefore moved that we establish interviews with any and all applicants as soon as possible, seconded by Mr. Weldon, and carried. Mr. Goodling inquired if there were any complaints of red worms in water and Mr. Bennett advised not for some time. Mr. Weldon stated since we did not rescind motion would like to strongly recommend we notify these people in writing concerning the conditions prior to such connections. Mir. Weldon brought attention to large number of potholes - weeds at street ends and palm fronds, part of this being caused by monsoon rains and wind. Ateekaa Bcach-T&32da July 10, 1967 • CITY MANAGER'S REPORT In the last two weeks the Public Works department has been cutting grass on road shoulders and in the City Parks , also used the edger along curbing at Selva Marina Drive. We have started the lot cleaning program throughout the City. The rest rooms at Donner Park have been completed . We have had 4 light poles installed at Donner Park so that flood lights can be put on the poles. We have the steps at the Beach Street ends repaired and painted. We have used black top to patch the potholes in the streets. We have been fortunate in finding about 300 ' of 6" C.I. water pipe which was installed in the wrong location during the installation of water mains in 1955. We can use this pipe for the interconnection with Neptune Beach at Sherry Drive. We have not received our permits from State Road Department for inter- connecting water mains with Neptune Beach at Seminole Road and Sherry Drive. We have received a letter from Humble Oil and Refining Company giving the City permission to uncover our 11" Water meter located on their property. This meter was covered up during paving in 1965. The Watermelon parties given by me last Friday at the Jack Russell and Donner Parks was a little shy of the number of children expected. We had about 75 children at Jack Russell Park and about 40 children at Donner Park. Possibly the rain kept the attendance down, but the children there enjoyed themselves. //4g2,,,4 Murray .
