CATON #309 10/02/2012 On September 25th, 2012, I, ACO Kelley Caton, received a signed City of Atlantic Beach Animal Control Complaint Affidavit from Ronelle L. Davis in reference to an incident that occurred late morning on July 26, 2012. According to the affidavit completed by Ms. Davis, she stated that she witnessed a black dog from 330 Magnolia Street run through her yard and into the yard of 346 Magnolia Street, The dog "charged and bared its teeth" at the pet sitter (later identified as B.J. Lester). As the pet sitter was with the black pit bull in the yard of 346 Magnolia Street, a young girl (kindergarten or first grade age) and her grandmother were riding their bikes down the street. The black dog then "quickly approached" the little girl and growled at her. The owner came out of 366 Magnolia Street and called multiple times to the black dog. Ms. Davis stated that the owner of the dog, "Willi" (Cecilia Babillis), carried the dog back to 330 Magnolia Street. Shortly thereafter, Ms. Davis witnessed Ms. Babillis' other dogs, Jack and Lola, aggressively approach and growl at the same woman and child riding bicycles south on Magnolia Street. Ms. Davis stated that the pet sitter placed herself between the dogs and the child before Ms. Babillis retrieved her dogs. On October 1st, 2012, I initiated a follow -up investigation into the Animal Control Affidavit received from Ms. Davis. I advised Ms. Davis that I had a few clarifying questions regarding her affidavit and she agreed to speak with me. During our conversation Ms. Davis provided additional details in reference to her affidavit. Ms. Davis said she was inside her home on the morning of July 26, 2012. From her second floor kitchen window she witnessed a black dog run north through her yard and run into the back yard of 346 Magnolia Street, one house to the south of hers. The back yard of 346 Magnolia Street Is fenced, but the gate was opened. Ms. Davis recognized the dog as one of three dogs residing at 330 Magnolia. She said that she recognized that the black dog is from 330 Magnolia Street because she frequently sees it on the front porch when she walks by. Ms. Davis observed pet sitter B.J. Lester stop her car in front of 346 Magnolia Street, Ms. Davis stated that her view was partially blocked by trees. She could see the back end of Ms. Lester's car, but doesn't know exactly when Ms. Lester exited the car. Ms. Davis stepped outside onto her front porch to warn Ms. Lester about the dog. Ms. Davis saw the black dog circle Ms. Lester's car. She also witnessed the dog charge and bare its teeth. She could not see what Ms. Lester was doing when she was approached by the dog. Ms. Davis said that Ms. Lester grabbed a stick to prevent the dog from re- entering the back yard of 346 Magnolia Street and tried to close the gate. Ms. Lester also yelled at the dog to go home. At that point the dog growled at Ms. Lester. While this was going on, Ms. Davis observed a girl approximately five or six years old and a woman she believed to be the child grandmother riding bicycles south on Magnolia St. At this time Ms. Davis was on her front porch. She stated that her view was blocked by trees and she did not see the Iittle girl and woman until they were in front of her house. Ms. Davis does not know the woman or child and has not seen them before. However, she feels that Ms. Lester did know them. Ms. Lester approached the woman and child, Ms. Davis stated it appeared that Ms. Lester wanted to warn them about the dog, Ms. Davis saw the black dog approach the group and observed Ms. Lester step in front of the child. The dog was approximately 5 feet from Ms. Lester and 8 feet from the woman and child. Ms. Davis said in her affidavit that the black dog growled. I asked her if she could remember hearing a growl or seeing bared teeth. She said no. Ms. Davis said that saw the owner, Cecilia Babillis, come from 366 Magnolia Street, which is a vacant house north of hers. Ms. Davis does not know why Ms. Babillis was at 366 Magnolia Street. Ms. Davis knows Ms. Babillis from the neighborhood and has had positive interactions with her in the past. Ms. Babillis called the black dog and it returned to her right away. She said she definitely remembers the black dog came right away. Ms. Davis cannot remember the dog's name. Ms. Davis said that Ms. Babillis apologized to the group and took the dog to 330 Magnolia. Ms. Lester was in the street talking to the woman and child when Ms. Babillis walked north, retuning to 366 Magnolia Street. Ms. Babiliis walked past the group and did not interact with anyone. When Ms. Babillis was halfway down the driveway of 366 Magnolia Street, Ms. Davis heard a banging noise that she thinks was the side gate 330 Magnolia Street. Ms. Davis saw Ms. Babillis's two other dogs - a brown pit bull and a brown & white pit bull - and aggressively approach the group, circling the little girl on the bicycle. I asked Ms. Davis to clarify this, because her affidavit says that the dogs "approached aggressively ". I asked her to define what she meant. She had trouble defining the dogs' behavior. I asked if the dogs were barking or growling. She said the dogs were not growling and appeared curious. Ms. Lester tried to shoo them away with a stick. Ms. Davis said that Ms. Babillis got there about same time "we're talking seconds." Ms. Babillis and Ms. Lester exchanged words. Ms. Davis could not hear most of the exchange, but remembers Ms. Lester mention leash laws and Ms. Babillis call her an "old cow." Ms. Babillis picked up one dog and headed towards 330 Magnolia Street and the other dog followed. Ms. Davis cannot remember which dog was carried, and stated that "from the back end both dogs look the same." Ms. Davis stated that she did not leave her property during the incident. She did not run out to help with the dogs because she felt that an extra person might upset the dogs. She also stated that she has known Ms. Lester for years, knows that she was an animal control officer at one time and felt that Ms. Lester could handle the situation. I then attempted to make contact with Ms. Lester via phone on October 1st, 2012 at approximately 5:22 p.m. and 5:47 p.m., but received no answer. I left a message requesting her to call me back. On October 2nd, 2012 at approximately I attempted to contact Ms. Lester via phone but received no answer. I left a message for Ms. Lester to contact me. Sergeant Jevic advised Sergeant Tusing and I that he observed Ms. Lester's vehicle parked at the Beaches Branch Library in Neptune Beach. Sergeant Tusing and I met up with Ms. Lester at the Beaches Library. Ms. Lester initially stated that she had received my calls, did not recall when the event occurred, and did not want to talk about the incident. I continued to speak with her and she stated that she remembered there were three dogs loose on Magnolia Street. One was a short - haired black dog that she described as "fearfully aggressive." She said that it bared its teeth and barked at her. Ms. Lester said she grabbed a palm frond to keep it away from her. Sergeant Tusing asked Ms. Lester if she was afraid and she stated no, and she was an animal control officer for 10 years in Atlantic Beach. She stated that someone without her experience would probably be nervous and afraid when confronted with the dog's behavior. Ms. Lester stated that the dog cowered when the owner, a young white female, came to get it. She stated that the owner gave it verbal commands and the dog became compliant I asked Ms. Lester if she knew the names of the woman and child who rode by on bicycles. She said that she did not. Ms. Lester remembered that while she was speaking to the woman, two other dogs ran north on Magnolia Street and circled her, the woman, and the child. I asked about the dogs' behavior and she stated that they were not growling or baring their teeth. Ms. Lester said that the same owner came back with leashes and took the dogs away. I asked her if she spoke with the owner. She said yes, but cannot remember exactly what was said. J. Tusing #1408 ` — 10/03/2012 On October 2nd, 2012, at approximately 3:25 p.m., I (Sgt. J.N. Tusing #1408) initiated a follow -up investigation into the Atlantic Beach Animal Control Affidavit received from Mr. Robbins in reference to an incident that occurred on August 10th, 2012, at approximately 4:45 p.m. at 310 Magnolia Street. Mr. Robbins stated in his affidavit that the brown and white pit bull mix nipped a roofing contractor that was working at his house. Mr. Robbins stated that the dog ran at the contractor and the contractor grabbed a hammer to back it down. Mr. Robbins stated that he then observed a dog growling at the contractor. He stated that "the nip was minor only due to the contractor's quick action." At approximately 3:30 p.m., I contacted Mr. Robbins via phone and requested he provide the name of the roofing company he contracted with when this incident occurred and he advised Romano's Roofing. A Google search located a phone number of 904 - 246 -5649 for Romano Roofing. I contacted the number and spoke to Danny Romano who advised that his brother Joey Romano handled the roofing jobs at the beach, and he was unaware of any employees complaining of being bitten by a dog. Danny Romano provided with the phone number (904- 838 -5559) to his brother Joey Romano. I then contacted Joey Romano via phone who recalled doing a roof repair for Bruce Robbins on Magnolia Street. Mr. Romano stated that he had two employees with him at the job site Randy (unknown last name) and Aaron (unknown last name). He recalled seeing several dogs running loose while they were there but could not provide a description. He further stated that Aaron may have approached him regarding one of the dogs either biting him or was trying to bite him but was not able to provide details. I asked if he could provide a last name or contact number for Aaron and he advised he would call me back. He stated that Aaron only worked for him for approximately one week. On October 3rd, 2012, at approximately 1 :37 p.m., I received a phone call from Joey Romano who advised that he does not know Aaron's last name and provided his phone number of 904 -327 -2089. At approximately 3 :15 p.m., I attempted to contact this number and it went straight to voicemail. The voicemail was automated and did not indicate who the number belonged to. I left a message for Aaron to contact me. I then ran a database search of the phone number to attempt to identify any persons listed using this number in any police contacts and the results were negative. At approximately 3:30 p.m., I contacted Mr. Robbins in reference to the affidavit he completed and advised him that I had a few clarification questions and he agreed to speak with me. During our conversation Mr. Robbins stated that he was not present when the roofing contractor was bitten. He stated that he was coming out of the side gate and observed the brown pit bull which he believed to be "Jack," growling at the contractor. He stated the dog quickly fled the yard, then the contractor told him the dog just bit him. The contractor stated that the dog just bit him on the forearm. He stated that the dog was unleashed and the owner was not present. I asked Mr. Robbins to describe the injury the contractor sustained and he advised that it was a "small break in the skin." Jevie #1407) initiated a follow -up investigation into the Atlantic Beach Animal Control Affidavit received from Vanessa Chamberlin in reference to an incident that occurred in August 2011 in Howell Park. Ms. Chamberlin stated in her affidavit that her wheaten terrier, "Kingston" approached pit -bulls and was immediately and viciously attacked. Ms. Chamberlin further stated, the pit -bulls were being walked by their owner (older lady with white hair — Suzanne LeViseur), when they broke away from the owner, who clearly had no control over them. Ms. Chamberlin stated "Kingston" was bitten by the pit bulls multiple times and suffered severe lacerations, which required sutures and underwent surgery at her Veterinarian's (Pet Doctors of America; 1103 aid Street South, Jacksonville Beach, Fl 32250) office and has permanent scarring as a result of the attack. Ms. Chamberlin also submitted three (3) photos of Kingston's wounds. At approximately 8:20 p.m., I made contact with Ms. Chamberlin at 850 Seminole Rd, after I asked her if she was willingly to talk with me. I advised Ms. Chamberlin that I received her Animal Control Affidavit and had a few questions that needed clarification and she agreed to speak with me. Ms. Chamberlin was unable to provide me with an exact date or time of the attack, however; she said would call her veterinarian's office and provide me with the exact date of the attack in August 2011. Ms. Chamberlin said the time was between 6 — 7 pm. Ms. Chamberlin advised me that she had Kingston off leash in Howell Park on the day of the attack and was they were approaching the Pine Street entrance of Howell Park, walking from the east. Ms. Chamberlin said she saw a woman she described as being in her 60's, approximately 512" to 5'3 "with whitish/gray hair walking two pit - bulls, described by Ms. Chamberlin as one brown and tan and the other white /tan) with leashes attached to them in Howell Park on the west side of a walkway bridge near Pine Street, Ms. Chamberlin stated she was on the east side of the walkway bridge when Kingston crossed over the bridge and approached the two pit -bulls still on their leashes under control of the woman. Ms. Chamberlin said as Kingston reached the two pit - bulls, they immediately and viciously attacked Kingston. Ms. Chamberlin said during the attack the two pit -bulls both came out of their collars, out of the control of the woman and continued to attack Kingston. Ms. Chamberlin said the pit -bulls were biting Kingston and she thought they would kill him. Ms. Chamberlin crossed over the bridge and when she saw an opportunity she reached down and grabbed Kingston and turned her backs to the pit -bulls and started to walk towards the north to get distance from the pit- hulls. Ms. Chamberlin said the woman asked if her dog was ok she said she told her to just go. Ms Chamberlin said she was very shaken by the incident not thinking that any dogs would attack another dog in that manner. Caton #309) received a signed City of Atlantic Beach Animal Control Complaint Affidavit from Gretchen Deters -Smith in reference to an incident that occurred on August 21, 2012, at 346 Magnolia Street. According to Ms. Deters - Smith's affidavit two dogs from 330 Magnolia Street, a black pit bull and a red pit bull, were off -leash and in her driveway at 346 Magnolia Street, Ms. Deters - Smith's friend, Kathy Mills, left at approximately 12:00 p.m, The black dog stood between Ms. Mills and her car and "barked at her in a menacing way." Ms. Deters -Smith asked the dog owner, Willie Babillis, to remove her dogs. Ms. Smith stated that Ms. Babillis could not grab the dogs because they did not have collars, and the dogs did not respond to her commands. Ms. Deters - Smith said that Ms. Babillis finally chased the dogs away. Ms. Deters- Smith's affidavit also stated that she did not report the incident because she thought she "would handle it neighbor to neighbor." On September 24th, 2012, 1 initiated a follow -up investigation into the Animal Control Affidavit received from Ms. Deters - Smith. I advised Ms. Deters -Smith that I had a few clarifying questions regarding her affidavit and she agreed to speak with me. I asked her what she meant by "menacing." She stated that while barking, the dog was not more than 6 inches from her friend, blocking the entrance to the car and did not back up. Ms. Deters -Smith told me that she changed her mind about reporting the incident after receiving a Ietter from Lindsay Cole. Based on this affidavit, Animal Control Citation #4029 was issued to Cecilia Babillis on September 26, 2012 for Running -at- Large. This affidavit was revisited during a Dangerous Dog investigation. I initiated another follow -up investigation on October 2nd, 2012 into the Animal Control Affidavit received from Ms. Deters - Smith. I advised Ms. Deters -Smith that a Running -at -Large citation was issued to Ms. Babillis based on her affidavit. However, now we were looking at the affidavit for a dangerous dog investigation and I had a few more clarifying questions. She agreed to speak with me. Ms. Deters -Smith said she was inside her house and did not see the initial encounter between Ms. Mills and the dog. Ms. Deters -Smith said she heard barking and went outside to see what the commotion was about. She saw the black pit bull standing in her driveway between Ms. Milts and the driver's side of Ms. MiIl's car. She said that there were two other dogs running back and forth between her yard and 354 Magnolia Street, the house to the north of hers. I asked Ms. Deters -Smith to clarify this, because her affidavit says that the there were only two dogs. She said she definitely remembers three dogs: the black dog in her yard, the brown dog "Jack" and the brown & white dog. Caton #309 10/02/2012 On September 26th, 2012, 1, ACO Kelley Caton, received a signed City of Atlantic Beach Animal Control Complaint Affidavit from William Ross in reference to an incident that occurred on September 6th, 2012 at approximately 2:00 p.m., at 301 Magnolia St. According to Mr. Ross' affidavit he was driving home from the beach and turned south on Magnolia Street from Palm Avenue. Mr. Ross stated that he drove past 330 Magnolia St. he observed 3 unleashed dogs that were being walked by his owner. When he arrived home and parked in his driveway. He removed one of his surfboards from his vehicle and turned around and saw one of the three dogs lunging at him. The other two dogs were in his front yard barking aggressively and also lunging at him. Mr. Ross stated that he swung his surfboard at the dogs and stated, "the only thing that kept these dogs from biting was swinging my surfboard to keep them away." After approximately 2 -3 minutes the.dogs retreated to their property. He stated that he will not walk his dogs down Magnolia Street from a past incident of one dog attempting to attack his dog as he walked down the street. On October 1st, 2012, I initiated a follow -up investigation into the Animal Control Affidavit received from Mr. Ross, Mr. Ross did not leave a phone number on his affidavit for me to contact him. I checked the white pages and his number was not listed. I followed up with the Atlantic Beach Water Department and obtained his phone number (904- 382 - 0854). At approximately 5:06 p.m., I attempted to contact Mr. Ross via phone and a female answered the phone and hung up, after I identified myself as Officer Caton with the Atlantic Beach Animal Control. I immediately called the number back and the phone went straight to voicemail (which identified the number as belonging to Mr. Ross). I left a message for Mr. Ross to return my call. At approximately 5:40 p.m., I attempted to contact Mr. Ross at his residence (301 Magnolia Street), but no one answered. I left an orange door hanger on his door requesting he contact me in reference to his affidavit. On October 2nd, 2012, at approximately 9:00 a.m., I made contact with Mr. Ross via phone in reference to the Animal Control Complaint Affidavit he submitted on September 26th, 2012. He then decided to report the incident. During our conversation Mr. Ross provided additional details in reference to his affidavit. Mr. Ross stated he drove south on Magnolia Street from Palm Avenue. He passed 330 Magnolia Street and saw three unleashed pit bulls. He could not remember what they looked like, but when asked to describe the pit bulls he said one was spotted, and one may have been brown. He advised that they looked liked they could have been pit bull mixes. Mr. Ross stated as he passed the dogs they were located mid -block in the grass area (east side of the street) across from houses. They were being walked without leashes by a white female with dark hair in her mid twenties. Mr. Ross did not notice if she had leashes in her hand. He assumed she was the owner and she waived as he drove by. Mr. Ross pulled into his driveway at 301 Magnolia Street. He was removing his surfboard from the car when one of the dogs lunged at him from approximately 1 foot away. He could not remember or describe which one of the dogs lunged at him. The other two dogs were in his yard approximately 3 ft to 10 ft. away from him, barking aggressively which he defined as "growling, deep, loud barking, and showing teeth." Robbins stated the dog ran past him as he was waving shears to keep the dog away from him. Robbins stated the dog made a second full speed pass again growling. Robbins stated the owner (Willie) was in the street yelling at the dog, Lola, to stop. Robbins stated the owner got the dog under control at that time. I, Sgt. L. jevic made contact with Bruce Robbins on October 10, 2012 at approx 8:45 pm via telephone to conduct a follow up to the affidavit described above. According to Robbins, he was taking trash to the trash area across the street from his home located at 310 Magnolia St. on Oct 7, 2012 at approx 7 :40 pm. Robbins said he was approx. 50 feet from his driveway when looked up and saw a pit bull in the road off leash approximately 150 feet north of him. Robbins said the pit bull carne at him, running full speed, growling and showing its teeth. Robbins said he dropped everything in his hands except the shears and starting waving them towards the dog to keep the dog from attacking him. Robbins said the dog came within a 36 inches of him as the dog ran past him, Robbins said he thought the dog would attack him if he did not have the shears. (Atlantic Beach Police Station) in reference to an animal complaint. Upon arrival, I met with the complainant Shannon Porter who had a signed City of Atlantic Beach Animal Control Complaint in reference to an incident that occurred on September 10th, 2012. According to the affidavit completed by Ms. Porter, at approximately 10:45 a.m. she witnessed two pit bulls in the street which were off of their leashes. She described the pit bulls as one brown and one was white with brown spots. She observed these dogs when she visiting her friend, Lindsay Cole at 338 Magnolia on September 10th, 2012. Ms. Porter stated that the white and brown pit bull charged her car as she pulled into Ms. Cole's yard. Ms. Porter was afraid and said she would not get out of the car until the owner took the dogs away. Based on this affidavit, Animal Control Citation #4002 was issued to Cecilia Babillis on September 17, 2012 for Running -at- Large. This affidavit was revisited during a Dangerous Dog investigation. I initiated another follow -up investigation on October 3rd, 2012 into the Animal Control Affidavit received from Ms. Porter. I advised Ms. Porter that a Running -at -Large citation was issued to Ms. Babillis based on her affidavit. However, now we were looking at the affidavit for a dangerous dog investigation and I had a few more clarifying questions. She agreed to speak with me. Ms. Porter stated that she was driving south on Magnolia Street when she saw two dogs off leash about a house north of Ms. Cole's. The dogs were walking south, in the middle of the street behind a young, white female (Ms. Babillis) who she knows from past experience to be the dogs' owner. Ms. Porter said that she turned into the driveway of 338 Magnolia Street when the brown and white pit bull turned around and charged her car. The dog stood in the middle of the yard barking and staring at Ms. Porter. She did not see the owner or the other dog. Ms. Porter thinks that Ms. Babillis must have summoned the dog because it suddenly turned around and ran next door to 330 Magnolia Street. Ms. Porter stated that she sat in her car "for a few minutes" afterwards. I asked her to elaborate on the time frame. She said she was shaken up sat "long enough" to give Ms. Babillis time to put the dogs in the house. Ms. Porter was picking something up from Ms. Cole and was only at the residence for a few minutes. She did not see the dogs or Ms. Babillis when she left. Ms. Cole did not see the incident. I asked Ms. Porter if she knew where the dogs lived or who the belonged to. She said yes, she has visited Ms. Cole many times and has seen both dogs and owner in the past. She has gone for walks in the neighborhood with Ms, Cole and the dogs have barked at them from the balcony. Jevic #1407 On October 10, 2012 I, ACO Fonda Spratt, received a signed City Of Atlantic Beach Animal Control Affidavit from Andy Huffman in reference to an incident that occurred on October 9, 2012 at approximately 11:20 a.m. According to the affidavit written by Andy Huffman, he stated he was standing near the garage at 338 Magnolia Street reading a manual regarding the lights that he was hired to install. He noticed a young lady walking south with two pit -bulls (one black and one white /tan). As the pit -bulls were north of the driveway, the black pit -bulls were barking at him and tying to break free from the owner and lunged toward him, but the owner yanked the canine back. He then heard more barking and the white /tan pit -bull came out of nowhere and was charging him at a rapid speed, growling, bearing its teeth and snapping at him. He was immediately fearful of being attacked and mauled, so he kicked the pit bull. The pit bull retreated briefly and then circled back and charged at him a second time coming in the garage, again growling and snapping at him, The owner was yelling the whole time "she won't bite." The owner was also trying to call the pit buII, but it was ignoring her commands. He stated that the pit bull eventually left and the owner put both dogs in the house, then the owner came back to ask if the dog had bit him. Mr. Huffman stated that both dogs appeared to be extremely aggressive, for no reason, and completely out of control. On October 11, 2012, Sgt. Jevic contacted Mr. Huffman via telephone to conduct a follow up investigation into the Animal Control Affidavit received from Mr. Huffman, Mr. Huffman provided additional information to his affidavit. Mr. Huffman stated he was standing in front of the garage at 338 Magnolia Street reading a manual regarding the lights that he was hired to install at approximately 11:20 A.M. He saw a young woman about 40 feet away from him walking south in the road just north of 338 Magnolia with two pit bulls on a leash (one black and one white /tan). As the pit bulls were just north of the driveway, the tan /white canine slipped out of its collar and the black pit-bull was barking at him and trying to break loose and lunged toward him, but the owner yanked the black pit - bull back. However, the white/ tan canine got loose and started to charge him at a rapid speed growling, bearing its teeth and snapping at him. Mr. Huffman stated that he was immediately fearful of being attacked and mauled, so he kicked the white /tan pit -bull. The white /tan pit -bull then retreated briefly and circled back and charged him a second time near the garage, again growling and snapping at him but ran past him. There are three pit bull mixed breeds' living at 330 Magnolia Street, one tan, one tan and white and one black, which are unpredictable and aggressive. Further exacerbating the problem, the ovvnlers frequently allow the pit bulls to roam the streets without a leash. If you have ever walked down Magnolia Street towards Howell Park, you likely know the pit bulls to which I am referring. Many of the neighbors on Magnolia Street have tried discussing the situation with the pit bulls owner(s) in the hopes of reaching an amicable resolution, but have been met with hostility and disrespect. It has come to the point that I and my neighbors are afraid for our safety, the safety of our pets, and all of you your loved ones and your pets, e have now learned tha I have also been informed by many of you that you too have been scared and disrupted by these pit bulls. In fact, I know that some of you no longer feel comfortable walking down Magnolia Street. At approximately 12:00 p.m., I initiated a follow -up investigation into the affidavit in reference to the incident that occurred on May 26th, 2012 at approximately 2:00 p.m., at 310 Magnolia Street. Mr. Brogden stated in his affidavit that he was working at 310 Magnolia Street and observed a brown pit -bull run up to a lady walking her dog. Mr. Brogden stated that the pit bull circled both of them and was growling and, "looked as if it would attack at any moment." Mr. Brogden stated he grabbed his machete "just in case" and the owner came and got the dog. Mr. Brogden stated spoke to the victim afterwards and was shaken up and feared for her and her dog's safety. At approximately 1:30 p.m., I made contact with Mr. Brogden via phone. I advised Mr. Brogden that I had a few clarifying questions in reference to the Atlantic Beach Animal Control Complaint he filed about the incident that occurred on May 26th, 2012 at 310 Magnolia Street: I asked ?& Brogden if this was the second incident he witnessed with this brown pit bull and he stated it was and that the two incidents were approximately one week apart. I asked him if it was the same dog in both incidents and he stated it was. He stated that during this incident he observed a white female in her late 40's to early 50's walking a very large dog approximately the size of a Great Dane on a leash. Mr. Brogden stated he was in the driveway of Bruce Robbins when he observed the incident occur in the roadway. He stated that the brown pit bull "charged" the large dog and approached it from the side (dog's shoulder area). He heard the pit bull growling and sniffing the large dog. He stated that he observed the pit bulls head to be below his shoulders (crouching) as it growled at the dog. He grabbed his machete and stated that he would defend the other dog or lady against the pit bull if he had to. I asked Mr. Brogden how close was the pit bull away from the dog and he stated it was right next to the dog. He stated that the incident took approximately 2 minutes and observed the dog owner's daughter come into the street and retrieve the dog. Mr. Brogden stated he spoke to the woman who appeared to visibly shaken and nervous about the incident. I asked Mr. Brogden if he knew the owner of the dog and he stated he did not and described her as a white female in her late teens to early twenties. I asked Mr. Brogden if he knew the lady walking the dog and he stated that he has been doing landscaping for Mr. Robbins for approximately 6 years and has never seen the lady or the dog before this incident and has not seen them since. The landscaper advised that the canine was showing signs of aggression by growling and snarling. The landscaper then. picked up a shovel to ward off the canine from attacking him. The owner Ms. Babillis arrived and retrieved her canine. At approximately 3:00 p.m., I made contact with Mr. Robbins via phone. I advised Mr. Robbins that I received his Animal Control Affidavit and had a few questions that needed clarification and he agreed to speak with me. Mr. Robbins advised that his landscaper who he identified as Spencer Brogden reported to him an incident involving the brown pit -bull from 330 Magnolia Street. Mr. Robbins stated that Mr. Brogden owns Spencer's Creations and his contact number is 327 -6842. Mr. Robbins stated that Mr. Brogden was in the process of completing an affidavit in relation to this incident. 1 asked Mr. Robbins if he observed the - incident with Mr. Brogden and stated that he did not. At approximately 3:30 p.m., I attempted to contact Mr. Brogden via phone but received no answer. I left a message for Mr. Brogden to contact me. On October 3rd, 2012, 1 checked my work voicemail box and had a message from Mr. Bro den. Mr. Brogden advised that he submitted two affidavits for review. One of these affidavits pertains to this incident and the other pertains to an incident with the same pit -bull that occurred onbJ11 v 26th,- 2012. 1 spoke to Animal Control Officer (ACO) Fonda Spratt who advised that she had the two affidavits from Mr. Brogden. At approximately 12:00 p.m., I initiated a follow -up investigation into the affidavit in reference to the incident that occurred on Ma� Y 2012 at approximately 11:00 a.m., at 310 Magnolia Street. According to Mr. Brogden s affidavit he working at 310 Magnolia Street and was taking trash to put across the street when he observed a brown pit bull come "charging down the street out of 330 Magnolia Street. The dog then ran into the yard of 310 Magnolia Street and chased the owner's cat over the back fence. The dog then charged me. The dog approached Mr. Brogden with a "lowered head all the while growling and barking." He had his shovel in his hand and thought that he may have to defend himself. At this time the owner's daughter retrieved the dog and told Mr. Brogden that the dog "wouldn't bite." At approximately 1:30 p.m., I made contact with Mr. Brogden via phone. I advised Mr. Brogden that I had a few clarifying questions in reference to the Atlantic Beach Animal Control Complaint he filed about the incident that occurred on May 20th, 2012 at 310 Magnolia Street. Mr. Brogden agreed to speak with me about the incident. Mr. Brogden was asked where he was standing when he observed the dog which he described as a brown pit bull, and lie stated he was standing on the east side of the street near the wooded area. He stated that the dog came "charging" down the street. I asked him to describe what he meant by "charging" and lie stated that the dog was "running with a purpose." He described the dog as taking a "full sprint" as he observed it run from the driveway of 330 Mannolia Street, and chased Bruce Robbins cat over the fence. He stated once the cat was gone, the dog looked at him and charged at him. I asked Mr. Brogden how close the dog came to him and he advised approximately 2 feet. He stated that he had his shovel in his hand and stated that he could have hit the dog and would have if it got any closer to him. He described the dog as barking, crouching down, growling, and showing his "canine" teeth (snarl). He stated that the incident lasted approximately 45 seconds to a minute and heard the owner yelling for the dog. Predation is and consuming prey. These patterns are exhibited by both wolves and dogs. It is generally accepted in the behavioral community that the behavior is genetically predisposed. All dogs share the same genetic makeup with wolves. This being accepted, then why don't all dogs exhibit this pattern? The answer is in the breeding of dogs. If humans do not want dogs to exhibit strong predatory motor patterns then they will only breed the animals that exhibit weaker or muted predatory patterns. After many subsequent generations where this type of selective breeding occurs, the result will be that dogs no longer exhibit these patterns. As defined, the predatory motor pattern includes most and sometimes all of the following behaviors: o Scan and scent ® Orient ® Freeze ® Stalk ® Charge, pounce (also called foreleg -stab or mouse jump) or chase ® Grab bite ® Kill bite o Toss (also called kill shake) ® Dissect o Consume or cache (page 203) A11'AUHMEN T A dog is able to vary the pattern and may skip a specific behavior but the overall result is the dog will be the death of the prey. I have reviewed the reports of the three dogs in question and the following are my opinion based on what is written in the reports. It is based on my experience and training in the field of dog behavior. I have not seen the dogs. EXAMPLES of DOCUMENTED INCIDENTS: Agency Report 12 -17084 Page 6 "The dog charged him with head down, growling and teeth bore." "...the dog circled him three times." Although it is not a direct part of the Predatory Motor Pattern, before a dog will charge a large prey animal it will display a behavior called Testing. The dog will work alone or cooperatively to test the prey (victim). The display consists of the dog darting in close, bow (head down) and move away quickly to keep themselves out of harm's way. This display is seen in the above incidents and is a precursor to Charging. The following is a full copy of a dog bite: "Date5/3/2012 Subject Pit Bull attack on beach south of Dewees Ave I was walking my French Bulldog on 48" nylon ( non- extension type) leash just south of the Dewees access on the beach- in the surf. Two females were out of the water with their red Pit Bull - on loose sand about 10 yards 3 A l l AU 1.V1 2N 1 k east of dunes and 20 -- 25 yards west of the surf (tide was low). The dog (off leash) came running towards the surf at my dog and grabbed him by the back of his neck. The girls were running and screaming towards the dog but he already had a hold of Beaux shaking him vigorously. I threw myself on their dog and tried to pry him off. We eventually got their dog off mine - words were exchanged and I ran to some workers at a house on 16th access and borrowed their phone allowing me to contact authorities. Photos of abrasions to the back of Beaux's neck and some blood in the anal region were taken by Animal Control Officer Kelley Caton #309" The above is an example of full predatory motor pattern. The only thing that prevented the dog from killing the French Bulldog was the intervention of the human. It has Orient, Charge, Grab Bite, Kill Bite and Toss. The following is an excerpt from a dog bite,report: SGT J. N. Tusing #1408 dated 10103/2012 On October 2nd, 2012 at approximately 3:25 pm, I Sgt J.N. Tusing #1408 initiated a follow -up investigation into the Atlantic Beach Animal Control Affidavit received from Mr. Robbins in reference to an incident that occurred on August 10th, 2012 at approximately 4:45 pm at 310 Magnolia Street. Mr. Robbins stated in his affidavit that the brown and white pit bull mix nipped a roofing contractor that was working at his house. Mr. Robbins stated that the dog ran at the contractor and the contractor grabbed a hammer to back it down. Mr. Robbins stated that he then observed a dog growling at the contractor. He stated that the nip was minor only due to the contractor's quick action. Later in this report it describes the bite as being a small break in the skin. This is an example of the dog going through the predatory motor pattern up to the Bite phase. It was thwarted due to the size and defensive maneuver of the victim. CONCLUSION These two examples demonstrate that the dogs are not only aggressive but are willing to complete the predatory pattern on not only animals but humans as well. The;,black.dog aggressively approached and,circled:the;;car and as the sitter ex�lted the car the black dug charged and bated itseteeth at,her T, l went outside to call out to her to be careful and where the dog was from She decidedwto make sure the.dog didn't reenter 346 Magnolia's back yard and to force it to go home. This occurred out -of- -view from the street and during this short period coming from the Howell park area, heading south on Magnolia, was a little girl (looked kindergarten or first grade age) on a bike equipped with training wheels. Behind her was her grandmother on her own bike. The Pet Sitter started to warn them and the black dog quickly approached the little girl and growled at the group. Willi appeared from 366 Magnolia St and called multiple times to the black dog. She was finally able to capture and carry the black dog back to 330 Magnolia. The sitter and grandmother waited for the coast to clear, however Willi immediately returned (without the black dog or leashes) walking around the group. When she was halfway down 366 Magnolia St's driveway, I heard a banging noise. I could see the Pit Bulls Jack and Lola running past her and aggressively approached and circled the little girl. The Pet Sitter, with a stick to block.the dogs, placed herself between the little girl and the dogs. Willi was able to pick up one of the dogs and the other followed: The Pet Sitter and Willi had an exchanged of words and I could hear the sitter informing Willi about Atlantic Beach leash laws and her dogs aredpgerous in how they approached the little girl: Willi's final response to the sitter was "Shut -up you:oid cow."
