Regular Meeting Minutes
July 23, 2008
A regular meeting of the City of Atlantic Beach Tree Conservation Board was
convened at 7:20 pm on Wednesday July 23, 2008 at the Adele Grage Cultural
Center, located at 716 Ocean Boulevard in Atlantic Beach. In attendance were
Board members Jim McCue, Brea Paul, Carole Varney, and Principal
Planner/Staff Liaison Erika Hall. Board members Stephanie Catania and
Maureen Shaughnessy were excused from the meeting. The position of Recording
Secretary was vacant.
1. CALL TO ORDER
■ Commencement of the meeting was delayed due to lack of quorum. Vice-Chair Jim
McCue called the meeting to order upon arrival at 7:20 pm.
2. RECOGNITION OF VISITORS
• There were no visitors in attendance.
3. APPROVAL OF MINUTES
Vice-Chair McCue called for a motion to approve the minutes from the July 9th regular
meeting.
MOTION: Carole Varney moved to adopt the minutes of the July 9th, 2008 regular
meeting, as written.
SECOND: Brea Paul seconded the motion.
DISCUSSION:There was no further discussion.
VOTE: Unanimous, 3-0

Ms. Hall explained that the board had deferred review of this application at the July 9th
meeting, pending submittal of a new or revised application consisting specifically of
required Exhibits D or G (scaled drawing prepared according to application
instructions, item 5.a, showing the location of existing and proposed structures, utilities,
easements, setbacks, interior and exterior zones, species, location and size of tree(s)
proposed for removal), as well as a letter of approval from the Oceanwalk HOA/ARC.
Ms. Hall said that she notified the property owners (Curt & Julie Cunkle, present) of
the (re)submittal requirements via mail, and that she had spoken with both the pool
contractor and a representative of the tree removal service via telephone on several
occasions, and had explained the minimum requirements for application submittal to
both. Ms. Hall noted that the requested materials submitted still did not meet the
specified minimum standards and that the contractor(s) had even asked her to pull
items from other (building) permit applications to complete the tree permit application.
She said she attempted several times to explain to the contractors that it was their
responsibility to submit a complete and accurate application for consideration by the
board, but found that the rationale was not sinking in. Thus, she forwarded the
submitted materials to the board and placed the application on the agenda for review.
Mr. McCue opened discussion to the board. Carole Varney expressed concern that the
applicant had not still had not submitted a complete application meeting the minimum
requirements. [A new application was not submitted. Additional items submitted and
added to the file were a property survey, a site plan of the proposed pool area only, and a
copy of an approval email from the Oceanwalk ARC]. Further, Ms. Varney noted the
applicant had not made any indication as to how they intended to meet the mitigation
requirements, nor had they shown other existing trees on the survey or site plan that
might be suitable for mitigation. Mr. McCue recommended that perhaps the
application should be returned to the Cunkles for revision and completion, and
consideration deferred until a complete application was resubmitted. After some
discussion though, the consensus of the board was to neither waste more staff time
coordinating with the various contractors or service providers nor to hold up the
Cunkles'pool installation.
MOTION: Brea Paul moved that the Tree Conservation Board approve application
TREE 08-00100029 for the removal of one (1) 42"Live Oak from the rear exterior zone
of the property located at 2337 Beachcomber Trail for the purpose of installation of a
pool and spa to an existing single family home. Mitigation shall be assessed at 21" of
hardwoods, or payment of the cash value equivalent [$11Z001inch] into the Tree Fund.
SECOND: Carol Varney seconded the motion.
DISCUSSION: Mr. McCue suggested, and the board agreed, that the application be
approved on the condition that the Cunkles confirm method of mitigation and provide
Ms. Hall with a satisfactory mitigation plan within 30 days of permit issuance. The
Cunkles agreed to this condition, and Ms. Hall said she would follow up with a letter
explaining the mitigation requirements and options.
