THE BEACHES TO FORMULATE AND 8 CONFIRM A DISTRIBUTION FORMULA FOR DIVIDING THE 9 PROCEEDS COLLECTED VIA THE 9-1-1 USER FEE TO BE 10 USED FOR SALARY RELIEF FOR A TERM TO END NO 11 LATER THAN SEPTEMBER 30, 2004 ; PROVIDING AN 12 EFFECTIVE DATE. • 13 14 BE IT RESOLVED by the Council of the City of Jacksonville: 15 Section 1 . The Mayor and Corporation Secretary are hereby 16 authorized to execute an Interlocal Agreement with the Beaches to 17 establish an appropriate distribution formula for dividing the 18 proceeds of the 9-1-1 User Fee for salary relief for a term to end no 19 later than September 30, 2004 . A copy of the Interlocal Agreement in 20 substantially the form and content to be executed is attached hereto 21 and by this reference made a part hereof. 22 Section 2 . Peek 30 1/12/00 G:\shared\LEGIS.CC\99Legis\Resols\1999-1181-A.wpd INTERLOCAL AGREEMENT WHEREAS, the parties hereto are the City of Jacksonville Beach,the City of Atlantic Beach, the City of Neptune Beach, hereinafter referred to as the "Cities" and the City of Jacksonville; and WHEREAS, the parties have entered into dialogue pursuant to creating a distribution formula for dividing the proceeds collected via the 9-1-1 User Fee to be used to pay a portion of the salaries and related expenses for 9-1-1 Call Takers for that portion of their time spent answering and handling 9-1-1 calls under the provisions of Section 365.171, Florida Statutes, . as authorized to be imposed by the governing body of Duval County; and WHEREAS, the Council of the City of Jacksonville acting as the governing body of Duval County, Florida has maintained the 9-1-1 User Fee at $.44 per month for the present fiscal year 1999-2000 and has authorized the fees collected to be used to fund an Interlocal Agreement wherein the Cities will receive their pro rata share to be used for lawful purpose; and WHEREAS, the parties hereto are entering into this Interlocal Agreement pursuant to and in compliance with the provisions of Section 365.171, Florida Statutes, NOW, THEREFORE, it is agreed: 1 . Each of the parties hereto shall receive a distribution proportion of the 9-1-1 User Fee calculated by taking the total call-takers actual salary expenditures from each party, adding 30% for benefits and training. The Sheriffs Office may also add other factors such as changes in the 9-1-1 call volume data percentage and inflationary increases to determine the amount of distribution. The maximum distribution proportion amount to be distributed as a result of this calculation for Fiscal Year 1999/2000 is as follows: Neptune Beach $ 66,865 Atlantic Beach 63,980 Jacksonville Beach 126,005 A. The distribution proportion (salary reimbursement) amount shall be remitted to the respective City Manager or Finance Director or his/her designee on a quarterly basis when the appropriate documentation has been submitted. B. In each succeeding fiscal year, the Sheriff's Office shall determine the maximum distribution proportion amount to be distributed to the three participating Cities by increasing the prior year's actual amount by the appropriate escalation factor or factors which shall not exceed more than 8% of the prior year's actual amount. The Sheriff's Office shall notify each of the Cities of the maximum distribution proportion amount in the first quarter of the new fiscal year. 2. The 9-1-1 User Fees collected and distributed as provided herein shall be utilized only for salaries and associated expenses, as provided for in Section 365.171, Florida Statutes. 3. Each party accepting funds hereby agrees to provide an audit or accounting of such funds and how they were expended in accordance with Section 11.45, Florida Statutes. 4. Each party hereto hereby acknowledges full payment and performance under all prior agreements on this subject and hereby waives any rights to assert any claim for failure of performance in prior years. 5. This Agreement shall be in effect from the date it is executed by the parties until September 30, 2004. -2- 6. This Agreement may be terminated by the City of Jacksonville or any of the individual participating Cities upon 90 days notice given by the party wishing to terminate its participation in this Agreement.
