CODE ENFORCEMENT BOARD MINUTES
7:00 P.M., March 9, 2010

Vice Chairman Pendleton called the meeting to order at 7:03 p.m., followed by the Pledge of
Allegiance to the Flag by all present.
Secretary Susan Gorman read the roll and determined that there was a quorum.
1. Approval of Minutes: Following a brief review, the Board voted unanimously to approve
the minutes of the Code Enforcement Board meeting of February 9, 2010.
2. No visitors noted and Vice Chair Pendleton asked all Respondents and witnesses to step
forward to be sworn in.
3. OLD BUSINESS:
a. Case # 118309,118409: 94 Stanley Road
b. Case # 119309, 119409, 119509 & 119609: 765 Sabalo Road
c. Case # 81309: 660 Sailfish Drive
Building Official Mike Griffin advised the Board of plans to serve revised Notice of Violation to
the Respondents in Items 3( a-c) and he asked the Board to withdraw the cases and consider
action at a later date. Board Members unanimously agreed to the Building Official's request.

4. NEW BUSINESS:
a. Cases # 125709: Respondents Scott Dunn and Lyndee McClure own the property at 66
9"' Street West and were present. Eddie Lopez presented the case and asked the Board to
note the fence violation. Board Members addressed their questions to the Code
Enforcement Officer and Mr. Lopez stated his recommendation. Discussion ensued. Vice
Chairman Pendleton asked the Board for a motion. Veda Bernstein motioned to find the
Respondent in violation but to allow the Respondents thirty days to apply for a fence
permit and to omit fines at this time. Barbara Weis seconded. Vice Chair Pendleton asked
the Board for a roll call vote. The motion passed unanimously.
b. Cases # 3410: Respondent Sally Lopez is the owner of the property at 741 Cavalla Road,
but was not present. Eddie Lopez presented his case and asked the Board to note the
rubbish violations. Mrs. Lopez's son arrived during Eddie Lopez's presentation, but was
sworn in by the Vice Chair. Discussion ensued and the Code Enforcement Officer stated
his recommendation. Veda Bernstein motioned to find the Respondent Mrs. Lopez in
violation and full compliance must be met by March 24, 2010 in order to avoid a fine of
$250.00 per day and for every day thereafter. Ray Martin seconded and the motion
carried unanimously.
c. Case # 2510: The Board was advised that Ms. Beatrice Dodds, owner of the property at
2166 Fairway Villas Lane was not present. Code Enforcement Officer Eddie Lopez gave
his presentation and asked the Board to note the door violation (garage) and made his
recommendation. Mr. Lopez informed the Board of conversations with a local pastor that
indicated his plans to assist Ms. Dodds replace the existing garage door. Barbara Weis
motioned to find the Respondent in violation and Ms. Dodds must come in compliance
by April 10, 2010 or face a fine of $250.00 per day and for every day thereafter. Veda
seconded and the motion carried unanimously.
d. Case # 129409: Kirt Lynch, owner of the property at 1400 Mayport Road was present.
Eddie Lopez presented his case and asked the Board to note the fence height and permit
issues. The Code Enforcement Officer took questions from the Board. Mr. Lynch
addressed the Board. Juliette Hagist motioned to find the Respondent in violation and that
full compliance must be met by April 13, 2010 unless the fence is removed or the Board
will impose a fine of $250 per day and for every day thereafter. Ray Martin seconded
and the motion carried unanimously.
e. Case # 124109: Mr. John C. Lane is the owner of the property at 342 Seminole Road but
was not present. The Code Enforcement Officer presented his case and informed the
Board that Mr. Lane does not currently reside in Atlantic Beach, Florida. The issue is

a violation of Single Family Residential use. Eddie Lopez distributed copies of a letter
from the Respondent, and Mrs. Lane, the Respondent's mother, requested permission to
read her son's letter to the Board. Discussion ensued and the Board addressed their
questions to Mrs. Lane and the Code Enforcement Officer. Veda Bernstein motioned to
find the Respondent in violation, but to allow Mr. Lane until August 1, 2010 to come in
full compliance or the Board will impose a fine of $250 per day and for every day after.
Ray Martin seconded and Vice Chairman Pendleton called for a roll call vote.

f. Case 1129-09: 2337 Seminole Road; Atlantic Beach City Code, Chapter 24, Sec. 24-82
(1), Short Term Rental violation, was not presented. The Board agreed to a continuum,
allowing Code Enforcement to present this case for the next regularly scheduled Code
Enforcement Board meeting.
5. MISCELLANIOUS BUSINESS:
Board Members agreed to schedule a regular meeting for April 13, 2010 at 7:00 pm in the
Commission Chamber.
