08 June2010 CEB MinutesCITY OF ATLANTIC BEACH CODE ENFORCEMENT BOARD MINUTES 7:00 P.M., June 8, 2010 PRESENT: Vice Chairman Ron Pendleton Veda Bernstein Ray Martin Juliette Hagist Richard Ouellette Nicholas Dodaro ABSENT: Chairman Carl Russell (excused) Barbara Weiss (excused) Alan Jensen AND: Michael Griffin, Building Official (absent) Eddie Lopez, Code Enforcement Officer Susan Gorman, Secretary Suzanne Green, Prosecuting Attorney Vice Chairman Ron Pendleton called the meeting to order at 7:02 p.m., followed by the Pledge of Allegiance to the Flag by all present. Secretary Susan Gorman read the roll and determined that there was a quorum. 1. APPROVAL OF MINUTES: Following a brief review, the Board voted unanimously to approve the mimites of the Code Enforcement Board meeting of April 13, 2010. 2. Vice Chair Pendleton asked all Respondents and witnesses to step forward to be sworn in. 3. OLD BUSINESS: Board Member Richard Ouellette asked for clarification on Code Enforcement policy regarding Vehicle cases that have gone before the Board. Code Enforcement Officer Eddie Lopez explained that Code enforcement policy is consistent with International Property Maintenance Code, Chapter 3, Section 302.8. Board Members asked questions regarding methods of tracking prior violations. Discussion ensued and Code Enforcement Officer Lopez encouraged the Board to email his City address with questions, concerns or updates. 4. NEW BUSINESS: a. Case # 37910: Mayport Road at Saratoga Cir. South Regina Rosenstein Trust is the owner of the property at Mayport Road and Saratoga Cir. S. June 8, 2010 Page 2. The owner lives out of state, but received notice. Code Enforcement Officer Eddie Lopez presented the case of Sidewalk and Driveway violations at the aforementioned property and took questions from the Board. The Respondent was not present, but has communicated with Officer Lopez. Board Member Ray Martin motioned to accept the recommendation made by Officer Lopez to find the Respondent in violation of International Property Maintenance Code, Chapter 3, Section 302.3; but to allow thirty days or until July 9, 2010 for the Respondent to come in compliance or the Board will impose a fine of $100.00 per day and for every day thereafter. Board Member Veda Bernstein seconded and the motion carried unanimously. b. Case # 37510: 981 Sailfish Drive Code Enforcement Officer Eddie Lopez presented the case of Storage and Container violations at 981 Sailfish Drive and gave his recommendation to find the Respondent in violation. Respondent Rena Koenig is the owner and was not present, but she recently communicated with City officials regarding the same violation. Board Members asked questions and discussion ensued. Officer Lopez advised the Board that a pod was removed and the dumpster on the property is permitted, but he advised the Board to note the Respondent has repeated the same Storage and Container violations at the aforementioned property. Board Member Veda Bernstein motioned to find the Respondent in violation of Atlantic Beach Code, Chapter 24, Section 24-64 (b) (1-2), regarding Storage and Containers. Repeat of same violation will result in a fine of $100.00 per day for every day thereafter, within twenty four hour notification by Code Enforcement. Board Member Richard Ouellette seconded and the motion carried unanimously. c. Case #8810: 417 Sailfish Drive Code Enforcement Officer Eddie Lopez presented the case of Rubbish Accumulation violation at 417 Sailfish Drive. Officer Lopez gave his recommendation to find the Respondent in violation of the International Property Maintenance Code, Chapter 3, Section 307.1. Mr. Bruce L. Smith received notice and is the owner of the aforementioned property, but was not present. Board Member Richard Ouellette motioned to find the Respondent in violation and allow him ten days or until June 19, 2010 to come in full compliance. Alternate Board Member Nicholas Dodaro seconded and the motion carried unanimously. d. Case # 39410, 39310: 385 St" Street Code Enforcement Officer Eddie Lopez advised the Board that Mr. Thomas J. Bennett Jr. is the owner of the property located at 385 5th Street, that notice was received and the Respondent is in compliance as of this hearing and his recommendation is to close Cases #39410, #39310. The Board agreed unanimously with Officer Lopez's recommendation. June 8, 2010 Page 3. 5. MISCELLANIOUS BUSINESS: Board Members discussed term limits that expire September 30, 2010 and several Board Members expressed interest in reappointment to serve as regular Board Members. The Code Enforcement Board will meet July 13, 2010 at 7:00 pm in the Chamber. 6.
