Dear Mayor Delaney:
Thank you so much for your rapid response on our informal understanding. I understand
the legal issues and will leave it to your discretion on the details.
Concerning the Pension fund, I can report that the Atlantic Beach Pension Board has
ordered the liquidation of the Fire Pension Fund as the preparatory step to turning over
the entire fund to the Jacksonville Fire Pension Board. That will fulfill our part of the
agreement, and we will complete that transaction without delay.
One technical issue on the Sherry Drive reconstruction funding issue remains. We
assume that when resolution and funding is agreed on by the Council that the money will
be transferred directly to Atlantic Beach. We are not sure when the reconstruction of
Sherry Drive will occur, as it is linked with our storm water project, which is still in the
design phase. That may not even be in this budget year, but we feel it would be cleaner
to have the money in hand, marked for the purpose.

Dear Mayor Shaughnessey:
I understand that our Public Works Department and the City of Atlantic Beach have been
communicating with each other concerning the plan for Jacksonville to resurface Sherry Drive and that
there may be some disagreement as to exactly what is expected of Jacksonville for this project.
As you may know,I was directly involved in the settlement negotiations with Lyman Fletcher
regarding the Atlantic Beach lawsuit. Lyman and I had numerous discussions relating to the Sherry Drive
project. Our conversations centered primarily on how Jacksonville would resurface Sherry Drive,after
Atlantic Beach did the subsurface repairs it would need for infrastructure work. Lyman indicated he did
not believe it would cost much to place some asphalt on the road;specifically,I recall him saying that we
could"just send a truck or two out." I obtained cost estimates from our Public Works Department,and
these figures were specifically included in early drafts of our agreement. We agreed to delete them only
because we,weren't sure how soon Atlantic Beach would be ready with its subsurface work. I recall
discussing with Lyman that Jacksonville would agree to repair the usual potholes and utility depressions
before placing asphalt on the surface. Atlantic Beach essentially agreed to complete all infrastructure
improvements before Jacksonville was to resurface the road.
Our two communities have made great progress toward building a more positive relationship.
Certainly neither of us wants this issue to become an obstacle to continuing that progress. I trust this letter
eliminates any confusion regarding our responsibilities under the interlocal agreement. If you feel there's
any need to discuss this further,I am available to meet with you.

Dear Mr. Westbrook:
With reference to the Interlocal Agreement between the City of Atlantic Beach and the City of
Jacksonville, Jacksonville agreed to "provide for the repairing and resurfacing of Sherry Drive in
Atlantic Beach." In previous correspondence with Ed Hall, P.E., we agreed that the best time for the
City of Jacksonville to fulfill its agreement with Atlantic Beach for this repair and resurfacing would be
during the construction of our major stormwater project,which was originally scheduled to begin during
the third quarter of 1997. The stormwater project is currently being redesigned, and we hope to begin
construction during Fiscal Year 1999/2000.
We would like to verify that you will have funds budgeted for this project, and that you will place this
project on your work schedule for the coming fiscal year.
Please note that our engineer, England-Thims &Miller, Inc., and our geotechnical engineer,Ellis&
Associates, Inc., determined that the repair of Sherry Drive consists of the reconstruction of the
roadway from the subgrade up, including removal and replacement of root material encountered at
Sherry Drive and 7th Street. The 1997 engineer's opinion of probable cost for this work was $336,867,
which will need to be adjusted for cost increases since that time.
I have attached a copy of the reports from England-Thims &Miller, Inc. and Ellis& Associates, Inc., as
well as a copy of the Interlocal Agreement between Jacksonville and Atlantic Beach for your review.
Please respond in writing to confirm that this project will be funded and scheduled for Fiscal Year

Pursuant to your request, we have teamed with Ellis and Associates, the project Geotechnical Engineer, to review
the improvements necessary to repair Sherry Drive.- This review primarily involved a site visit by Mr. Greg
Edmonds, P.E., of Ellis and Associates, and core borings looking specifically at the asphalt and base components
of Sherry Drive. Based upon this information and the attached report, it appears the road should be either
reconstructed from subgrade up, including removal and replacement of the root material encountered at Sherry
Drive and 7th Street, orh the placement of a full depth asphalt section of at least three inches of asphalt pavement.
Since the roadway grade is very critical to drainage in this area, it appears the only acceptable alternative is to
reconstruct the existing roadway and not to simply install a surface coarse overlay.

Dear Mr. Kosoy:
As requested by England, Thims. & Miller in a recent meeting at their office, we've
completed our review of the condition of the subject roadway. We understand the
roadway, which has experienced various forms and degrees of distress, will be repaired.
You requested we review the condition of the roadway and provide our opinion of what
will be required to repair the roadway to a serviceable condition.
The section of Sherry Drive under consideration is from Atlantic Blvd. north to Plaza.
Our review included an initial site visit by me. In the site visit, I observed several forms
of distress including isolated small depressions of the roadway, depressions extending
across the roadway at numerous locations which appear to be associated with utility
crossings, and some areas exhibiting water-related distress in the form of "alligator"
cracking of the asphalt and settlement of the roadway.
As a result of the observations of the pavement condition, technicians from our office were
dispatched to the site and they performed pavement section cores at 9 locations along the
above section of Sherry Drive. The results of the pavement section cores indicate the
asphalt surface course generally varies in thickness from approximately 2-1/8 to 4 inches
with a thickness at one location of 6-1/4 inches. There was no significant base course
encountered below the asphalt surface course. At 4 of the locations we encountered
unconsolidated oyster shell below the asphalt varying in thickness from 2-1/2 to 5 inches

and at the remaining 5 locations we encountered what appears to be a very "lean",
unconsolidated, mixed-in-place sand/asphalt mix below the asphalt. Previous pavement
section cores performed in the roadway encountered basic the same results regarding
pavement type and no significant base; however, asphalt surface course thicknesses
generally varied from 1-1/2 to 6 inches with 7 inches at one location. Auger borings
performed in the roadway indicate the materials within the upper 4 feet below the
pavement section generally consist of fine sands. An exception to this general profile
occurs in the area of the intersection of Sherry Drive and 7'h Street where the auger boring
encountered a one foot layer of fine sands with roots within a depth range of 1.5 to 2.5
feet below the existing pavement surface.
Given that there is no base course below the roadway and given the varying thicknesses
of the asphalt surface course, it is our opinion there area two alternates for the repair of
the roadway.
1. The first alternate would be to rebuild the roadway which would include removing
the existing asphalt, oyster shell and soil materials below the roadway to achieve
the grade below the new limerock base course. The exposed subgrade would
require stabilization as well.
2. The second alternate would be to increase the thickness of the asphalt surface
course to create a full-depth asphalt pavement section since there is no base course.
Given the minimum thickness of asphalt surface course measured in our cores and
based on our experience, we estimate the additional asphalt thickness required for
the full-depth asphalt section would be at least 3 inches. With the anticipated
traffic data provided to us, we could determine the actual required additional
thickness of the full-depth asphalt overlay for the roadway.
We understand from our recent discussions the area cannot tolerate increasing the roadway
finished grades by more than approximately 2 inches. Therefore, it is our opinion that the
only available alternate to repair to roadway is to rebuild the roadway with a pavement
section of an asphalt surface course, a base course, and a stabilized subgrade. sAlso, the
sands containing roots,encountered in the area of Sherry Drive and 7'h Street should also
be removed and replaced with suitable backfill materials.

a) In addition, Atlantic Beach agrees to provide fire
suppression response service to the residents of Neptune Beach.
The City of Jacksonville shall be responsible for paying Atlantic
Beach $150, 000 for the Neptune Beach service beginning in Fiscal
Year 1995-96, in equal quarterly payments commencing October 1,
1995. Each year thereafter, the City of Jacksonville will pay 103%
of the previous year's amount for providing service to Neptune
Beach.
b) In further consideration for the payment of the
$150, 000. 00 as provided above, the City of Atlantic Beach agrees to
continue providing police patrol and response services to the
northeastern corner of the City of Jacksonville adjacent to the
City of Atlantic Beach at the same level of service provided during
FY 1993-94 and 1994-95.
9 . Sherry Drive - Jacksonville agrees to provide for the
repairing and ,resurfacing of Sherry Drive in Atlantic Beach as
follows: Subsequent to all utilities located within the right of
way being verified and repaired and/or replaced by others, if
necessary, to prevent disturbance of the pavement for at least five
years, the City of Jacksonville shall provide for a one time
repairing and resurfacing of the existing 24-foot wide asphalt
bearing surface of SHERRY DRIVE, between ATLANTIC BOULEVARD and
PLAZA STREET, approximately 3230 Linear Feet. Each of the parties
will appoint a qualified engineer to determine the work required.

The work shall be completed within twelve (12) months after
Atlantic Beach completes the necessary infrastructure improvements.
10. Hopkins Creek Drainage - The parties agree that the
drainage at Hopkins Creek under Florida Boulevard (located within
the City of Neptune Beach) shall be reconstructed to facilitate
necessary drainage flow, and Jacksonville and Atlantic Beach shall
each appoint an engineer to work cooperatively in designing a
reasonable construction acceptable to each engineer. The work
shall be performed within twelve (12) months after the effective
date of this Agreement. The City of Jacksonville shall bear the
cost of design and construction only (which does not include the
cost of Atlantic Beach's consulting engineer) . The parties
recognize that Jacksonville's ability to perform this work is
subject to the cooperation of Neptune Beach, Atlantic Beach, and
the ability to obtain the proper permitting from federal, state and
local regulatory agencies. The parties further recognize that
Jacksonville is not responsible for improving drainage within
Atlantic Beach.
11. Population Formula - Where a provision in this Agreement
requires that Jacksonville disburse or distribute funds or revenues
to Atlantic Beach using a formula based upon the percentage of the
population of Atlantic Beach in relation to the total Duval County
population, the population figures to be used shall be the most
recent population estimates for Duval County and the City of
