09 February 2010 CEB Minutes*AMENDED CITY OF ATLANTIC BEACH CODE ENFORCEMENT BOARD MINUTES 7:00 P.M., February 9, 2010 PRESENT: Chairman Carl Russell Vice Chairman Ron Pendleton Veda Bernstein Juliette Hagist Ray Martin Richard Ouellette EXCUSED: Barbara Weiss Nicholas Dodaro UNEXCUSED: AND: Michael Griffin, Building Official Eddie Lopez, Code Enforcement Officer Susan Gorman, Secretary Alan Jensen, City Attorney Suzanne Green, Prosecuting Attorney Chairman Carl Russell called the meeting to order at 7:02 p.m., followed by the Pledge of Allegiance to the Flag by all present. Secretary Susan Gorman read the roll and determined that there was a quorum. 1. Approval of Minutes: Following a brief review, the Board voted unanimously to approve the minutes of the Code Enforcement Board meeting of January 12, 2010. 2. No visitors noted and Chairman Russell asked all Respondents and witnesses to step forward to be sworn in. 3. OLD BUSINESS: a. Benjamin Brown, 457 Sailfish Drive: Building Official Michael Griffin gave an update regarding fines related to this case. b. Rena Koenig, 981 Sailfish Drive: The Building Official Michael Griffin gave an update related to Case # 427-08. February 9, 2010 Page 2. 4. New Business: Code Enforcement Officer Eddie Lopez addressed the Board and reported compliance for the following cases: Items (a, c, d, g, h, i, j, m) were taken out of sequence at this time. a. Case #125109; 736 Amberjack Lane: Rubbish removed from the property; Walter and Kimberly Peters are in compliance. c. Case #118809; 1200 Mayport Rd.: Motor Vehicle removed; KSH Properties complied. d. Case # 116909; 1921 Mealy St.: Motor Vehicle removed; Willie Johnson complied. g. Case # 104009; 955 Main St.: Structure, permits; D. Strohecker/T. Bozzuto in compliance. h. Case # 118109; 940 Main St.: Motor Vehicle removed; Raymond Dagley, Jr. complied. i. Case #82309; 785 Sailfish Drive: Rubbish; Dolly C. Caudill is in compliance. j. Case # 21109; 365 Sailfish Drive: Rubbish; Elizabeth White & Adam Zuck in compliance. m. Case # 110909; 2113 Fairway Villas Lane S: Motor Vehicle; Donald Colston & Mary Love are in compliance. Code Enforcement Officer Eddie Lopez continued with his presentation of the following cases: e.*(Case #261-09, 945 Plaza, was taken out of sequence and acted on at this time.) Respondent Bobby Knight is the owner of the property at 945 Plaza and was present. Eddie Lopez presented his case and asked the Board to note the fence and trailer violations. Board Members addressed their questions to the Code Enforcement Officer and Mr. Lopez stated his recommendations. Chairman Russell asked the Board for a motion. Veda Bernstein motioned to find the Respondent in violation and allow Bobby Knight until March 21, 2010 to repair the fence post and come in full compliance or the Board may impose a fine of $250.00 per day. Ray Martin seconded. Chairman Russell asked the Board for a roll call vote. The motion passed unanimously. b.*(Case #121109, 1447 Jasmine St., was taken out of sequence and acted on at this time.) Respondent James Sharp is the owner of the property at 1447 Jasmine St. and was present. The Code Enforcement Officer asked the Board to note the inoperable vehicle and gave his recommendation. Ray Martin motioned to find the Respondent in violation and allow until March 1, 2010 to come in compliance or the Board may impose a fine of $250.00 per day for each day after. Respondent Tommy Spence was present and is the owner of the property at 2190 Fairway Villas Lane. Code Enforcement Officer Lopez presented the case, and recommended that Mr. Sp motioned to find the Respondent inOviolation and that he compliance. Ron Pendleton must remove or repair the vehicle at the property by March 1, 2010 or the Board may impose a fine of $250.00 per day for each day after. Juliette Hagist seconded and the motion carried unanimously. f.* (Case # 121909, 331 Skate Road was taken out of sequence and acted on at this time.) Mr. George Fryer was present and is the owner of the property at 331 Skate Road. The Code Enforcement Officer explained the violation to the Board.
