Adjourn 1pr • MINUTES OF THE MEETING OF THE ATLANTIC BEACH CITY COMMISSION HELD AT THE CITY HALL ON MONDAY, JULY 8, 1968 AT 8:00 P. M. Present: William S. Howell, Mayor-Commissioner Louis C. Holloway, Jr. Arthur J. Longo, Commissioners and Richard H. Hilliard, Acting City Manager Oliver Ball, Acting City Attorney Adele S. Grage, City Clerk Absent: Robert R. Rosborough, Commissioner (Out of City) John W. Weldon, Commissioner (Out of City) R. C. Vogel, City Manager (Out of City) The meeting was called to order by the Mayor Commissioner, Mr. Howell. The Invocation was given by Commissioner Holloway. Upon motion of Mr. Longo, seconded by Mr. Holloway and carried the minutes of the meeting of June 24, 1968 were approved as written. Mr. Howell recognized visitors present and called for any busi- ness from the floor not on the Agenda. Mr. J. U. Moorhead stated he did not know who was responsible but he wanted to express appreciation for action taken on mosquito control. There was no further business from the floor. Mr. Howell presented and read in full Ordinance #35-68-3 approving borrowing $3, 200.00 from the First National Beach Bank, then declared the meeting in session for Public Hearing on said Ordinance. Notice of Public Hearing was posted as required by Charter. As no one appeared either for or against said Ordinance, Mayor Howell declared the Public Hearing closed. Whereupon Mr. Longo moved approval of Ordinance #35-68-3 on second and final reading, seconded by Mr. Holloway. It was brought out that this is being done to take advantage of cash discount the dealer offered. The question was put and the motion carried. Whereupon Mr. Howell declared Ordinance #35-68-3 passed on second and final reading. Mr. Howell read Resolution #68-8 approving refund to Beach Bonding Company of $450.00 bail bond on which they presented the person in 30 days. Mr. Holloway moved adoption of Resolution #68-8, seconded by Mr. Longo and carried. Copy of Resolution #68-8 is attached to these minutes and made a part thereof. Fire and Police Department reports for June, 1968 and dockets for June 24, July 1st and 8th, 1968 were received for informa- tion and filing. lir Minutes 7/8/68 Page #2 The Acting City Manager report was presented for information and filing. Mr. Hilliard, Acting City Manager, in the absence of Mr. Vogel who is on vacation, reported that the City Commission of the City of Jacksonville has approved the installation of 47 - 400 Watt Mercury Vapor lights on Atlantic Boulevard as covered by Mr. T. W. Bockwick 's letter of July 2, 1968, copy of which is attached hereto and made a part hereof. Mr. Holloway stated that the trash has not been picked up on Selva Marina Drive and he feels the City should pick up at City' s expense, if necessary, as it looks bad and something needs to be done. The Contractor was paid by the 3 property owners to do the work and haul away but he didn't go through with it. The matter was discussed at length and it was decided to write the property owners under the nuisance Ordinance and garbage Ordinance and if not taken care of then City will remove and bill them. Mr. Ball will get with Mr. Hilliard on letters of notification. There was a discussion of beautifying the median strips on Atlantic Boulevard and their upkeep. It was agreed we do not want to assume responsibility for upkeep but are willing to cooperate with others concerned. Mr. Howell knows Mr. Salem of State Road Department and will get in touch with him and the Garden Circles and see what can be worked out. Mr. Longo congratulated Chief Stucki on safe and quiet 4th of July in Atlantic Beach. There being no further business, Mayor Howell declared the meeting adjourned. Grage City Clerk RESOLUTION NO. 68-8 WHEREAS, on May 19, 1968 one Wilfred Laurier Donna was arrested by the Atlantic Beach Police Department upon various charges involving the operation of a motor vehicle on Tickets #2662, 2663 and 1638. The said Donna was released from custody that same day upon the "Beach Bonding Agency" depositing cash funds in the amount of $450.00, as and for a bail bond for Donna ' s court appearance the following day (May 20th, 1968) . WHEREAS, on May 20, 1968, Donna failed to appear in the Municipal Court of the City of Atlantic Beach, and the Court duly forfeited the cash bail bond of $450.00 and the money was delivered to the City Treasurer of Atlantic Beach. FURTHER, Donna ' s failure to appear before the Municipal Court on May 20, 1968 was caused by his confinement in the Municipal Jail of the City of Jacksonville, Florida from the early morning hours of May 20, 1968 until approximately June 20, 1968. Whereupon he was surrendered to the Police Department of Atlantic Beach. FURTHER, Donna was tried before the Atlantic Beach Municipal Court, found guilty and fined $175.00 on July 1, 1968. WHEREAS, this Commission takes cognizance of Chapter 903.28 Florida Statutes (1965) and Section 155, City of Atlantic Beach Charter, AND FURTHER, the passage of this Resolution is recommended by the Municipal Judge, City of Atlantic Beach. NOW THEREFORE BE IT RESOLVED BY THE CITY COMMISSION OF THE CITY OF ATLANTIC BEACH, FLORIDA AS FOLLOWS : That the City Treasurer, City of Atlantic Beach, pay over to the Beach Bonding Agency the sum of $450.00 as and for the remission of forfeiture of the cash bail bond deposited in behalf of Wilfred Laurier Donna, as aforesaid.
