AGENDA ITEM: Final Plat for a four (4) lot single-family subdivision of previously un-
platted property located on the north side of Cornell Lane, east of
Mayport Road and to be known as Cornell One subdivision.

BACKGROUND: The proposed plat contains four lots, which comply with the RS-2
' Zoning District regulations and the Comprehensive Plan low-density category. The subject
property has not been previously platted. In that more than three new lots are created, Florida
Statutes, Chapter 177, require the recording of a plat.
' Planning staff has requested, and the developer has agreed, that provision for the continued
private maintenance of stormwater facilities will be addressed by a note on the Final Plat and
within private deed restrictions. (That note is on Sheet 2 of the plat.)
All lots will be developed in accordance with the RS-2 zoning district standards. Central water
and sewer will be provided. Staff finds that the proposed plat is consistent with the
Comprehensive Plan and applicable Land Development regulations, and accordingly,
recommends approval of the proposed plat.
The Community Development Board considered the preliminary plat at their December 17th
meeting and recommended approval, subject to the deed restriction and plat notation as
' requested by staff, and also that street design and any required easements comply with City
standards.

BUDGET:, No budget issues.
RECOMMENDATION: Approval of the Final Plat for afour-lot subdivision know as
Cornell One, subject to a condition that stormwater retention, drainage facilities and structures
shall be privately maintained buy the property owners, all successors and assigns.

DECEMBER 17, 2002
A regular meeting of the Community Development Board was held Thursday, December 17,
2002, in the City Hall Commission Chambers. Present were Chair Don Wolfson, Craig
Burkhart, Robert Frohwein, Karl Grunewald, Samuel Jacobson, Steven Jenkins, Mary Walker,

1. Call to Order
The meeting was called to order at 7:00 p.m.
' 2. Approval of Minutes of Meeting of November 19, 2002
A motion was made by Mr. Burkhart, seconded by Mr. Grunewald and unanimously carried to
approve the Minutes of the Community Development Board meeting of November 19, 2002.

~~1^~~ a. Plat-2002-02 Beaches Habitat. Request to consider a preliminary plat of a four (4)

Chuck Kennedy, 2115 Bay Road, Neptune Beach, with Connelly and Wicker, was
present representing Beaches Habitat and answered questions by the Board. Staff
explained that this land has not been previously platted, and since more than three new
' lots were being created, the approval and filing of a subdivision plat is required by
Florida Statutes. Staff advised the Board that the four single-family lots comply with the
Comprehensive Plan and the zoning and subdivision regulations. The Board discussed
I the project and Staff's recommendation, particularly concerning the maintenance of the
drainage and retention pond. A motion was made by Steven Jenkins, seconded by 1VIr.
Grunewald, and unanimously carried to recommend approval to the City
Commission of the proposed plat, subject to construction of the street complying
with city standards, and also subject to Staffs recommendation that deed
restrictions and notes be included on the Final Plat, which provide for continued
' private maintenance of all drainage improvements and stormwater facilities. (Mr.
Burkhart acknowledged a conflict of interest and recused himself from voting on the
motion.)
' b. Review and recommendation to Citv Commission of revisions to Chapter 24, which
would create new Commercial Corridor standards that would apply to Commercial
' Zoning Districts along portions of Atlantic Boulevard and Mavport Road. The
Board and staff discussed the revisions made to Chapter 24.

STAFF COMMENTS AND RECOMMENDATION
The proposed preliminary plat contains four lots, which comply with the RS-2 zoning district, the

The proposed subdivision has been reviewed by the Public Works and Public Utility Departments,
with minor comments, which will be addressed in the construction and engineering plans. Planning
staff has requested that provision for the continued private maintenance of stormwater facilities be
addressed on the Final Plat and within deed restrictions.
All lots will be developed in accordance with the RS-2 zoning district standards, as well as other
applicable land development regulations. Central water and sewer will be provided. Staff finds that
the proposed plat is consistent with the Comprehensive Plan and applicable Zoning, Subdivision and
Land Development regulations, and accordingly, recommends approval of the proposed preliminary
plat.
SUGGESTED ACTION TO RECOMMEND APPROVAL
The Community Development Board may consider a motion to recommend approval to the City
Commission of a preliminary plat for a four (4) lot residential subdivision within the RS-2
Zoning District, to be known as Cornell One subdivision, and as described within the attached
legal description, subject to the following conditions and findings:

• Deed restrictions and notes shall be included on the Final Plat providing for continued
private maintenance of all drainage improvements and stormwater facilities.
