Subject: Enabling Resolution for C ural Arts and Recreation Advisory Committee
This memo is to explain the reason that we asked that the resolution amending the terms of office
for the Cultural Arts and Recreation Advisory(CARA)Committee be deferred from the regular
commission meeting on June 27th and to provide a status on the issues that gave rise to that
proposed resolution.
First, when we discussed the terms of office for the CARA Committee members, we were
working from an outdated copy of the enabling resolution. The original resolution was adopted
in July 2002 and contained a provision that members would have a maximum of two(2)
consecutive two-year terms. This enabling resolution was amended in June of 2003 to provide
that the members may serve a maximum of four(4)consecutive two(2)year terms for a total of
eight years. A copy of that amending resolution is attached. This change was made in
connection with those of other city boards to standardize the terms of office.
There were three issues to be addressed in the deferred resolution and at least one of these may
now be moot because of the longer terms of office for the CARA Committee members. The first
was to stipulate that the filling of an unexpired term would not count as a full term. If the
deferred resolution had been adopted. the CARA Committee members could serve a total of
between four and six years which equals two full two-year terms plus some portion of an
unexpired term In fact, they already have the ability to be serve for a total of four two-year
terms which means somewhere between six and eight years total if they were initially appointed
to fill an unexpired term With this in mind, is there any need to further amend the terms of
office for the CARA Committee members''
Second. the terms for the C.ARA Committee members were to be further staggered so that two of
the members would come up for reappointment every six months rather than four at a time at the
end of each year The Board Member Review Committee's original concern was that, if so many
CARA Committee members came up for reappointment at one time, they would be more
difficult to fill. Given that they can now serve between six and eight years is the further
staggering of terms to six-month intervals necessary? With longer terms allowable, there is more
likelihood that turnover would be less frequent for those who are term limited
The last issue to be addressed in the deferred resolution was making the President of the Teen
Council an automatic member. While this still should be addressed, you will recall that
Dezmond Waters made the suggestion in the June 27th City Commission meeting that this be
amended to say "or their designee'.
The next regularly scheduled Board Member Review Committee will be on Thursday, July 21'4
at 500 pm I am scheduled to be out of town that week and will not be able to attend so it was
important to outline these issues in a memo form before the meeting. If you need any additional

RESOLUTION NO: 03-05
A RESOLUTION OF THE CITY OF ATLANTIC BEACH, FLORIDA
AMENDING THE TERMS OF OFFICE FOR MEMBERS OF THE
CULTURAL ARTS AND RECREATION ADVISORY COMMITTEE
AND PROVIDING AN EFFECTIVE DATE.
WHEREAS, on July 8. 2002 the City Commission adopted Resolution 02-13 creating a
Cultural Arts and Recreation Advisory Committee which included a provision limiting the maximum
number of consecutive terms that any appointee may serve, and
WHEREAS. the City Commission has expressed a desire for appointments to city boards and
committees to have uniform terms and term limits so that all members will be appointed for two-year
terms and that there will be a maximum of four consecutive terms.
NOW THEREFORE BE IT RESOLVED, by the City Commission. City of Atlantic Beach
as follows;
Section 1. That Section 4 of Resolution 02-13 be repealed and that a new section on
membership be adopted as follows:
There shall be a total of nine (9) members appointed by the Mayor and Commission. Members
must be residents of Atlantic Beach. Following the expiration of the terms of office of current
committee members the term of office shall be for two(2) years and members may serve a
maximum of four(4) consecutive terms. Any committee member may be removed for cause
by the city commission upon written charges and after public hearing. Any member who fails
to attend (3) consecutive meetings without cause shall have his office declared vacant unless
the member's absence is excused by a majority of the board members, and the city commission
shall promptly fill such vacancy. A member may choose to resign from the committee at any
time by giving written notice to the City Clerk. One member of the committee shall either be a
member of the Atlantic Beach Teen Council or an adult advisor to same_
Section 2. This Resolution shall take effect immediately upon its final passage and adoption.
