Upon the Stipulation of Dismissal with Prejudice
entered into between plaintiff, City of Atlantic Beach, and
defendant, City of Jacksonville, it is:
ORDERED AND ADJUDGED:
1 . The Stipulation of Dismissal with Prejudice and
attached Settlement Agreement entered into by the parties to
this action are accepted by the Court and the Settlement
Agreement is incorporated in this order by reference.

2. This Court shall retain jurisdiction for the
purpose of enforcing the provisions of the Settlement Agree-
ment.
3. This cause be and the same is hereby dismissed
with prejudice, each party to bear its own costs.

Dear Mayor Meserve:
This will acknowledge your letter of December 20th. I want to thank you and City Manager Jim Hanson for
coming in to meet with Police and Fire Pension Director,John Keane,Lex Hester,and me.
This is to confirm our informal understanding. Without conceding a legal obligation,you agreed to ask the
Pension Board and City Council to turn over the entire assets of the Firefighter's Pension Fund,as part of
the completion of the contractual transfer of fire services.
Also,without conceding a legal obligation under the Inter-Local,I agreed to seek a total of$225,000
towards the reconstruction of Sherry Drive in Atlantic Beach,pursuant to our agreement to repair Sherry
Drive. This transfer is,of course,subject to Jacksonville City Council approval but I have spoken to the
Council Auditor who has tentatively said that he will recommend approval.
These actions will fulfill the Atlantic Beach contractual commitment re:the fire services contract,and will
fulfill the City of Jacksonville's contractual commitment in the Inter-Local Agreement with Atlantic Beach
and Jacksonville concerning Sherry Drive.
