MINUTES OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE
CITY HALL ON MONDAY, MARCH 27, 1967 AT 8:00 P. M.

The meeting was called to order by the Mayor-Commissioner, Mr.
Howell.
The Invocation was given by Commissioner Parks.
Minutes of the meeting of March 13, 1967 were approved as written
upon motion of Commissioner Holloway, seconded by Commissioner
Goodling and carried.
Mr. Howell recognized visitors present and called for any business
from the floor not on the Agenda.
Mr. Glover Weiss asked for clarification as to whether he can park
a house-car in his yard. He plans on doing quite a bit of travel-
ing and would like to park the house-car on his property between
trips - it will not be lived in while parked there. Mr. Howell
stated he thinks what concerns Mr. Weiss is the provision that
you cannot park and live in a trailer in the City other than in
a trailer park, and it might be construed that could not park any
kind of trailer. Mr. Goodling asked the City Attorney 's opinion.
Mr. Thompson advised he had looked at Ordinance but couldn't
find that simply parking would be in violation. Mr. Weldon would
like minutes to show we consider this not in violation of
Ordinance as it is a passenger type vehicle and will not be
utilized for living purposes while on premises. Mr. Weldon then
moved that approve proposed parking as requested by Mr. Weiss
for the intervals between trips with the distinct understanding
that will not be used for living purposes and is not in violation,
seconded by Mr. Goodling who again asked the City Attorney if
violates any condition. Mayor Howell then put the question and the
motion carried.

Mr. Goodling suggested in view of the fact that the majority
of the visitors present were here in regard to 'surfing
ordinance, it might be good to consider it next. Mr. Howell
agreed and presented the Surfing Ordinance for second and final
reading and read same in full. He then declared the meeting in
session for Public Hearing on said ordinance. Notice of Public
Hearing was posted in line with Charter requirements. Mr. Thomas
Galt, Mr. George Bull, Mrs. Frank Harvey, Mr. Henry Isaacs, and
some of surfers spoke against the Ordinance. They believe
Beach and Ocean are safer because of surfers - who have been of
great assistance to life guards. Following these comments for
the surfers and being no further comments for or against the
Ordinance, the Mayor declared the Public Hearing closed. Mr.
Goodling stated that we don't want to penalize our Atlantic
Beach surfers, but on the other side there are residents with
small children who play in shallow water and could be hit or
harmed - would like to see some equitable method of control.
Mr. Weldon noted no one appeared in defense of Ordinance -
realizes responsibility is to enact laws to safeguard Community,
but is inclined to watch situation and see how develops. Mr.
Howell agreed and feels as long as boys police themselves,
Ordinance won't be necessary. Representatives of two surfer
clubs were present - the Utica and Surfside. Their cooperation
was asked in keeping surfing orderly and safe, and reporting
any trouble immediately to life guards or police. Following
further discussion, Mr. Weldon moved the Ordinance be tabled,
seconded by Mr. Holloway and carried. Jim McClure, president
of Surfside Club and Dickie Rosborough, representative of Utica
Club, were recognized and thanked for their interest and
attendance. Mr. Weldon stated that wants surfers to have good
time - but he will be first to vote for controlling legislation
if situation gets out of hand - just if need action to protect
people.
A letter was presented from the State Beverage Department
advising we have received overpayment of $477.28 in Cigarette
Tax which will be deducted from next payment. Letter was
received for information and filing.
A note was read from Mrs. Norman Minchew thanking the Commission
for the Resolution on Mr. Minchew.
A letter was read advising of meeting of Jacksonville Expressway
Authority on Tuesday, March 28th, at 10: 00 A. M. Mr. Parks is
our representative at these meetings.

A letter was read from Mrs. W. A. Rallace commending Police
Officer Shirley Causey for his assistance in an emergency.
Mr. Goodling moved the letter be filed in personnel record
file, seconded by Mr. Weldon and carried.
A letter was presented from the Atlantic National Bank advising
that monies in the Water Savings Accounts could no longer be
handled in this manner and suggesting putting in Time Certificates
of Deposit. As Bond Ordinance specifies Water funds have to be
deposited in this bank, there is no choice. Following discussion
Mr. Goodling moved that the funds in the Savings Accounts at
the Atlantic National Bank be placed in Time Certificates of
Deposit, subject to concurrence by the City Attorney, at the
maximum interest rate, seconded by Mr. Weldon and carried. The
City Attorney and City Treasurer were directed to handle.
Mr. Bennett read his report, copy of which is attached hereto and
made a part hereof. He also advised we are roping off Beach on
Saturdays and Sundays, is checking on possible bypass at Mayport
Road and the Plaza; have received enough aerial easements on
East Coast Drive so that light poles can be installed back of
sidewalk. He also asked instructions for bidding on street re-
surfacing. Mr. Weldon suggested that proposal for streets to
be repaved and projects to be undertaken be submitted in regular
form at next meeting and request renewed at that time.
Mr. Parks presented report on bids on 6 " water line material
for W. 6th Street and recommended defer action until next
meeting. Copy of report is attached hereto and made a part
hereof. They don't expect any increase in original prices as
this is just a temporary deferral. There was no objection and
matter will be considered at 10th meeting.

Mr. Weldon reported for Committee on bids for Tractor-Mower
and recommended that the bid be awarded to low bidder, Quinn R.
Barton Company in the amount of $1.852.52. Copy of report is
attached hereto and made a part hereof. Mr. Goodling moved report
be accepted and recommendation adopted, seconded by Mr. Holloway.
The bid is within budgeted funds to be paid in one payment from
1967 budget. There being no further discussion, the Mayor put
the question and the motion carried.
Mr . Parks presented Committee report on Mr. George Bull 's applica-
tion for septic tank. Copy of report is attached hereto and
made a part hereof. Mr. Parks commented briefly on the report.
Mr. George Bull advised in this case has lost sale - but would
like to know in case of another sale what to operate under.

are in full accordance with proposed plat. There was much
discussion and it was brought out that this area is not
platted or zoned. Following further discussion, Mr. Parks
moved that Mr. Bull be r.quested to submit a proposal con-
cerning the easements that he proposes to submit to the City
of Atlantic Beach concerning public access to any residentail
sites sold by metes and bounds in unplatted areas, seconded by
Mr. Weldon. Mr. Bull asked "submit when? and Mr. Parks
stated before final action on this or any subsequent action.
Mr. Howell then put the question and the vote was:
Aye: Goodling, Holloway, Parks, Weldon
Nay: Howell
Whereupon Mr. Howell declared the motion carried.
Mr. Parks reported at length on meeting he attended of Express-
way Authority at request of Commission. He took issue on the
following:
(1) Absence of traffic lights in scope of work for which
bids have been received. Mr. Sollee advised would
recommend traffic lights deemed adequate.
(2) Matter of pedestrians crossing beneath overpass. Mr.
Sollee advised would recommend protected sidewalks
beneath overpass.
(3) Raised objection to width of turnouts,
(4) Objected to fact that plans indicated a width on roadway
that would not permit parking and at the same time permit
two lanes of moving traffic.
(5) Raised objection to the matter of access to property
that abuts highway. Also brought up 6 way intersection
at Atlantic Boulevard, Mayport Road, Main Street, Florida
Boulevard and Mayport Boulevard, and problems of access,
etc.
Mayor John Futch of Neptune Beach and Captain Swope of Mayport
Naval Station were present and spoke too. No decisions were
made. He advised Mr. Sollee stated that he would recommend
provision for conduit only for convenience of future installa-.
tion of street lighting. As to recommendations for traffic
lights, conduit and sidewalks, will limit strictly to confines
of overpass and access ramp thereto. Mr. Parks is editing
transcript of meeting to give to Mr. Sollee 's secretary and will
request that we be favored for official records with true copy
of the minutes.

Mr. Bennett presented a report on the Beach Preservation Forum
held on March 21, 1967 . Copy of report is attached hereto and
made a part hereof. There was a lengthy discussion in which it
was brought out that there was no one from County Commission
at the meeting. Mr. Weiss was asked to tell of his studies on
this subject and he suggested Congressman Charles E. Bennett
should be starting point and let him put pressure on County
Commission. Mr. George Bull spoke on the subject - agreeing
with idea, but feels ill-timed. Mr. Holloway feels should get
moving on something and therefore moved that a Resolution be
prepared and sent with comments to Congressman Bennett and any
other sources that will help in solving erosion problem,
seconded by Mr. Weldon, and after further discussion the Mayor
put the question and the motion carried. City Manager Bennett and
Mr. Weiss were requested to prepare suitable resolution.
Mr. Bennett presented report on meeting with George Patrinely,
Harold Mills and Chief Vogel relative to life guards for 1967 .
Copy of report is attached hereto and made a part hereof.
An Ordinance was presented for first reading by Title only
amending Section 2 of Traffic Ordinance #75-58-1. This Ordinance
was presented in full in writing. Mr. Parks moved passage on first
reading by title only, seconded by Mr. Holloway. There was ques.
tion of listing Mayport Road since speed limit on it is set by
State. Opinion was requested of Mr. Thompson who advised not
to strike but show to conform to State requirements as set from
time to time. It was agreed that Mayport Road speed be shown
"as established from time to time by Florida State Road Depart-
ment". Following further discussion the Mayor put the question
and the motion carried. tr 10, 1967 was set as date for

An Ordinance amending Utility Tax Ordinance #70-58-1 as regards
tax rate was presented on second and final reading. Notice of
Public Hearing was posted in line with Charter requirements.
Mr. Howell read the Ordinance in full and declared the meeting
in session for Public Hearing. The matter of tax rate was
discussed, following which Public Hearing was closed. Mrs.
Grage advised this revenue is pledged to water bonds, approxi-
mately $34, 000.00 was collected in 1966, and it appears it will
take 8% to produce equivalent amount. Mr. Weldon moved that
figure ofc )nserted in Ordinance and Public Hearing be
continued to 10th, seconded by Mr. Goodling. There was
further discussion as to rate following which Mr. Weldon with-
drew his motion and Mr. Goodling his second. Mr. Weldon then
moved that after due calculation by City Clerk that percentage
figure be inserted in proposed Ordinance which will produce
amount not less than amount produced in past and that Public
Hearing on said Ordinance be continued to May 10th, seconded
by Mr. Parks and carried.

Mr. Hilliard requested approval of purchase of dairy spray,
muriatic acid, and a fan in the amount of approximately $35.00
from Reservoir Account #1.502. Mr. Holloway moved approval,
seconded by Mr. Weldon who inquired if money available and
Mrs. Grage advised it was. The Mayor put the question and
the motion carried.
Mrs. Grage advised bid for garbage truck chassis was approved
subject to City Attorney 's approval, but did specify who would
sign contract papers for City. Mr. Weldon moved City Manager
sign, seconded by Mr. Holloway. Mr. Thompson advised contract
meets his approval with changes he made which were accepted by
First National Beach Bank. Mr. Howell put the question and the
motion carried.
The Police Chief presented Municipal Court Dockets for March
20th and 27th, 1967, which were received for information and
filing.
Mr. Bennett presented a letter from Yucca Garden Circle express
ing appreciation for City's support in making beautification
improvement.
Mr. Bennett presented request for temporary septic tank permit
for Ira Bratcher on Lot 4, Block 66, Section H, located at
72 W. 10th Street. There was discussion during which it was
determined that closest sewer line is on East side of Mayport
Road some 650 feet away or on W. 8th Street which is more than
2 blocks away. Mr. Parks moved that Commission consent to grant-
ing of such temporary septic tank permit to be valid until such
time -as sanitary sewer is provided, subject to transferable
covenant running with land from property owner to connect to
sewer when provided, seconded by Mr. Goodling. The Vote was:
Aye: Goodling, Holloway, Parks, Weldon
Nay: Howell
Whereupon Mayor Howell declared the motion carried.
Mr. Bennett presented request from Colonel Salzman for water to
property he has bought on Beach Avenue in North Atlantic Beach.
Mr. Holloway advised he understood we were at maximum capacity
on this line. It was agreed that investigation be made and
report made at next meeting.
Mr. Holloway inquired as to report on dog situation. Mr. Bennett
advised Ordinance is being prepared for presentation at next
meeting.

Mr. Weldon inquired as to docket showing man charged with
leaving scene of accident and no driver ' s license yet entire
fine was suspended. Chief advised evidently producted driver 's
license.
Mr. Weldon requested City Manager be looking for Recreation
employees. Mr. Bennett has one application and is sending out
another one. He is having meeting with Parks and Recreation
Committee on Wednesday night. There was a discussion of tennis
courts and basketball court and the provisions in 1967 budget.
Mr. Bennett will report on this at next meeting.
Mr. Howell presented a request from Mrs. Mary I. Palmer, 136
Beach Avenue, that City raise sidewalk at her driveway on
Ocean Boulevard as there is a problem as to relation of her
driveway and City sidewalk. Mr. Goodling moved City Manager,
City Attorney and Mr. Hilliard look into situation and see
what can be done without causing a situation where going to
lay City open for law suit, seconded by Mr. Weldon and carried.
There being no further business the Mayor declared the meeting
adjourned.

REPORT ON MEETING FOR LIFE GUARDS FOR THE
SUMMER OF 1967
The meeting regarding life guards was held last evening, March 20,
with George Patrinely, Captain of the American Red Cross Life Guards,
Harold Mills, a Lieutenant, Chief Robert Vogel and myself being
present. We discussed the problems of the life guard situation and
have agreed to the following recommendations:
1. Chief Vogel will be in charge of the life guards and he will
communicate with our Captain of the life guards on all problems
pertaining to this work.
2. All life guards will check in at the Police Station no later than
8:30 A. M. each morning Monday through Saturday so that they can
be on duty by 9:00 A. H, and the check out time will be after
6:00 P. M. each day. If any of the guards are later than 10
minutes we shall deduct 1/2 hour from their time.
3. The Beach Buggy will be located at the Police Station and must be
hosed down by the life guards at the end of the day's work.
4. The life guard towers will be located at the 14th Street , the
pier at the Atlantic Beach Hotel and at the 4th Street stomp. The
towers at 14th and 4th Streets are to be located at the water 's
edge, and during high tide are to be placed upon the seawall.
The tower at the Atlantic Beach Hotel pier will be securely
fastened to the pier, but each night the towers at 14th and 4th
Streets are to be chained and locked to the posts at the top of
the seawall.
5. Ve are to place signs at each Street end advising the swimmers that
life guards are located at 14th Street, 4th Street and at the
Atlantic Beach Hotel pier. I will cover details of these signs
with Dick Hilliard.
6. Ve are to furnish the Beach Buggy, and after much discussion we
agreed that since Police Chief Vogel is in charge of the life
guards a radio is to be installed in the Beach Buggy so that the
life guards can have instant police protection.

The Committee appointed by the Mayor at the regular
Commission meeting, March 13, 1967, has studied the
bids received for the Tractor Mower - each Company
1111 bidding on the same tractor, and recommend that it
be awarded to Quinn R. Barton Company as the low
bidder in the amount of $1, 852.50.

REPORT ON MR. GEORGE BULLS APPLICATION FOR SEPTIC TANK
Honorable Mayor and Members of City Commission:
The undersigned were appointed as a Committee at the regular meeting
of the Commission on March 13, 1967 to investigate and to report
back to the Commission our findings and recommendations concerning a
letter from Hr. George Bull to Mr. Richard H. Hilliard, Acting City
Manager, dated March 7 , 1967, requesting approval for the installa-
tion of a septic tank to serve a proposed residence in an unplatted
area north of Selva Marina Subdivision - Unit 2, and generally
north of the present dedicated northerly terminus of Park Terrace
East. A photo copy of a map segment showing two approximate loca-
tions for the proposed residence and septic tank accompanied the
letter.
1111 After considering and reviewing this matter, the Committee feels that
the matter of the septic tank application is of secondary importance
to other considerations involved in constructing the proposed resi-
dence at either of the locations described. However, subject to
a satisfactory percolation test and the issuance of a "temporary"
septic tank permit by the Duval County Health Department, this
Committee would offer no objections to the installation of a septic
tank and conventional drain field as proposed providing that accept-
able covenants are made with the City (said covenants being transfer-
able and binding upon the future owner of the property) that the use
of the septic tank and drain field will be abandoned and the residence
properly connected to an approved sanitary sewer when provided.
The matter of public access to this proposed residential site, and
the circumstances surrounding the provision of that access, is con-
sidered by this Committee to be of primary importance in this
instance. The Committee has no knowledge of the City Commission of
Atlantic Beach being petitioned to accept title to any property to
provide public access to the proposed residential site. Without such
public access, the Committee questions the rendering of normal
municipal services to this proposed residential site.

REPORT ON BEACH PRESERVATION FORUM
MARCH 21, 1967 AT 2:00 P. M.
This meeting was attended by the Mayor and City Manager.
The citizens of this area did not seem to be interested
in attending this meeting, after all the publicity, so
there was a very small crowd there.
They had a panel consisting of the Corps of Engineers,
Division of Beaches and Shores, Florida Board of
Conservation and the Florida Travel Council. Each man
411/ gave a report and we were advised that it is necessary
to continue adding sand to our Beaches or else we are
going to be back to the same trouble we had in 1963 .
They advised us that the revetment wall is only a
temporary protection barrier.
In order to get any work done on the Beaches it is
necessary for the County Commissioners to start the
ball rolling, and up to the present time they have
turned their heads the other way regarding this. As
they suggested, it goes from the County Commissioners
to the State, to the Federal Government, and until we
can get some action from the County Commissioners the
Beach erosion problem cannot be handled.

CITY MANAGER'S REPORT
1. The last two weeks the Public Works Department has been
cleaning drainage ditches and installing culverts on Sturdivant
Street and lowering the culverts on Levy Road.
2. A sprinkler system has been installed in the Park at the
corner of Ocean Blvd. and Seminole Road.
3. Considerable time has been spent on replenishing the clay
in the infields of the ball diamonds at the Jack Russell and
Donner Parks.
4111 4. Part of the crew has been cleaning the curbs and repairing
stop signs and painting the sign posts.
5. We have received the new truck chassis and are now in the
process of installing the 20 yard garbage body on this new
truck chassis.
6. The Water Department has been checking the pumps at the
lift stations and at the Sewer Plant and repacking these pumps
wherever it is needed.
7 . The water reservoir was shut down and cleaned Friday night,
March 17 .
8. We have been having a rash of grass fires and I have been
advised that they have been set by someone using a candle
which burns down and starts these fires.
9. On the evening of March 20, Chief Vogel and myself had a
meeting with George Patrinely and Harold Mills of the American
Red Cross Life Guards and we have this situation well in hand
as per my report of March 21.

REPORT ON MEETING OF EXPRESSWAY AUTHORITY ON
MARCH 16, 1967
I just called Mr. Sollee 's office and talked with his
secretary and she expects to get out a copy of the
transcript of the March 16 meeting in reference to the
overpass at Atlantic Boulevard and Mayport Road either
today or tomorrow, copy of which will be attached to
this report.
She also advised me that there is a regular meeting of
the Expressway Authority at 10:00 A. M. on Tuesday,
March 28. I will inform the Commissioners regarding
this meeting.
