Commissioners 12. Adjourn MINUTES OF THE REGULAR MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, APRIL 24, 1967, AT 8:00 P. M. Present: William S. Howell, Mayor-Commissioner John W. Weldon Donald L. Goodling (Late) Louis C. Holloway, Jr. Walter J. Parks, Jr. , Commissioners and Frank Thompson, City Attorney Murray H. Bennett, City Manager Adele S. Grage, City Clerk The meeting was called to order by the Mayor-Commissioner, Mr. Howell. The Invocation was given by Commissioner Parks. The minutes of the meeting of April 10, 1967 were approved as written upon motion of Mr. Holloway, seconded by Mr. Parks and carried. Mayor Howell recognized visitors present and called for any business from the floor not on the Agenda. Mr. Chas. R. Moore requested a clarification of the traffic ordinance as regards parking on Beach Avenue. He advised he has been excluded from parking on the West side of Beach Avenue abutting his property and also on the East side of Beach Avenue across from his property. He stated he had never made a practice of parking on Beach Avenue but when it is necessary he would like to be able to park without threat of police action. Mr. Bennett advised he had written Mr. Moore regarding a trailer that he had parked across from his place on Beach Avenue, and Mr. Moore has removed it. There was a lengthy discussion of speeding, parking, concrete blocks and posts on and off of street right-of-way on Beach Avenue. It was brought out that the signs and blocks were put at the location on complaint of Mr . John Reid, in order to provide clearance for him to get in and out of his garage. Mr. Weldon stated he felt all citizens should be treated alike and suggested the City Manager no later than tomorrow investigate and see if signs should be removed, or whether street should be further widened throughout block so that there is no discriminatory treatment of any citizen. There was further discussion and Mr. Parks stated he did not think the action of the Director of Public Safety, who was "Judge" Arthur Craig at the time, was variance from Ordinance as believes Ordinance gives Director of Public Safety the authority Minutes 4/24/67 Page #2 in his judgment to put "No Parking" signs in any area at any time. Mr . Thompson concurred. Mr. Bennett advised he would remove the signs and clear the road in this section of Beach Avenue. Mr. Henry Isaacs called to the attention of the Commission that in the April 10th, 1967 minutes, page 4, line 5, "Mr. Otto Ball" spoke at length and it should be corrected to "Mr. Oliver Ball". The Minutes will be so corrected. Mr. A. J. Longo inquired as to what has been done further as regards the traffic situation at 15th Street, Seminole Road and East Coast Drive. The situation is getting worse. He suggested money be added to General Fund for a new police car and hire another patrolman. There was discussion following which Mr. Goodling moved the City Manager and Chief of Police take matter under consideration, investigate and report back at the next meeting on feasibility as well as cost for adding additional police patrol to cope with apparent traffic, seconded by Mr. Holloway. Chief Vogel spoke at length on work of his Department and their handling 1967 traffic on 1910 roads. At peak traffic time it is sometimes necessary to have all 5 men on duty. Mr. Longo, Mr. Henry Isaacs and Mr. Robert Cook spoke urging something be done - they think police do good job but need assistance. Mr. Howell suggested contact Auxiliary Police for help on weekends. Mr. Howell put the question and the motion carried. Mr. Clarence Johnston, Mr. George Bull and Mr. Henry Isaacs all spoke in favor of some immediate action being taken to correct the traffic situation. Bids were received for resurfacing streets. Copy of certified proof of publication of "Call for Bids" is attached to these minutes and made a part thereof. Bids were received from: Asphalt Contracting Corporation Houdaille-Duval-Wright Company Jaxon Construction Company Mr . Parks stated the Commission has just taken an action which thinks is necessary in regard to public safety within confines of Municipality, he therefore moved that any action on bids as received be postponed until the result of the report and recommendation previously called for is received and acted upon. Mr. Howell suggested bring report back and consider both at same time and see which way to go. Mr. Goodling stated • Minutes 4/24/67 Page #3 Committee on new police will either have to come up with addi- tional revenue to offset additional expense or give up some of expenditures. There was no second to motion so Mr. Parks then moved that the bids be referred to Committee for report at next meeting, seconded by Mr. Goodling and carried. Mr. Bennett, Mr. Hilliard and Commissioner Holloway were appointed as Committee. City Manager Bennett read his report, copy of which is attached hereto and made a part hereof. Mr. Goodling noted concurred with Recreation Committee recommendation - and doesn 't believe any official action needed. Mr. Parks advised hasn 't had time to prepare specifications on chlorinator. Mr. Howell stated will pass over to next meeting. The matter pertaining to Mr. George Bull 's application for septic tank in area to be known as Selva Marina Unit #6 was deferred until later in meeting. The Pet Ordinance #95-67-10 was presented for second and final reading and read in full by Mayor Howell. Notice of Public Hearing on said Ordinance was posted in line with Charter requirements. Mayor Howell then declared the meeting in session for Public Hearing. Mr. Henry Isaacs, Mr. Colin Tucker, Mr. George Bull and Mrs. Dorothy Kerber spoke against the Ordinance - as unenforceable, should have leash require- ment, putting more burden on Police Department when have just finished discussing their overload, etc. Mayor Howell then declared the Public Hearing closed. Mayor Howell questioned where dogs will be kept. Chief Vogel advised in a pen which we now have but will have to build separate one for cats, and recommended that we continue the services of the Jacksonville Humane Society - but we need dart gun for capture. Mr. Holloway moved that Ordinance #95-67-10 be passed on second and final reading, seconded by Mr. Weldon. Mr. Goodling advised he thought the Commission had set a precedent and he doesn 't find where there has been a written report of Committee with recommendations. He feels certain people will be con- cerned about protection of these animals, and is obligation to listen to both sides. It was brought out that Notice of Public Hearing was posted, also news media carried. There was further discussion of cost involved, holding pens, tranquilizer guns, and fact that we are concerned with the wild and roving dogs. Mr. Howell expressed concern over how going to enforce. Following discussion Mayor Howell put the question and the vote was: Aye: Holloway, Parks, Weldon Nay: Goodling, Howell • Minutes 4/24/67 Page #4 Mr. Howell declared the motion carried and Ordinance #95-67-10 passed on second and final reading. Mr. Goodling inquired if we will have a report from the Committee as to who is to enforce, recommendations on dart gun, terms of contract, financing, and if Humane Society gets who is to notify owners. Mr. Howell assumes that this will be brought back by Committee who drew up proposed Ordinance. He directed that the minutes so reflect. Mr. George Bull advised that in compliance with the Committee 's report of March 24, 1967 on his septic tank application, he had written transmitting document evidence and suggestions and would like an answer. There was a lengthy discussion as to not developing at random, platting of area, easements, etc. Mr. Howell suggested the matter be referred back to original Committee to work out a flat use proposal and recommendations. Mr. Weldon so moved, seconded by Mr. Holloway and the vote was: Aye: Holloway, Weldon, Goodling, Howell Nay: Parks Whereupon the Mayor declared the motion carried. Copies of Police Court dockets for April 17th and 24th together with monthly reports of Fire Department and Police Department for month of March 1967 were received for informa- tion and filing. Chief Vogel advised there were a number of broken concrete blocks on public property that constitute traffic hazard - just wanted to bring to attention of the Commission. Mr. Bennett stated he had written Mr. Collee relative to getting some of broken up pavement from Atlantic Boulevard and was advised to contact Reynolds, Smith and Hills. He also stated that construction will start on Atlantic Boulevard improvements on May 1st and a meeting has been called for 2:00 P. M. , April 27, to coordinate utilities work. Neptune Beach is meeting tonight and Mr. Bob Gordon, Neptune Beach Councilman, hopes to get some authority for action. Mr. Bennett plans to attend the Expressway meeting on Thursday. Mrs. Grage advised that corrected copy of the minutes of the conference held on March 16th, 1967 has been received from the Jacksonville Expressway Authority. Minutes 4/24/67 Page #5 Mr. Bennett advised he had received answers to his letters from Congressman Bennett and Senator Holland. Mr. Weldon suggested copies of the letters be sent to each Commissioner. Mrs. Grage will send copies as suggested. Mr. Bennett reported that we have been checking out licenses and have received a lot of repercussion as to vending machines. Also, the Peaches Aquatic Pool, Inc. and Selva Marina Club have not paid license but two other Clubs in the City have. He would like to know just what is a "Private Club" and "Country Club". There was discussion and Mr. Weldon moved that the City Manager get with the City Attorney and get interpreta- tion and enforce Ordinance in accordance with interpretation fixed by Attorney, seconded by Mr. Parks. Mr. Goodling suggested if they find Ordinance should be modified to suit present conditions to report back to Commission. Mr. Weldon agreed. The Mayor then put the question and the motion carried. Mr. Bennett reported he has application and approved drawings for the new Sea Turtle Restaurant and asked for approval of same. He advised it complies with building code, also hotel and restaurant requirements, and he recommends approval. Mr. Weldon stated he feels this is wholly desirable and welcome and he therefore moves that the City Manager be authorized, if there is compliance with all applicable Ordinances, to issue approved building permit for construction, seconded by Mr. Parks and carried. Mr. Bennett advised he has written the Ribault Garden Club in regard to selling the public on idea of using the refuse bags, sample of which is attached to back wall. Grage, City Clef April 24, 1967 CITY MANAGERS REPORT 1. The Public Works Department has placed blacktop at the 7th Street and 15th Street Ramps. 2. We have installed a concrete sidewalk for Mr. Jackson on the 6th Street side of East Coast Drive and 6th Street. We are furnishing labor only for this installation. 3.Much of the time has been used in getting the Jack Russell Park in shape for the start of the Little League baseball games which began on the 22nd. We have cleared Park Street East of the Donner playground, and since this is not a through Street we are going to set up the Donner playground in this area so that there will be no danger of the children getting hit by baseballs. 4. Members of the Commission met with members of the Recreation Committee and decided to build a new concrete concession stand and a slab for the indoor play room at the Jack Russell Park at a cost of $750.00. The concrete block are going to be furnished by the Little League and our Public Works Department will install the block and do the necessary carpenter work. The concrete slab is already poured. When this building is up we will move the present wooden concession stand and put the bleachers in back of home plate. 5. we have installed a sprinkler at the Jack Russell Park so that the baseball diamond and infield can be watered. 6. We have been cutting the grass along the highways, and with the new mower we can keep the Parks and the roadways mowed quite often. //4-41/i'd Murray H. Bennett City Manager
