Community Development Director DATE: December O1, 2005 • ~ BACKGROUND: In response to recent concerns expressed by some residents over the division of existing large lots into new minimum 75-foot wide by 100-foot deep lots, the City Commission may wish to consider alternatives for retaining these lots as they were originally platted. There are • ~ very few areas within the City that contain such larger lots, and these are located mostly within the first portions of the original Selva Marina subdivision, which was platted during the 1950s. ` ~ As of this date, the Subdivision regulations allow for the administrative division of a single lot into two lots, provided that each new lot meets the minimum width, depth and lot area requirements of the particular Zoning District where it is located, as well as the density limit of the Comprehensive Plan. As such, a lot that is 150-feet in width and 100-feet in depth could be divided into two 75- • foot wide by 100-foot deep lots, provided all other requirements are also met. Again, this type of lot division can result only in two lots. A division that creates more than two contiguous lots must • ~ be considered as a Subdivision plat or replat as set forth by the procedures in the Land • Development Regulations. If it is the direction and the desire of the community, the City Commission my wish to consider the creation of an additional single-family residential Zoning District that establishes a larger • minimum lot size consistent with those large lots as they exist in the older Selva Marina subdivision. For example, a Zoning District named RS-L (Residential, Single-family-Large Lot) • could be created, which establishes a nninimum 10,000 square-foot lot area with a minimum • , required width of 100-feet and a minimum required depth 100-feet. The area to be encompassed by this new Zoning District would then need to be rezoned to the new classification. (This would ' be somewhat similar to the process the City used when the Open Rural (OR) Zoning District was eliminated and the Conservation District was created, or when the RG-1 (Two-family} area was rezoned to RS-2 (Single-family.) This would have the effect of prohibiting future lot divisions in • this Zoning District, including the administrative two-lot divisions, since it appears that there are .. no lots of sufficient size within the City to meet the minimum width and depth requirements of such a new Zoning District. Existing lots would continue to be considered Lots of Record, and the ' new Lot Area requirements would apply only to new lots. BUDGET: No budget issues. . , RECOMMENDATION; Direction from City Commission to seek input from the community and proceed with process as described herein, including review and recommendation from the Community Development Board.
