11 JAN 2011 CEB MINUTESCITY OF ATLANTIC BEACH CODE ENFORCEMENT BOARD MINUTES 6:00 P.M., January 11, 2011 PRESENT: Chairman Ray Martin Vice Chair Veda Bernstein Nicholas Dodaro Juliette Hagist Ian Luthringer Richard Ouellette Ron Pendleton Barbara Weiss AND: Michael Griffin, Building Official Kathy Stiles, Code Enforcement Officer Susan Gorman, Secretary Alan Jensen, City Attorney Chairman Ray Martin called the meeting to order at 6:00 p.m., followed by the Pledge of Allegiance to the Flag by all present. Secretary Susan Gorman read the roll, finding a quorum was present. 1. Approval of Minutes: Following a brief review, BarbaraWeiss motioned to approve, Juliette Hagist seconded and the Board voted unanimously to approve the minutes of the Code Enforcement Board meeting of November 9, 2010. 2. Administration of Oath to Defendants/Witnesses: Visitors were noted and Chairman Martin asked witnesses to come forward to be sworn in. 3. Unfinished Business: None January 11, 2011 Page 2. 4. NEW BUSINESS: a. Case #60010: 901 Ocean Blvd., #51 Code Enforcement Officer Kathy Stiles presented the case and explained the violations specific to 901 Ocean Blvd. #51, and the issues between the Respondent and her Condominium Association regarding the doors at the aforementioned property. The Board was advised that service was received by posting the Notice of Hearing on the property. Officer Kathy Stiles gave her recommendation to find the property in violation and to allow the Respondent thirty days or until February 11, 2011 to achieve compliance. The Respondent was not present, but was represented by Brien McInerney of 901 Ocean Blvd. # 51. Mr. McInerney gave sworn testimony to his intent to resolve the Code violations at the aforementioned property. Board Members addressed their questions to Mr. McInerney and discussion ensued. Chairman Ray Martin asked the Board for a motion. A motion was offered to accept Officer Stiles's recommendation, but City Attorney Alan Jensen reminded the Board that a motion must state whether the property is in violation or not, before the motion can state terms or fines. Ron Pendleton amended the motion to find the property in violation and to allow the Respondent thirty days or until February 11, 2011 to achieve compliance. The Board may impose fines of up to $100.00 per day and every day thereafter until compliance is achieved. Board Member Juliette Hagist seconded and the motion carried unanimously. b. Case #69110: 421 Sargo Road Code Enforcement Officer Kathy Stiles presented the case and explained the violations specific to 421 Sargo Road. The Respondent was not present, but Officer Stiles explained that Notice of Service was received by the owner, Walter L. Barnes, who does not reside at 421 Sargo Road, but is the owner of the aforementioned property. Mr. Barnes discussed his plans to demolish the existing house at 421 Sargo Road with Code Enforcement Officer Stiles. Board Members addressed their questions to Code Enforcement Officer Stiles and she gave her recommendation that the Respondent make the necessary repairs to 421 Sargo Road by February 11, 2011, or face fines of up to $250.00 per day until compliance is met. Discussion ensued and City Attorney Alan Jensen offered verbiage for the Board to insert in their motion in light of the Respondent's intent to demolish the existing structure. Board Member Veda Bernstein motioned to find the property in violation and to order the Respondent to make repairs cosmetically acceptable to Code Enforcement Officer Kathy Stiles by February 11, 2011, or the Board may impose fines of up to $250.00 per day for every day thereafter January 11, 2011 Page 3. until compliance is achieved. Board Member Juliette Hagist seconded and the motion carried unanimously. 4.
