The Atlantic Beach City Commission held a Public Hearing curing the regularly scneduled meeting of the 1Gth of r ub, uary LU18. After public comment and Commission discussion, the re -slat was approved by unanimous vote. There may be other historical information, not presented in this chronology and not available at the time of the drafting of this report. J UJ I IVILAI IUN: tsecause of comments offered by the public dui ing the rublic Hearing held on the 1Lth of N'ebruary LU18 by the Atlantic Beach City Commission, Commissioner Stinson as Chairperson of the rz,)AxC asked members of the on the rz,)AxC 15Lh of N'ebruary GU18 to review the impact the develupment might have on pedestrian safety in the area surrounding the approved re -platting and the proposed develupment. This matter was again placed on the agenda P2SARC for the 1st of March 2018. During this meeting and the resulting discussion, including inquiries made of Sergeant Jevic, the Ai3PD liaison to the P2SARC, about ABPD activity in the area, the PzSARC members voted unanimously to request the City Commission take action to ensure pedestrian safety in the area. The recommended action is to install temporary, no -parking signs along the north side of Ahern Street, between East Coast Drive and Sherry Drive, during construction of the Northshore Condominiums. (The location and number of any permanent "No Parking' signs to be reviewed and determined after construction is complete.) It is believed by the members of the P2SARC that it would be prudent to take these necessary steps to protect pedestrians traversing the area from construction vehicles and to prevent vehicular parking from continuing to encroach onto the sidewalks along the development as is now being experienced. BUDGET: Budgetary impact has not been determined at this time. RECOMMENDATION: 1. Install temporary "No Parking' signs along the north side of Ahern Street, between East Coast Drive and Sherry Drive, during the construction of the Northshore Condominiums. Planner Reeves explained that the future la,,a use otT:he properties includes Residential Medium (RM) and Resiaential General Multitamily (RG -M) zoning. This properties are adjacentto a single- family zoning district to the NortFi, and tFie central Business district to Lne South. He then explained T:5at T:5e proposed plan is to construct a 12 -unit townhome development, consisting of four, three story buildings where each unit will have a two -car garage-. Statt then aispiayea the proposed site plan, which showed that there would be two driveways which would Be accessed througll East Coast Drive. Tnis issue had been discussed at a prior meeting of the Community Development board, when the applicant requested a variance for the proposed construction. Since this meeting, tRe applicant has slightly modified the parking arrangement along East Coast drive, however, there will still Be parking directly along t5is street. He explained that prior to L5is construction, the applicant would need to go Orougn the tull permitting process with all applicable City Departments. Re then noted that the current request was for a re -plat of LRe property and as such, the Board would be recommencing approval or denial of this plat request, not of L5Q proposed construction, to LRe City Commission. Previously, the units were going to Be considered condos wits a condo association maintaining tMe ownership of the units. If this re -plat requestea were approved, the units would each Be individually -owned townnomes. The property then, woula Be divviea up into 12 inaiviaual parcels with independent ownership. Staff noted zFiat -c5ere is an existing easement on the West side of the property tRat will remain in place, to allow a driveway arcess to the adjacent property for the residents who live LRere. There are also ingress ana egress as well as utility easements covering much of the property, other than where the units will Be. Az this point in Page z of 6 time, these easements have not Been legally reviewed By City Statt nor By t5e City Attorney. Statt noted that this would Be a requirement prior to sending the application to City Commissioii. An approved re -slat is required in this circumstance because the applicant wishes to subdivide their property into 3 or more parcels. The property is just under 0.9 acres, allowing for 11.6 units total. They are proposing to construct 1z units. CRair Paul questioned ittMis re -plat request would possiBly nave to be modified then brought before the Board again if the easements are Lound to be inadequate or inappropriate. Statt replied that the easements on the property should not attect the re -plat pi oposed tonight. Instead, the review of the easements will help give shape to the legal language of this re -plat. Mr. Stratton reterenced the meeting of the Community Development Board where this application was previously brought before them. He commented on the concern that was raised ai that meeting, regarding the driveways which would exit onto East Coast Drive and the effect that would have on the traffic at that intersection (ot Easi Coasi Drive and Ahern Si.) He asked siatt what tMe parking and driveway situation would Be entering and exiting East Coast Dr. with this current re -plat request tonight, Staff explained LRat w1LR the currently proposed parking layout, the units along East Coast Dr. would each have two parking spots in their garages, and would share a drive aisle io gain access io and trom these parking spots. This drive aisle would Be regulated By easements for ingress ai ,d egress, so that it would remain clear for all units io properly access their parking spaces. Mr. Reichler commented on the [Community Development] Board's responsibility to ensure that anything they are approving meets the requirements and goals of the City's Comprehensive Plan and Land Development Regnlations, He asked whether or not any City Statt Mad reviewed this re -plat request to make sure that it does meet these criteria. Staff responded that while minor tweaks to The request may need to Be made at tinal permitting, the project proposed was consistent with the City's Comprehensive Plan and Land Developmeni Regulations. Mr. Reichler. asked Staff if the applicant's landscape plai, was consistent wiLR the City's requirements regarding tree mitigation, Yagin 3 of 6 Applicant Comment Start replied that He did not believe it did, However, he was still doi,ig the calculations for this proposed plan. Mr. Mandelhaum questioned whether or not the Plat request complied wish all applicable City legislation. Statt replied that it did meet such criteria. Cham Paul claritied that the application was being brought Betore the Community Development Board due to the num5er of parcels being created through the parcel split. Rick johnstun, 3528 Ocean Drive, Jacksonville Beach FL 32250, introduced himselt as the applicant. He explained that at a prior meeting of the Community Development Board, he presented an application fora variance as the structures were going to originally be condos, but that He withdrew that application due to the tension present at the meeting. Following the meeting, he met with some otthe neighbors near His property and worRed with the City of Atlantic Beach's Public Works Department to try and address any issues that came up in the conversations. He added that along with these changes, he added a wide, sidewalk along the street in addition to more parRing spaces, while trying to maintain the integrity of his design. Mr. Johnston then cornmented on the easements on site. He stated that he had met with the City's Public Works Department to discuss these easements along with the Water and Sewer utilities on-site. He noted that they also Have worRed with JEA to plan out how the electric utilities will be tied in to the Buildings. I He applicant then went on to discuss his landscape plan, specifically, the t, ees they chose to keep on-site versus those they need to remove. Mr. Johnston then spoke to the drive aisles which would enter and exit ott of East Coast Drive. He stated that he tried to taRe into account the residents who would Be immedlately ettected. At the same time, He did not tind another parRing option. Mr. Elmu, e questioned what the length of the property was along Ahern Street and East Coast Drive. Mr. ReicRler commenteq that while Fie was not personally in favor of the proposed design of the proposed construction, Fie could not vote against tRe application Betore the Boarq so long as it was consistent with tRe City's Comprehensive Plan and Land Development Regulation. CFiair Paul clarified that the Board was only voting on tRe approval or denial of tFie applicant's request to subdivige the lot, per their Plat Request. Ms. Lanier commented tRat sliie Believeq the gesign presented to tRe Board for the proposed development to be consistent with the surrounding communiry. At the same time, sliie expresseq her concern tortRe ingress anq egress points along East Coast Drive, in light of the traffic along that road.
